Supreme Court to set up 3-judge bench to hear Karnataka hijab ban issue


New Delhi, Jan 23 (IANS): The Supreme Court on Monday agreed to examine a plea to constitute a three-judge bench to consider petitions challenging ban on hijab in classrooms of pre university colleges in Karnataka.

Senior advocate Meenakshi Arora, representing some petitioners, mentioned the matter before a bench headed by Chief Justice D.Y. Chandrachud.

She said the matter is urgent in view of the impending examination scheduled in February and added that students have moved to private colleges after the split verdict. Arora further contended that the examinations can only be conducted in government colleges, therefore students may be permitted to appear in the exams wearing hijab.

The bench, also Justices V. Ramasubramanian and J.B. Pardiwala, asked the counsel to mention before the registrar. The counsel submitted that the matter may be taken up for interim order.

The bench said, "This is a three-judge matter. We will do it."

The Supreme Court, in October last year, gave a split verdict on petitions challenging the validity of ban on hijab worn by some Muslim girl students in classrooms of pre university colleges in Karnataka. The split verdict was delivered by a bench comprising Justices Hemant Gupta and Sudhanshu Dhulia.

Justice Gupta upheld the Karnataka government circular and dismissed the appeals against the Karnataka High Court judgment. However, Justice Dhulia quashed the Karnataka government's decision to ban wearing of hijab inside classrooms of pre-university colleges, saying that the Constitution is also a document of trust and it is the trust the minorities have reposed upon the majority.

Justice Dhulia, in his judgment, said: "We live in a democracy and under the rule of law, and the laws which govern us must pass muster the Constitution of India. Amongst many facets of our Constitution, one is Trust. Our Constitution is also a document of Trust. It is the trust the minorities have reposed upon the majority."

The bench had said since there is divergence of views, the matter would be posted before the Chief Justice of India for setting up a larger bench.

    Let them wear what they are comfortable with. Why do we try to impose rules on women dressings. In Iran women are forced to wear the Hijab and in India we are opposing. Its none of our business. Leave them alone. When I sau "them" it includes all women irrespective of caste, religion, nationality.

    Ramesh..In Iran womens protested by themselves to get rid-off Burqa/Hijaab as need freedom. Even in Saudi Arabia announced there is no compulsory to wear it. Do you think these people wear Burqa/Hijaab during holidays to european countries. In flight itself they change themselves by removing burqa and stuff in bags will find with branded jeans and t-shirt. They are not caged animals are living once on this earth. Do you know how many people killed in Iran revolution and how many people hanged upto now. All need changes in this world.

    Pankaj, Ramesh Poojary commented " Let them wear what they are comfortable with". This means if anyone want to wear, let them wear, if any woman do not want to wear hijab, its her wish, let her go without Hijab. Its purely their personal decision. Let us concentrate on the practices which is affecting the society such as dowry, female infanticide, untouchability within one's own faith, and do not poke nose on other's affairs.

    Hijab, turban, skull cap or any other ethnic dresses, all are part of different diversified culture indians use to represents earlier. it was the country famous for Inclusion and diversity, today it is altogether different situation, We are not allowed to showcase diversity. There are cases where inclusion also screwed up. Now we need to live with fear, feeling of insecure and broken relations.

    Udupi Girl Students are done rift in between communities will not solved in future so easily..from Jhatka/Halal to no shops near religious places. No one use to wear burqa during world cup cricket match. Even wife of Jordan King never wear Burqa/Hijab..inspite of descendants of Prophet.

    Still they didnt obtained NOC by agitating students. Verdict will remain the same. Again will pronounce Allah Ke Ghar Dher hai..Aur Mumkin Nahi..
