New Motor Vehicle Bill approved : Drunk Driving Fine Rs. 10,000


NEW DELHI, Aug 4 (IANS): The Union Cabinet on Wednesday approved the Motor Vehicle (Amendment) Bill, 2016, providing for hefty penalties for violation of road safety rules. The fine for driving without licence goes up ten times to Rs. 5,000 while penalty for drunken driving increases fivefold to Rs. 10,000.

The decision was taken at a Cabinet meeting chaired by Prime Minister Narendra Modi.

"The important provisions include increase in compensation for hit-and-run cases from Rs. 25,000 to Rs. 2 lakh. It also provides for compensation up to Rs. 10 lakh in road accidents fatalities," an official release said.

The Cabinet also recommended that for persons without helmets the new proposed penalty would Rs. 1,000 apart from suspension of licence for three months. The current penalty is Rs. 100.

For seat belt violation, new proposed penalty is Rs. 1,000, up from Rs. 100.

For driving without insurance, the proposed penalty is Rs. 2,000, up from Rs. 1,000.

For offences by juveniles, the guardian/owner shall be deemed to be guilty. They will have to pay a penalty of Rs. 25,000 apart from three-year imprisonment. The juvenile will be tried under the Juvenile Justice Act and registration of his or her motor vehicle will be cancelled.

The bill provides amendments in various penalties. While the old penalty for violating road rules was Rs. 100, the new minimum penalty is Rs. 500.

Similarly, the penalty for speeding was Rs. 400, but the proposed penalties for LMV (light motor vehicle) is Rs. 1,000 and for medium passenger vehicle Rs. 2,000.

The new proposed penalty for unauthorised use of vehicles without license would go up to Rs. 5,000 from Rs. 1,000.

For travelling without ticket, new proposed penalty is Rs. 500 which goes up from Rs. 200.

For driving despite disqualification, the new penalty is Rs. 10,000, which is now Rs. 500. The new proposed penalty for dangerous driving would go up to Rs. 5,000 from Rs. 1,000.

For disobedience of orders of authorities, the new proposed penalty is Rs. 2,000, compared with Rs. 500 at present.

The vehicle without permit will now have to pay up to Rs. 10,000. For aggregators (violations of licencing conditions) the proposed penalty would be Rs. 25,000 to Rs. 1,00,000.

The new proposed penalty for overloading is Rs. 20,000 and Rs. 2,000 per extra tonne. For not providing way for emergency vehicles the proposed penalty is Rs. 10,000. For overloading of passengers, the penalty would be Rs. 1000 per extra passenger.

"The bill also proposes to mandate the automated fitness testing for the transport vehicles with effect from 1st October 2018. This would reduce corruption in the Transport Department while improving the road worthiness of the vehicle," said the statement.

"The penalties are also proposed for deliberate violation of safety/environmental regulations as well as body builders and spare part suppliers," it added.

For overloading of two wheelers, new proposed penalty is Rs. 2,000 and disqualification of licence for three months. Currently, the penalty is Rs. 100.

    At the same time, any attempt at illegal gratification by the enforcement authorities, should be mercilessly dealt with. Also, let's hope that the additional revenue generated will be utilised only for the purpose of improvement of the transport infrastructure, viz., better (broad, level, pothole-free, well-maintained) roads, scientifically constructed road humps, better traffic signals, CCTV cameras for control over breaking of road-traffic rules and better working conditions and remuneration to those personnel involved in traffic management (traffic police as well as traffic wardens).

    It is good move to increase penalty. We Indians do not improve unless we are show stick,
    specially the provision of driving byJuveniles and the parents/guardians/vehicle owners give vehicles to them and boast of these when they drive. These things can be observed near educational institutions right in front of the police and they just ignore all these things. The worst part is they end in speed driving, endangering not only their lives but those of others. The hefty penalties as proposed in he Bill is required. Then only people will learn to observe the law. The police department should conduct frequent checkups specifically near he Educational Institutions and during the early morning hours. Jai Hind.

    Intent behind this move is valid. However, it will only empower the Police to deal at a different scale than they are currently dealing. It would have been really helpful if the bill was accompanied with the following:
    1. Police will from now on seize to handle cash transaction, but the same may be added to an account associated with the number plate that needs to be settled within the financial year.
    2. Police salary hike to make them unsusceptible to greed.
    3. Rupee denominations reduced from current 1000 to not more than 50.
    Without this, this Vehicle bill will lead to more court cases or the law itself viewed as draconian.

    As fine about is high..chances are more give encouragement for corruption. People won't pay Rs.10,000/- and only give Rs.2,000/- as a bribe and escape. Good people also start to give bribes here after which they didn't done in there life time. A driver who is earning hardly Rs.25,000/- to Rs.30,000/- how he can pay hefty penalty.
    If children's are having grudge towards there parents..will purposely involve in wrong doings.
    Most of heavy vehicle drivers..cannot drive..without having booze.
    Looks like more and more accidents are going to take place in near future...unless and until some amendments are not done.
    In long journey people wants to carry more amount with them..or credit cards having lum sum amount for these purposes only.
    All people will do one or other mistakes while driving.
    If people really pay fine..it will help government to install CCTV and many other amenities which required for public.
    Let us wait and see how it works.

    You blame others for corruption, here you are teaching how to do the corruption by stating " People won't pay Rs.10,000/- and only give Rs.2,000/- as a bribe and escape" No more blaming corruption since you have been the teacher for others.

    What concerned me is your statement "Most of heavy vehicle drivers cannot drive without having booze". Such generalized statements are exactly what you have preaching from Himalayan caves and we are not sure basis for this claim, unless it is your personal experience. I know many heavy vehicle drivers, they never have a drink or so called booze in their life.

    One more Wiseman statement "from the nomad Dev Kumar Himalayan cave man that All people will do one or other mistakes while driving, may be valid. There are training classes and exams to learn the right way. Police always consider intentional mistakes and accidental mistakes which helps people to earn from their mistakes. If you harm other people or cause damage to other vehicles or property, we cannot say minor incident.

    Who tells you to pay if you are not 'drunk' while driving ? The government ? Certainly not ! In other words, drunk driving is illegal universally, not only in India and definitely not because its Modi govt. ruling India.

    Driving without license or hit and run should go unpunished ? I tell you, build your own roads where only you alone ride. You can ride on them drunk or intoxicated by anything else. Jump red signal or crash at the signal pole - nobody will fine nor question you.

    When in public, please behave as the law demands. Else, live in the Himalayas ! In legality poor/rich is not an issue but safety of the driver, passengers and pedestrian surely is !

    Driving under influence,Boating under influence ,Flying under influence and operating any machinery under influence of any substance or medication causing dizziness should be punishable by law.In developed countries they use breath analyzer and other test and 72hrs initial imprisonment is common.Besides the insurance premium shoots up for the offender because insurance companies are not willing to compensate such drivers...

    Good job ! Utilize the revenue to improve traffic facilities. Pay decently to the cops standing on roads, whether its raining or scorching heat, to control traffic. Install more surveillance devices that even vehicles used for petty robbery will be traced from every nook and corner! Those who peeing on roadsides will be conscious of being watched !

    When the fine was just Rs. 100/- there was complaining that 'getting away with an offence is too cheap'. Now when the fines are increased, you cry 'poor' card ?

    Offenders are not assessed through their financial status. Refrain from offending, poor will not get poorer !
