Mumbai dance bars back as Supreme Court lifts ban


New Delhi, Jul 17 (TNN): The dancing girls will be back in the beer bars of Mumbai, with the Supreme Court on Tuesday upholding Bombay high court's verdict to junk Maharashtra government's decision to banish them from the city's famous night life.

Though the state government can put curbs on dance bars to prevent obscenity if it so wishes, the order is seen as a setback to Maharashtra home minister R R Patil, who pursued the ban virtually as a personal mission, and will be cheered by many who saw the ban as overzealous moral policing.

A bench of Chief Justice Altamas Kabir and justice S S Nijjar said the state government's 2005 decision to amend the Bombay Police Act and impose a complete ban girls dancing in bars in the name of ensuring safety of women and curbing obscenity was an overreaction, which reflected lack of thinking to search for viable alternatives, and resulted in large-scale joblessness among women.

"The restrictions in the nature of prohibition cannot be said to be reasonable, inasmuch as there could be several lesser alternatives available which would have been adequate to ensure safety of women than to completely prohibit dance. In fact, a large number of imaginative alternative steps could be taken instead of completely prohibiting dancing, if the real concern of the state is the safety of women," Nijjar said, authoring the main judgment.

Agreeing with him, Kabir said the expression "the cure is worse than the disease" came to mind immediately as many dance girls who lost their livelihood because of the complete ban on dance bars had been forced into prostitution.

"The state has to provide alternative means of support and shelter to persons engaged in such trades or professions, some of whom are trafficked from different parts of the country and have nowhere to go or earn a living after coming out of their unfortunate circumstances," the CJI said, while suggested putting in place a "strong and effective support system" for them.

Rejecting the state government's appeal against the 2006 judgment of the high court, the court said instead of a complete ban on dance girls in pubs and bars, the state could consider the alternative suggestions made by a state-appointed committee like banning dance girls from exposing body or wearing tight and provocative clothes during performances.

The committee had also suggested keeping customers in the pubs and bars away from the dance girls by erecting railings around the dance floor which should be a minimum of 10x12 feet accommodating a maximum eight dancers, no showering of money by customers on dancers and a register maintaining the name of each dance girl engaged at the bar.

The court said the state promulgated the 2005 ban on dance girls despite the fact that no authority was asked to take steps to implement the suggestions of the committee and urged the government that "it would be more appropriate to bring about measures which would ensure the safety and improve the working conditions of the persons working as bar girls".

"The discontinuance of bar dancing in establishments below the rank of three star establishments has led to the closure of a large number of establishments, which has resulted in loss of employment for about 75,000 women employed in the dance bars in various capacities," Kabir said.

"In fact, as has also been commented upon by my brother (Nijjar), many of these unfortunate people were forced into prostitution merely to survive, as they had no other means of survival," the CJI said, describing that the closed dance bars presented a Hobson's choice to the girls who lost employment.

"From the material placed before us and the statistics shown, it is apparent that many of the bar dancers have no other option as they have no other skills, with which they could earn a living. Though some of the women engaged in bar dancing may be doing so as a matter of choice, not very many women would willingly resort to bar dancing as a profession," the CJI said.

    Mr. Vincent Rodrigues, ban dance bar. No problem. But, before that make necessary provision for 75 thousand employees (bar girls) for proper employment for their family's survival. All of a sudden a crazy, illiterate Minister can not forcibly close dance bars and throw these girls to street. Why can't he stop the dance of movie stars/item girls dancing naked on New year eve and collecting 90 lacs for 5 minutes nanga naach ? Why only after these helpless, poor girls ? Why can't he raise his voice against Bollywood's semi naked dance on screen ? Or is he enjoying it secretly ? 'Malaa Mota Maal paayje' is the story behind dance bar closure. Nothing else.

    The Supreme Court decision on lifting the ban on dance bars in Bombay seems to be not encouraging when the state government not in favour of it.This will really effect the modesty of the men and women too may get exploited in so many ways.Good to know that the state is going to challenge this decison in higher bench and let us all hope for the best.Thanq.

    I Really appriciate the decision of
    the court to lift ban on ladies bar.
    Because of this R R Patil so many
    people lost their job.So many youths from our Dist.will get a job
    once again.It is the duty of the
    police to look after the security
    of lady staff.Hotel management
    has to provide transport to male & female staff to reach their destination.

    Similarly they have banned Live Music Bands(in many States)while DJ music is allowed which can bring the stage down with their high decible noise.

    RR Patil did not get the crores as hafta from Bar owners.One sardar owner flately refused. Only RR patil is behind this decision of closing the dance bars.Opening it is a welcome decision. As such when there are other licenced evils like alcohol sale and prostitution what is wrong in Dance Bars?It is also ridiculous when other states allow this and one particular state because of ego of one person banned it.

    We should appreciate court decision to lift ban on dance bars. When Ministers do not get enough hafta, they try to close the business. Mr. Jude has rightly said. RR Patil is most incompetent and stupid Minister which was proved by his comments during Mumbai attack. Poor girls now can live and support their family as well. No girl wish to dance in front of bevdas unless they are helpless. Do not snatch their daily bread for your selfishness Mr. Patil. They do not force anyone from street to come and drink in their bars.

    After the Mumbai attack RR Patil had to quit for his stupid comments. After the fresh elections, he has been again brought back as Home Minster. He is totally incompetent when it comes to law and order and has made it his mission to go after the poor bar girls who are only trying to earn a living. He is busy wasting Police personnel by asking them to keep tabs on bars to run behind and harass these poor girls and these guys keep themselves busy by extorting money from the bar owners and have the least concern for maintaining law and order in the city. Therefore this is a welcome step by the Supreme Court and I hope this RR Patil is sacked from the ministry for incompetence and a new Home Minister is appointed who will take better care of law and order, terrorism, corruption and forget the bar dancers and let them live their lives in peace.

    So, now all Bhoothakola, Samardhane, Nagamandala, Raashi Pooja, etc, etc will starts in flying colour in our Coastal region, since many of our people from Coastal regions owns Dance Bar and Restaurants in Mumbai. Let us not debate on girls dance in Bar, but I would appreciate these Bar Owners if they treat their other Bar Employees too in par with these dance girls by giving at least leave salary, ticket charges, medical reimbursement, etc. If you don’t treat humans with care then what it is the use of “Pooja Ceremony”?

    People from all over India travel to Dubai, Bangkok to sit and relax at a ladies beer bar. That means crores of money is going out every day and night. The SC should allow ladies bars at every city so that people have places to relax. This also controls the moral policing by the so called social reformers. I wonder why the RSS,VHP, is silent after this court ruling.
