SC quashes allocation of 214 coal blocks allocated since 1993

New Delhi, Sep 24 (PTI): In a major blow to the corporate sector, the Supreme Court today quashed allocation of 214 out of 218 coal blocks which were alloted to various companies since 1993 and in which it was claimed that around Rs 2 lakh crores were invested.

A bench, headed by Chief Justice R M Lodha, saved only four blocks--one belonging to NTPC and SAIL each and two allocated to Ultra Mega Power Projects--from being cancelled.

The bench, also comprising justices Madan B Lokur and Kurian Joseph, granted six months breathing time to mining companies to wind up their operations in the coal blocks.

The bench also directed the companies, which were allocated coal blocks but had not operationalised them, to pay a compensation to the government for the loss of exchequer. It accepted the findings of the CAG which came to the conclusion that the loss of Rs 295 per tonne was caused due to the non-operation of the mines.

The apex court also noticed the stand taken by the NDA government that it is "fully prepared to face socio-economic impact" if the coal block allocations were cancelled.

During the earlier hearing in the case, the UPA govt had opposed cancellation of coal blocks allocation saying that around Rs 2 lakh crore had been invested by various companies after blocks were alloted to them.

The apex court had on August 25 held that all coal blocks allocation since 1993 by various regimes at the Centre have been made illegally and arbitrarily.

The apex court, which had used almost all terms to condemn the procedures adopted by 36 screening committee meetings since 1993, however, had stopped short of cancelling them saying, "what should be the consequences, is the issue which remains to be tackled." The apex court, which examined the allocation of 218 blocks in pre-auction era till 2010, had held that they were done in an illegal manner by an "ad-hoc and casual" approach "without applicatio n of mind" and "Common good and public interest have, thus, suffered heavily" due to lack of fair and transparent procedure resulting in "unfair distribution" of the "national wealth" -- coal -- "which is king and paramount Lord of industry."

"To sum up, the entire allocation of coal block as per recommendations made by the Screening Committee from July 14, 1993 in 36 meetings and the allocation through the government dispensation route suffers from the vice of arbitrariness and legal flaws.

"The Screening Committee has never been consistent, it has not been transparent, there is no proper application of mind, it has acted on no material in many cases, relevant factors have seldom been its guiding factors, there was no transparency and guidelines have seldom guided it," the bench had said in its 163-page verdict.

No wonder, I read in the paper that when Pramod Mahajan died, his assets were worth 2000 crores. Also, some congressmen have become, from rags to riches.

I thought all these coal scams were happening in the last 10 years of UPA rule. Now they are accountable during their rule from 1993!!!?
And I thought all those Vajpayee etc were of some other parties (NDA).....other than UPA\Congress...
That means UPA has company in coal scams....!!!! Some of the stolen files may be with them then!!? How these BJP people were fooled all this time...

It is Chief Justice R M Lodha's wisdom that prevailed to cancel all the coal blocks except four blocks-one belonging to NTPC and SAIL each and two allocated to Ultra Mega Power Projectsfrom being cancelled.!!!

All political parties involved in these coal block allocations since 1993 are responsible and accountable and UPA is involved in greater extent!!!

The fact of the matter is nobody(no political party) is "Untouchable" in Scams in India!!!.

This is a landmark judgement for our country but "Power Companies" are at the receiving end because they too are not "Clean" enough in their business dealings without paying commissions/kickbacks etc.

Just take the example of "Adani's" reaching in such a short span of time from Narendra Modi's Gujarat and Mr. Gautam Adani could fund the entire "2014 Lokh Sabha" Election Campaign for Mr.Modi Bhai (whopping Rs.10,000 Crores!!!)

Adani power has the fastest turnaround time of projects in the industry surpassing the Tata's!!! who are the "PIONEERS" in Private Power Generation in our Country since 1911!!!.

Narendra Bhai .....Adani the Jawaab Naheen!!!

Ab Acche Din Aanewale hein!!! Intazaar karo paanch saal thak!!!! Lene ke Dhene padenghe Modi Bhai ko!!! Hisaab.....

welcome the move by both NDA govt, who said it is ready to face the socio-economical challenges and also SC for scrapping everything.. lets start afresh, with a transparent auction mechanism!!

it may create some headaches for Piyush Goyal our power minister, to manage coal supply and keep the power generation going, as it hamper his dream of 24x7 power supply in few power sectors! but anyways, we need to make our choices now, so that we have better days ahead!! acchedin...

Today, after the success of Mars orbiter, we said, we are proud as Indians. Now, I say, I am also proud to belong to a country that has an independent supreme court. Also, I thank Dr. Ambedkar, for writing a foolproof constitution, which protects my fundamental rights as a citizen.

All congress men were shouting from the roof top that there was no scam. At lease now it is proved that there was a scam. Again zero loss theory went wrong. Sabbal was arguing that since mines were not operational, no coal has been taken out and hence zero loss. Are yaar koi sabbal ko doond ke laavo

What action is supreme court going to take on the people who have done this ghotala? What is the fault of those poor private companies who invested on the basis of these coal blocks! They were allotted these blocks by Dongi Congis specially First family and chamchas. They too should be accountable and punished.

Yes I agree with you, We all are happy for this order from SC. AT the same time there is one more order telling MODI to clear the criminal politicians, but it is not implemented and may remain in the files only. Now MODI has to prove his PATRIOTISM and NATIONALISM by implementing SC order about criminal politicians in his own house. The BALL is in modis court !!!!!!!!!

Now the question is who will punish the bribe taker, the bribe givers are punished by the court.
In fact, the bribe takers include Bureaucrats, opposition leaders & all the previous ruling party leaders since 1993. The burden is on the bribe giver to prove before the court of law beyond reasonable doubt.

Let us keep our hopes on NAMO ( who shouted from all cylinders before election that he will punish all who are guilty, is now under paramount obligation to deliver)
Further, one must see whether INR 1.86 lakh crore is going to fetch out of fresh auction otherwise one must conclude that Former CAG's report is wrong (a feku report)
