Cong claims SC's observations have vindicated its stand on LoP


New Delhi, Aug 22 (PTI) : Latching on to Supreme Court's observations on Leader of Opposition issue, Congress today said it "vindicates" the party's stand and alleged that the Speaker's decision to deny the LoP status to it in Lok Sabha appeared "coloured by BJP's partisan agenda".

"The Supreme Court observation has actually vindicated what the Congress and the UPA have been saying through out. The decision of the Speaker was in utter disregard to law and appears to be clearly influenced and coloured by the partisan agenda of the BJP-led government," Congress spokesperson Anand Sharma said soon after the Supreme Court agreed to interpret LoP provision for the purpose of appointment of Lokpal in which LoP is a selection committee member.

Emphasising the importance of the post, a bench headed by Chief Justice R M Lodha said Leader of Opposition conveys the voice of a representative different from government in the House and asked the Centre to make its stand clear within two weeks, saying the legislation cannot be put in "cold storage".

The court also observed that the issue of LoP is relevant not only in Lokpal law but also in other existing and incoming legislations.

Congress, as the second largest party in the Lok Sabha with 44 seats, has been making a strong bid for the LoP post but the ruling BJP has opposed it, saying it does not have the requisite 10 per cent seats which meant it needed 55 to stake claim.

Hitting out at the government over denial of LoP status to Congress, Sharma said that when the Congress had made a representation to Lok Sabha Speaker Sumitra Mahajan in this regard, it had hoped that she will take a fair and just view.

"However, the Speaker denied it to Congress relying on the opinion of the Attorney General, which was not worth even the piece of paper on which it was written and was influenced by partisan politics of Government," Sharma told PTI.

He also attacked Prime Minister Narendra Modi over the issue saying while he talks of taking Opposition parties along, his actions are in "direct conflict" with what he says.

"Disrespecting Opposition, disrespecting laws and insulting leaders of other parties, Chief Ministers. All this are reflective of a mindset, which is determined to undermine institutions and established conventions and norms of the Constitution.

"No ruling and observation of Speakers can override a law of Parliament and the law has it that the single largest Opposition party does not require any specific number in Lok Sabha to claim the LoP status. It was the right of the Congress party," Sharma said.

    LoP required in Lokpal law & other existing and incoming legislation.

    If so how Lok Sabha will function without Lop?
    Congress is falling short of 11 MP's for LoP and BJP has 11 excess THAN REQUIRED FOR MAJORITY!
    What a tragedy of Congress?
    Result of TOTAL NEGLIGENCE AND OVER CONFIDENCE.
    Now desperate for the Post of LoP! Can they stoop down further and beg 11 from BJP ?

    Indian constitution says 10 prcnt of total seats are required to grant LOP. This govt has taken right decision. Even SC will uphold this.

    I think you are referring ITALIAN CONSTITUTION. Get educated man. Behaving like HITLER does not work in India.

    Mr. Congress, why you want leadership? last 10 years we gave you to lead India, which was a very crucial period where their was global development. lot of country's used it and they became prosperous. but we showed to the whole world that how good we are in corruption.country was looted. public had given you the reply. its the time for you to think, re unite and to win the indian voters again after 5 years. Mr. Modi was a hope to india due the corruption phase with which it went. He can also lead india if he and his team has good policies and by taking every one with him. But the way with witch we are seeing the communal out fits are opening up their folded wings which was not active from past 10 years, it seems india will be getting in to different dangerous phase which is going to make india totally unstable. But i feel its only a time these outfits will bite the dust by Mr. Modi. He is another image of Indira Gandhi. but for reasons if he cannot do then it will be same old fate of UPA for his party after 5 years. Indians are fed up of corruption, instability, violence. they need respectful and peaceful life to lead.

    One of the rule that prevails in overnment recruitment is this!!! if there are no suitable candidates, no one is hired and post lies vacant!! let anyone disagree on this! same for LoP too!!

    if SC sees a LoP needs to be appointed then it should also pass judgeent of filling all government posts lying vacant immediately!

    Court opined that LOP is critical. It did not say it should be given to congress. Speaker only rejected congress representation. Not sure how it vindicates congress stand in any ways. It could be given to TMC or AIADMK which have larger success ratio in elections than congress. In any case, this falls in domain of the legislature and supreme court can't do a thing about that. They are expressing opinions on something which is yet to be made a law by the legislature.

    LOP is required I agree. But no one is eligible for the post at present.

    University can't a student who scored 10 marks in 100 in the exam as PASS.
