Tarun Tejpal granted regular bail


New Delhi, Jul 1 (PTI) : The Supreme Court on Tuesday granted regular bail to Tehelka founder editor Tarun Tejpal in a sexual assault case filed by his colleague with a warning that it will be cancelled if he tries to tamper with evidence or induce witnesses.

A bench headed by Justice H L Dattu, however, said denial of bail to him would curtail his liberty and would come in the way of him getting fair trial if he remains in jail. It said the investigation has been completed and the chargesheet filed.

”He has not been convicted. He is just an accused. At the end of the day it is his freedom and he is also entitled for fair trial which also means freedom to meet his counsel,” the bench said.

The bench, which also had justice S.A. Bobde, imposed stringent conditions for his release on bail. It said it was not disposing Tejpal's petition and keeping it alive so that violation of any one of the condition by him would enable the Goa police to immediately move the apex court for the recall of the bail order.

It asked the trial court judge in Goa to expeditiously complete the trial in the case, preferably within eight months from today.

The apex court did not agree with the Goa government's contention that reasonable apprehension of influencing witnesses and Tejpal's past conduct in this regard should be considered as grounds for denying him regular bail.

The bench also disagreed with Additional Solicitor General Neerak Kishan Kaul, who was appearing for Goa Police, that Tejpal should be kept in jail till the victim and four of her friends, named as prime witnesses in the case, record their testimonies in the trial court.

While opposing the bail plea, the ASG alleged that “there has been systematic attempt to attack the victim's psyche and there have been a chain of events in the past months indicating reasonable apprehension of tampering with evidence.”

The Goa government opposed 51-year-old Tejpal's plea, saying that the victim and her boyfriend were getting threatening emails from some phishing sites and they seemed to be under some surveillance.

The bench asked senior advocate Salmam Khurshid, appearing for Tejpal, to convey to his client that any violation of the bail conditions by him directly or indirectly would invite trouble for him.

The bench noted that investigation into the case has been completed and charge sheet filed but speedy trial in the case is not possible as 152 witnesses have been named and trial process will take at least three years.

The bench said Tejpal cannot be kept in jail till then.

”If the court does not come to the rescue of this person then do you not think that liberty of the person is curtailed?” the bench asked Goa police which vehemently opposed the regular bail for Tejpal and submitted that he should remain in jail till four key witnesses were examined.

While granting bail, the bench directed Tejpal to surrender his passport and made it clear that he would not seek any adjournment of the trial proceedings and attend the court on every date.

The bench said in case there would be any urgency requiring Tejpal's absence from the trial court, his counsel would have to inform the court.

The apex court had on May 19 granted him interim bail for three weeks to enable him to attend the cremation of his mother, who had died on May 18, and subsequent rituals. The interim bail was later on extended twice till today.

Tejpal has been chargesheeted for allegedly raping, sexually harassing and outraging the modesty of a junior colleague during an event held at a hotel in Goa in November last year. Tejpal was arrested on November 30, 2013 and is at present out on interim bail.

He has been accused of sexually assaulting the victim on November 7 and repeating the offence the next day.

Before being released on interim bail, he was lodged at Sada sub-jail in Goa's Vasco town.

    Firstly I am not a lawyer, so legal pundits please enlighten me...in India if a man rapes a woman he is charged by IPC 376....if a woman rapes a man does IPC has any provision to charge her???

    As far as I understand answer is no....common Bejaimai,,, you are a lawyer, You can shed some light on it...before Bhandumaam jumps in....


    I wanted to tell Vidhwaan Moily about to change IPC to incorporate this....but From Union law minister he became Union Gas Minister and was busy with Gas Connections....

    this TT should be banned from entering any kind of "lifts" and also should be made to wear finger caps, thats worn by Thavil (tanjavur barrel drum) players, ALWAYS!! lest he will finger anything!

    I really dont know who is stupid here?

    * The clever girl went into the lift on 7 November 2013, where she alleges she was raped by Tejpal.

    * The clever girl went again with her alleged rapist Tejpal into the same bloody lift on 8 November 2013 and where she once again alleges she was raped by the same Tejpal.

    * Then there is the very clever and highly educated IITian CM of Goa who sympathizes with the celver girl who made the clever mistake of going with the rapist a second time in the same lift that she boarded and got raped in at the first time.

    * Then there are the most clever and indigenous Goan policemen who can concede from recordings of CCTVs installed outside in a corridor and corroborate the clever girls allegation that she was raped inside a closed lift.

    And finally here we are all mighty clever readers of Daiji World passing our own judgement of sorts whether or not Tejpal is guilty when we should really ask ourselves what tempted the clever girl to go into the lift a second time with her alleged rapist Tejpal if she resented his groping or non-penile ion or whatever it may be have been the first time.

    Tejpal is kept in custody by Parrikar as revenge for having done Tehelka on the BJP/VHP for Gujarath riots, plain and simple. This is a shame on Parriker and BJP and shows when it comes to governance they have the same revenge attitude of Indira Gandhi.

    This is not a rape case, but an alleged sexual abuse case. The police can file a case,but why keep him in custody.

    Police are not bothered about real rape that is occurring, (MP - BJP ruled has the highest reported rapes in the country), real crime is not being prosecuted , instead police are after high profile, high society cases like this and Ness wadia where no real rape has taken place but a lot of noise has been made.

    Is there no other real crime occurring in Goa, that police have to keep this man in custody when the court proceedings are going on, when he has neither committed rape or murder.

    "Since November 30, Tejpal, the former editor Tehelka magazine, has been in jail after a junior colleague accused him of raping her in a lift. The incident was alleged to have taken place during a festival called Think, organised by Tehelka in the Grand Hyatt hotel in Bambolim, Goa. There were cameras only in the landing outside the lift, not inside it. The woman journalist alleged that she was asked by Tejpal, her employer, to accompany him in the lift on November 7 and November 8, and on both occasions he assaulted her. On the first occasion, it is alleged, he committed non-penile rape.
    Tejpal was given the footage by the Goa police on the instructions of the court on February 19, but since then, it seems to have been viewed by many people. No matter whose version you choose to believe, the fact is that the CCTV footage cannot establish whether it was consensual sex or rape – simply because the alleged criminal acts took place inside the lift where there were no cameras".
