Attempt to murder Urwa police ASI: Accused gets 7 years rigorous imprisonment, fined Rs 50,000

Mangaluru, Apr 28: In connection with the attempted murder of Urwa police station ASI Aithappa, the additional district and sessions court, FTSC-1 fast track court, has sentenced accused Mohammed Niyaz (29), a resident of Kana, Surathkal, to seven years of rigorous imprisonment and imposed a fine of Rs 50,000.

According to the complaint filed by Urwa police station ASI Aithappa, the incident occurred at around 3.20 am on April 5, 2017, near Ladyhill Circle in the city while he was on patrol duty on a motorcycle. Two persons approached him on another bike from behind. The rider, identified as Shameer, asked him in Tulu which police station he belonged to. When Aithappa replied that he was from Urwa police station, Shameer instructed Mohammed Niyaz, who was riding pillion, to assault him.

Following this, both the accused allegedly struck Aithappa forcefully on the back of his head with an iron rod, causing injuries and attempting to kill him. The accused fled on the motorcycle after noticing members of the public approaching the spot.

Then assistant commissioner of police Uday M Nayak, who was the investigating officer, conducted the investigation and filed the charge sheet before the court. The case was heard in the additional district and sessions court, FTSC-1 fast track court. After hearing the arguments, Judge Mohana J S delivered the verdict on Monday against second accused Mohammed Niyaz.

The court awarded two years of rigorous imprisonment and a fine of Rs 10,000 under Section 332 read with Section 34 of the IPC, three years of rigorous imprisonment and a fine of Rs 15,000 under Section 333 read with Section 34, and seven years of rigorous imprisonment and a fine of Rs 25,000 under Section 307 read with Section 34.

Out of the total fine amount of Rs 50,000, the court directed that Rs 45,000 be paid to the injured ASI as compensation.

The first accused, Shameer, failed to appear before the court and is absconding abroad. Trial against him is pending.

Government prosecutors Harishchandra Udyavar and K Badrinath Naari represented the prosecution.
