Katju seeks pardon for Zaibunissa in 1993 Mumbai blasts case


New Delhi/Mumbai, Mar 27 (IANS): After actor Sanjay Dutt, Press Council of India chairman Markandey Katju Wednesday sought a pardon for Zaibunissa Kazi, another convict in the 1993 Mumbai blasts case.

The former apex court judge said that he would write to President Pranab Mukherjee and Maharashtra Governor K. Sankaranarayanan to pardon Zaibunissa Kazi, 70, on humanitarian grounds.

"Zaibunissa Kazi also deserves a pardon. I was earlier considering her case and after going through her judgement file, I am of the firm opinion that she also deserves a pardon," Katju said in his blog.

"I have decided to appeal to the president of India as well as the governor of Maharashtra to pardon Zaibunnisa and Sanjay Dutt," he said.

The Supreme Court verdict Thursday upheld Dutt's conviction for illegal possession of prohibited weapons like an AK-56 assault rifle and a revolver and sentenced him to five years in jail.

Two days ago Katju had said that he received an e-mail from Shagufta, Zaibunnisa's daughter, appealing to him to seek pardon for her mother.

Shagufta, 40, told mediapersons that her mother was innocent and she had only agreed to keep a bag containing AK-56 rifles, bullets and hand grenades that was brought to her by Abu Salem and Manzoor Ahmed Sayed Ahmed. She said that Zaibunnisa was not aware of the contents of the bag.

"I wish I was a celebrity or my mother was a celebrity, then I would also get all the support that Sanjay Dutt is getting today. If it is on humanitarian grounds, then why only Sanjay Dutt, why not Zaibunissa?" she asked.

Zaibunnisa was a co-accused in the 1993 bomb blasts case and was sentenced to five years imprisonment.

"The only charge on which she has been convicted is possessing some prohibited weapons. It was not disputed that no recovery of any weapon was made from her house. In my respectful opinion she should at least have been given the benefit of doubt," Katju said.

"Zaibunnisa is a widow with various ailments. She had a kidney operation some time back, and has to be screened every six months. She can hardly walk. I do not think she will survive for long in jail. Even on merits, I am of the opinion that she deserves a pardon," he said.

On being criticised for seeking pardon for Sanjay Dutt, Katju said: "Some people have said that many others will also appeal for pardon. My reply is that I am willing to consider every case which is brought to my notice."

"But I will make an appeal only if after carefully studying the relevant material I am satisfied that the case deserves pardon. I make no distinction between a celebrity and non celebrity. Paragraph 125 of the Supreme Court judgment states that she is not guilty of the main charge of conspiracy," he added.

    i am not against pardon, but atleast let sunjay enter the Jail once, then all can talk about pardon, This Katju is already submitted pardon request to Governor.
    At least let him serve 2.5 year in jail out of 5 year sentence.
    Although every one helped Sunjay to get away with link to blast in 1993.
    he is convicted for only illegal weapon.
    And i am sure that, in case sunjay gets pardon from any one(Governor or president )there are people who will make sure that he serve his sentence

    Markandeya Katju himself is a Kashmiri Pandit, and he should go to dungeons called rehabilitation Centres in Jammu to see how the Kashmiri Pundits uprooted from their homes in the Valley by the Pak Terrorists, are living a hellish life there, and then he should talk about pardoning all those who assisted knowingly or unknowingly, to the terrorists from our enemy countries.

    If these two are to be pardoned then the entire list of people from who had brought,found certain places to preserve it safe in the celebrities house and finally who planted the bombs are to be pardoned as nobody knew anything what is lying inside the bomb before planting,as it was not open and visible.GOOD joke.....

    This makes a complete mockery of the justice system and the Apex court orders!

    Humanitarian ground is a very broad term and in that any and every crime can be brought under its umbrella!!

    If these two can get amnesty under this umbrella why not all those with equal or less serious offences?

    Even after tehelka expose clearly shows people referring to Modi for his invaluable support during Gujarat riots under his eyes has come out clean and now looking for the PM post. This lady was fooled to keep the bag without knowing what was in it.
    This is not even close to a crime in this case and she has to be pardoned !

    Mr. Indian, Mangalore. For your kind information Katju is not above the Supreme Court and he was always upheld the Supreme Court verdict. But there is provision and clause also in Indian constitution that governor and/or president can pardon any accused after getting the judgment from Supreme Court based on the case in some circumstances so Katju is appealing to governor to pardon after reviving the case of her as a humanitarian. I hope Mr. Indian will understand.

    Why Katju did not raise this issue before....When Sanjay Dutt (VIP) got punishment than only he come to know. As every one knows Sanjay dutt had close contacts with D company. CBI also did not book him under TADA because of high influence...First try to understand Sanjay dutt's personnel life when he was young....
    According to me he got less punishment because of his VIP influence....he should be punished more....If he is a real Indian he should not seek pardon and should surrender himself.

    Both belong to same category.

    If Sanjay Dutt is pardoned, then there will be thousands of requests across the country from convicts who have committed lesser crimes.

    So, Dutt will be not be pardoned.

    Can anybody tell me Killing with BOMB is more painful than killing with TRISHUL AND BULLETS?
    The SC verdict surely relieved the pain of those families who lost their dear ones in Bomb blast but what about the pain of those who lost their nears and dears in two months long bloody riots in Mumbai just a month before the bomb blast.
    I am with the government for punishing the people who are responsible for killing the innocent people by blasting bombs. At the same time they also need to punish the people who are responsible for instigating the people to kill during riots and the police officers who did not do their job properly rather they were bias and turned the guns towards a section of people.

    Should take stern action against katju..people should protest in large numbers.. nobody is up above judgement of court. if these people are go on delivering verdict what's the use of courts..just abolish it. what it means by katju.. is it item if you purchase one ..will offer one free.
    if sanju is released...should also to release..Zaibunissa. Better even paradon people who involved in ahmedabad blasts...who digged tunnel..to escape...!! what's the difference...!! No mercy for Police Personnels/Army Officers who killed in defence to protect nation...!! Everything pre-planned looks like..all will come out one by one..like kalmadi..!!

    I welcome and respect the verdict of the Supreme court on the Mumbai serial blasts but what about the Mumbai riots victims of December 1992 and January 1993 in which more than 900 Muslims were killed and properties worth more than Rs 10000 crore were damaged by rioters and police? The police officers who not only failed to perform their duty but shoot the innocent people inside the place of worship. The police officers, who were accused by Sri Krishna commission, got promoted to higher ranks. Some of the politicians and leaders who instigated the killings are carrying larger images now. Why? Why and Why?

    Yes..If Sanjay gets favour from the court,then Zaibunissa must get that favour.She should be pardoned considering her age. Very important factor in this case that Zaibunissa's daughter claimed that her mother didn't know what was inside the bag.I feel,that might be true.Even Sunjay Dutt was saying the same thing "I didn't know"..So, law is equal to everyone. No celebrity can misuse law..
