Bengaluru, Aug 17: Activist T J Abraham, a key complainant in the Mysuru Urban Development Authority (MUDA) site allotment case involving Chief Minister Siddaramaiah, is preparing to advance the case to the special court for public representatives.
Abraham plans to submit the sanction granted by Governor Thaawarchand Gehlot, requesting the court to take cognizance or refer the case under Section 156(3) of the CrPC.
“We will present this sanction to the special court and ask the judge to take cognizance or refer the matter under Section 156(3) of the CrPC. I will make this submission on August 21,” Abraham told reporters in Bengaluru.
The Governor’s sanction, issued under Section 17A of the Prevention of Corruption Act, 1988, and Section 218 of the Bharatiya Nagarik Suraksha Sanhita, 2023, allows for the prosecution of Siddaramaiah for the alleged offences described in the petitions filed by activists Pradeep Kumar S P, Abraham, and Snehamayi Krishna.
In addition, Pradeep Kumar has filed a caveat with the Karnataka High Court to ensure that if Siddaramaiah seeks relief, the court will consider the complainants' arguments.
“The caveat is crucial to ensure that any relief granted to Siddaramaiah does not overlook our side of the case,” Kumar explained.
