SC refuses to interfere with animal sacrifice as religious practice


New Delhi, Sep 29 (IANS) : The Supreme Court on Monday refused to interfere with the religious practice of sacrificing animals to please gods and goddesses across the country on the plea that it amounted to cruelty to animals under the Prevention of Cruelty to Animals Act.

Declining to entertain the PIL by Varaaki, a Chennai-based journalist, a bench of Chief Justice H.LK.Dattu and Justice Amitava Roy said that how could it pass an order to prevent animal sacrifice when as a religious practice, it has the sanction of law.

The court said this as senior counsel Raju Ramachandran, appearing for Varaaki, told the court that when animals are slaughtered at slaughter houses, it is governed by rules and regulations and animals are slaughtered by trained people.

Ramachandran told the court that during religious practices, the animals are killed by untrained people causing unnecessary cruelty to them. He said that at times, animals are sacrificed during religious ceremonies in the presence of children.

However, Chief Justice Dattu noted that "The Prevention of Cruelty to Animals Act itself gives that right (of animal sacrifice as religious practice). Villagers will say that it is our religious practice for centuries to please gods and goddesses by such animal sacrifices".

The court said that it had to "harmonize all faiths and religions". "These are very very sensitive matters. We can't be blind to centuries-old traditions being followed," it said.

Allowing the PIL to be withdrawn, the court allowed Ramachandran to implead the petitioner as a party in the matter where the apex court is hearing a challenge to Himachal High Court order banning animal sacrifice as a religious practice.

    Not only animals hv life, even vegetables(PLANTS) hv life, they can feel pain, bt they hv less senses than human. Y cant people understand that there is food chain, each human or animal is depending upon another for food.

    The supreme court has squandered an opportunity for the fear of angering Majority Hindus & Minority Muslims who Scarifies animals. Court wanted to avoid controversy. Hhey could have clubbed it under anti superstition act & closed the chapter.

    Even though UAE is Muslim country , the slaughter of animals in homes and public spaces is prohibited.

    A human can cut any animal and consume its meat which will not defile a human. It will go into its stomach and will pass on.
    Animal sacrifice is of the old practice and it is morally forbidden. Legally, even the Supreme Court refuses to interfere in it.

    Animal’s sacrifices of any kind to please God or as a sin offering should be banned.

    Animal is for humans. Humans have to protect it for domestic purpose and for utilizing to accomplish work plus its meat for human consumption.

    Just for information, many century old practices have been stopped. Old does not necessarily be healthy and moral.

    We have faith only in supreme court, let it continue unbiased whether it is majority issue or minority issue. otherwise if courts also act like political parties there will be no hope.

    Sacrificing animals to gods and goddesses and later consumed by humans SC do not want to interfere but interferes in what minority wants to consume. Really Supreme!

    Humans are eating animals not because of empty stomach,because of their selfish nature which can be controlled by human beings.In this nature every soul has its own right to live and one should interfere with other soul in my view.we talk about progress, development but forget basic values of life.Again its my personal view.
