Premarital sex 'immoral', no religion permits it: Court


New Delhi, Jan 5 (PTI): Premarital sex is "immoral" and against the "tenets of every religion", a Delhi court has said while holding that every act of sexual intercourse between two adults on the promise of marriage does not become rape.

Additional sessions judge Virender Bhat also held that a woman, especially grown up, educated and office-going, who has sexual intercourse on the assurance of marriage does so "at her own peril".

"In my opinion, every act of sexual intercourse between two adults on the assurance of promise of marriage does not become rape, if the assurance or promise is not fulfilled later on by the boy," the judge said.

"When a grown up, educated and office-going woman subjects herself to sexual intercourse with a friend or colleague on the latter's promise that he would marry her, she does so at her own peril. She must be taken to understand the consequences of her act and must know that there is no guarantee that the boy would fulfil his promise.

"He may or may not do so. She must understand that she is engaging in an act which not only is immoral but also against the tenets of every religion. No religion in the world allows premarital sex," the court said while acquitting an employee of a multinational company of the charges of rape.

The 29-year-old man, a resident of Punjab, was arrested when a woman, doing a secretarial and administrative job at a private company in Delhi, lodged a complaint of rape against him in May 2011.

In her complaint, the woman had alleged that the man, whom she had met through a chat website in July 2006, used to have physical relations with her on several occasions by promising to marry her.

    Very good judgement. Hope in future all females who is planned to black mail males will think before what they do......Sexual contact is their own problem...Not the rape and rape is crime.

    goes.....
    1.It's a judgement by a court judge
    this....Leave it at that.
    2.When it comes to an individual, he has to be firm. No point in indulging and then feeling 'guilty'.
    3. By point no 2 I mean either you do or you don't do.No half measures. There's no such thing as
    being half- pregnant...is there?Same way......
    4. Be 'Khullam Khulla' in life. That doesn't mean be 'Fully Open' literally and invite troubles!Your Life should be lead in a way respecting the 'emotions' of everybody coming into contact with you.Trust your first instinct, the
    first time always. It helps.
    5.Never ever lead a 'lady' up the
    garden path. The consequences are
    disastrous.
    6.There is nothing more 'sinful' then taking an innocent girl for a ride.
    7. Point no 5 and 6 were during my times not long ago. Now I hear stories of girls leaving boys 'in the bush'. Then my advice won't work.
    8. For scheming boys and girls in any case nothing matters.
    9. This judgement too reflects the
    'culture' and environment we grow up in.
    10. If the mentioned activity becomes rampant think mankind would be nearer 'animal class'......So think there's 'urgent need to take stock
    of the situation 'in any case!

    Premarital sex in any form is objectionable and immoral.Yes,no religion permit it.Even working class matured people engaging in premarrital sex are indulging in danger if the relationship is not materiaised in marrige.Thanq.

    Good verdict by the court.
    With changing times, specially youth getting well paying jobs at far off places from their residences, premarital sex and related crimes have multiplied.
    Live in relations have increased, so the orphans also.
    Most of the unwed are not ready to own the responsibility of bringing up the child born to them!
    Poor orphan child is victim of irresponsible unwed couple and the society in general is at peril.
