Bengaluru: HC directs dowry properties to be included in property division

Bengaluru, Feb 26: The state high court has ordered that when seeking the division of properties as per the Hindu Succession Act, properties given in the form of dowry have also to be included.

Hemalata from the city had filed this suit. A single judge bench of the court presided over by Justice Suraj Govindaraj passed this order.

"Under the Hindu Succession Act section 6, the property set to be divided is the joint property of the family. This includes the dowry, gifts, property etc given during the marriage," it observed.

The brother of the petitioner had filed suit in the city civil court here seeking to include two properties which were given to his sister during her marriage. The court had upheld his plea and passed an order on August 8, 2018. Against this order, Hemalata had approached the high court.
