New Delhi, Dec 5: While the three judge panel set up by the Supreme Court to look into the allegations of sexual assault made by a law intern, against Justice Ashok Kumar Ganguly, has found evidence of his misconduct, they said that since the law intern was not on their roll and the Judge has retired, at the time of the incident, the court need not take any further action in this instance.
The panel said they had thoroughly looked into the statements given by Stella James, Justice Ganguly and three other witnesses, it arrived at the conclusion that Stella had been subjected to untoward and unwelcome behaviour from the Judge. There appeared to be sufficient proof pointing to the arrival of Stella at the Hotel Le Meridein on December 24, 2012 and being in the room that the Judge had been residing in to help him with regards to some official work. She remained in the room from 8 pm that evening until 10:30pm.
Justices R M Lodha, H L Dattu and Ranjana Prakash Desai felt that the charges put forth by the complainant did indeed ring true, even though Retired Judge Ganguly continued to protest his innocence. Having retired in February this year Ganguly seems to be between the devil and the dead sea with the West Bengal's ruling party Trinamool Congress asking for tougher action against him as well as an NGO registering an FIR against him and protesting before the offices of the West Bengal Human Rights Commission (WBHRC).
Justice Ganguly has been previously asked to step down from his post as the Chairman for WBHRC, but he had claimed to have been undecided about doing so. At the moment he has taken leave in the wake of the allegations showing a shimmer of truth to them and the fact that the demand for his resignation has intensified.
