Indian doctor found guilty of rape charges in Australia


Melbourne, Sep 17 (PTI): A 39-year-old Indian doctor was today found guilty by Australian Supreme Court of raping two women during consultations, even as he pleaded not guilty to the charges.

Manu Maimbilly Gopal was arrested on March 1 at Melbourne International Airport while waiting to fly to Kochi after contacted by local police about the sexual assault claims.

Gopal was accused of digitally penetrating two women after telling them they needed internal vaginal examinations when they complained of abdominal pain during separate visits to a Sunbury medical clinic in February last year.

He was found guilty after a two-week trial.

Justice Geoffrey Nettle remanded him for a pre-sentence hearing on September 26, according to 'The Age' newspaper.

The report said that Gopal took his first victim, an 18-year-old full-time student suffering from stomach cramps, to the consultation room and locked the door.

"(The young woman) told you that she didn't understand what the internal examination would involve, where it was going to be," Crown prosecutor Lesley Taylor said in her closing address to the jury.

The examination took up to four minutes and Gopal did not take notes.

The victim after the examination said she "crumbled" and her boyfriend had to hold her up as she cried uncontrollably.

"She said the perfect word to describe how she felt was violated," Taylor said.

The other victim was a mother of four who went to see the doctor because of bad pain to her right side.

Gopal told the woman that her symptoms could have something to do with her ovaries and he needed to do an internal examination.

The woman asked if it was really necessary but Gopal insisted. In this also, Gopal made no notes of the vaginal examination.

    I think, Allen, Mangalore answered correctly your question, I don't have anything more to add other than stating judiciary in western countries is very fair,,, nobody is punished without sufficient proof nor anybody is acquitted easily unlike in India.

    When a doctor does not write procedure performed in the medical file means its a very major lapse here,,, no physician does it here in US unless he wants to hide something(Medical Malpractice).

    Now benefit of doubt if any, should go to physician here like any accused.

    We all do certain things to protect our own interest, without recording our activity.

    Most primary is, right inside our house, the kitchen in-charge discards things he/she could not use up before their expiry/decay but does not tell the purchaser about it. Shall we call it the rape of house-owner's finances ?

    A food producer adds taste-enhancers, colourants to attract his customers despite knowing the additives are harmful for health.

    A milk producer feeds his animals with urea laden fodder so that the milk production would be more. He knows about the impact of the pesticide on humans, yet he doesn't mind his tact.

    An IT professional, to retain his client, enforces certain codes in the program which he alone can decode. So does an Engineer, a Mechanic, a shopkeeper, so on.

    Lets come back to Australia where the government imposes restriction in migrating medical professionals to study complete medicine branches no matter one is a pediatrician, neurologist, Ophto, Ortho or an oncologist. This is because in Australian perspective a practitioner needs to be of maximum use of the entire community in a given locality. Our Doctor gentleman went a step ahead to do more than he is asked for, perhaps to use the experience in some of his extra activities.

    I don't think he harmed the patients nor did he held them at ransom as did the personalities named above. Neither he lured them in for his advantage.

    Thinking in this line, I still remain with the doctor. That is because, I can specialize in one/two skills. I got to depend for other needs on others who will definitely take advantage of their position as I too may have lets say being in-charge of a kitchen.

    Nevertheless, there are very honest house-wives, food suppliers, engineers, doctors, so on. Never generalize.

    Ms Lydia Lobo, in most of the western and developed countries there is a system called Medical Transcription whereby every detail from general appearance, method of examination, diagnosis, and prescription needs to be recorded and filed for each and every patient in a proper manner. Failing which is considered as an offence. (just for your info.)

    Agree. Similarly, in every ISO firm, a procedure is mandatory about each and every activity that is carried out. Failure is considered an offence hence tried as per the law of the firm.

    No offense the doctor too is tried as per Australian law but its wrong of us to judge him at par with cheap rapes that are happening in our own country.

    Lets be with him - he has not physically raped any patient.

    Instead of making fun of a method that is used to medically examine a woman (lets say vaginal area), its best readers ask your better half about how it is done. We may get many lady doctors at this time/age but male students do opt for such branch of medicine even today. Obviously a woman doesn't mind being touched by a woman hence the method has not been an issue at any time. However, for a dedicated doctor irrelevant of gender, a patient is an experimental sample, not a woman or man.

    Just because Australia found two faults with the doctor, please do not compare the case with brutal rapes that are happening in India.

    I sympathize with the doctor and wish he had a female assistant with him during the check up and he had recorded his method.

    Though there a few professionals who misused their position (not only doctors, I say, all, in some or other way) we can't generalize. There are thousands of very dedicated and honest professionals.

    I will stand by the doctor if will appeal against the verdict.

    Not recording vaginal test in the medical patient file is his major fault...if the test was genuine what prevents him from recording it in the medical file???

    Just because he did not recorded in medical file court found his conduct dubious...if he wanted to be on the safer side he could have taken a female nurse so nobody can show a finger at him...

    Now doc is convicted perhaps there will be big civil suit of million dollars as compensation...this could be motivation of the accuser to make fast big bucks...now hospital will pay it and doc perhaps will be banned from practicing medicine...or even go to prison.

    Doctors behavior is stupid at best and criminal at worst....

    I take this opportunity to inform my NRI brothers that similar incident was complained by one of the NRI ladies. For visit or residential visas , the ladies has to go for medical check. In one of the reputed hospital in Mangalore where the doctor insists young ladies that thorough check in necessary and sends nurse outside the room. Then He will ask to remove the cloths and touches every secret parts. A lady mention that she objected then the Doctor threatened that it is necessary if not I will not produce the right medical certificate. Scared lady allowed. After coming gulf she mention the story to one of her friends. After receiving the complaints we contacted the owner of the hospital and described. Later we came to know that the Doctor was suspended. No police was made to due to family respect.
    I request all my NRI friends to make a note of this and to advise any ladies who are going to the Doctors must be accompanied by any elder female relatives.

    If true very shameful behavior...I have heard similar stories but normally they are hushed up.

    There was a doctor in Katpady, Udupi doing similar things long time ago...many women were visiting him because of his treatment or blackmail,,, including one very famous woman from Kinnimulky...which ended up in tragedy.

    Dear All, Read clearly!!! It states "Digital Penetrating"... That does not mean Rape !!! "Digital Penetrating" means examining the internal parts of the body with medical instruments !!!
    In the western countries, if a man touches any part of the female body and if the female dont like it , then they term it as " Sexual Harrasment" !!!! The same way, if the vaginal check up was not required and the doctor checks and does not note it on the patients file, it is called as Digital rape.

    Indian Doctors are one of the best in the world !!!!

    The only 2 mistakes made by the doctor are 1)Performing a vaginal check-up without the presence of a female nurse/ Female doctor 2) Not mentioning the vaginal check-up on the report.

    Hope our other Indian Doctor friends start practicing writing the complete report of examination and make sure that atleast 1 female assitant is always present during examination !!!!

    Please note that this rape is not the brutal rapes done in India!!!

    Hard to believe. Generally doctors (male) conducts female patients physical examinations in the presence of female clinic staff. This is a universal rule, unless the patient needs one to one exam.

    Racism has taken birth in Australia also, they don't indeed like asians, mainly Indians. There were many cases of hate crimes against Indians in the past.

    Earlier, Dr. Haneef from Banglore was imprisoned, accusing him of terrorist and later he was acquitted and Australian government paid him a huge amount of compensation. Who knows this also similar false charges!

    Anyway, hope a thorough investigation will bring out the truth.
