SC asks Karnataka to release 15,000 cusecs of Cauvery water


New Delhi, Sep 5 (PTI): Supreme Court today directed Karnataka to release 15,000 cusecs of Cauvery water per day to Tamil Nadu for the next 10 days to ameliorate plight of the farmers there.

Noting that the samba crops in Tamil Nadu would be adversely affected, a bench comprising Justices Dipak Misra and U U Lalit directed Karnataka to ensure supply of water to Tamil Nadu.

The apex court also directed Tamil Nadu to approach the supervisory committee within three days for the release of Cauvery water as per the final order of the Cauvery Water Disputes Tribunal's (CWDT).

The Supreme Court also asked the supervisory committee to decide on Tamil Nadu's plea in ten days from today.

"We think it's appropriate to direct Karnataka to release 15,000 cusecs of water per day for ten days," the bench said, while also directing Tamil Nadu to release water to Puducherry appropriately as per its interim arrangement.

The court posted the matter for further hearing on September 16.

On September 2, the Supreme Court had made an emotional appeal to Karnataka saying 'live and let live', after Tamil Nadu brought to the notice of the court that the Karnataka CM has said that not a drop of water will be released to it.

In a recent plea, Tamil Nadu had sought a direction to Karnataka to release 50.52 tmc feet of Cauvery water to save 40,000 acres of samba crops this season.

In reply, Karnataka had said it has a deficit of about 80 tmc feet in its four reservoirs.

Senior lawyer F S Nariman, who appeared for Karanataka, said that there were "rain deficit months" in the recent past and it was difficult to release the water due to Tamil Nadu.

He said the Tribunal has not provided for an alternative for Karnataka on the point of release of water during distress months. The apex court had earlier refused to give an urgent hearing to Tamil Nadu's plea for setting up of Cauvery Management Board for implementation of the CWDT award.

At the directions of the apex court, the Centre, in 2013, had notified the final award of the CWDT on sharing of water of the Cauvery system among the basin states of Karnataka, Tamil Nadu and Kerala and union territory of Puducherry.

The CWDT had recommended the setting up of a Cauvery Management Board/Authority on the lines of the Bhakra Beas Management Board for implementation of the order.

The board, in turn, would constitute a Cauvery Water Regulation Committee for assistance.

The Tribunal, in a unanimous decision in 2007, had determined the total availability of water in the Cauvery basin at 740 thousand million cubic (tmc) feet at the Lower Coleroon Anicut site, including 14 tmcft for environmental protection and seepage into the sea.

The final award made an annual allocation of 419 tmcft to Tamil Nadu in the entire Cauvery basin, 270 tmcft to Karnataka, 30 tmcft to Kerala and 7 tmcft to Puducherry.

    All major water ways & river water distribution should be handled by the central Government for the grater good of our country not for particular state and movement & settlement of Indian Citizens should be made free with in India. All pro state, pro language, pro region organizations should be permanently banned to retain the unity & integrity of the one Country.

    There are many people of Karnataka stay in TN.
    Government must know how to keep good relation with neighboring states.

    Hope an appropriate, long-term National River Water Utilisation & Water Conservation Policy/Guidelines is brought out by the Central Govt., with the following points in mind:

    1) To undertake inter-linking of
    rivers to prevent flooding/
    over-flowing/wastage of river
    water in all parts of India.

    2) To advise/enforce the cropping
    pattern of various crops in
    different parts of India,
    depending on the weather
    conditions/availability of
    sufficient irrigation
    facilities on a long-term
    basis, e.g., cultivation of
    crops like paddy, sugarcane,
    etc. requiring very large
    quantities of water in
    problematic areas is to be
    strictly prohibited.

    3) The Central Govt. needs to set
    up a non-biased Adjudicating
    Authority to resolver inter-
    State River-Water disputes.

    4) Irrigation experts, Water
    Conservationists and Agricul-
    tural Scientists should
    formulate guidelines for
    improving/recharging of water-
    bodies and underground water
    and recommend suitable cropping
    patterns, depending on the
    availability of irrigation
    facilities.

    5) Above all, political leaders/
    influential leaders of society
    should desist from water-
    politics for the sake of their
    vote-bank.

    I do not understand why tamilians cultivate land if no enough water available. They should definitely look for alternative crops other than paddy.

    Where all those flood water gone? Sidda , next year when flood comes to TN, leave more cauvery water to them, let them suffer little more or else change Nariman. According to recent reports, govt spending nearly 25.6 Cr rupees per year on this much of lawyers. Hope, people doesn't say that this ruling also due to Modi.

    We are not presenting our case properly or we do not have standing based on legal agreement done earlier. History shows that each time TN has gone to Court, Karnataka is loser irrespective of our people have water or not.
    Is it our legal counsel Mr. Nariman needs to be changed? Our situation has become helpless. Finally the violence starts and ends with human and monetary losses. Nothing else.

    Also our judiciary acts like Somalian judiciary most of the times...we need quality lawyers and judges...read J Jayalaitha acquittal judgement by Justice Kumaraswamy of Karnataka High Court...you will know....it cries for change...

    Also in Salman Khan bail against conviction of by trial Court...Bombay High Court judge opened his bench at mid-night to grant a stay...so Salman does not go to prison....Even in Somalia, perhaps this will never happen...

    Fully agree. Judicial system which was supposed to be of very high standard has reached its low. Lack or quality people due to inefficient system of ion and due to corruption creeping in the judiciary has lost its shine.

    15000 cusecs of water means the flow of 15000 cubic feet per second, that is equivalent to 1.296 TMC per day and 12.96 TMC for 10 days. Since it is a temporary order, the present order is not have any significant impact. However, the long term order if given, will have a disastrous effect on Karnataka which is having a drought like situation in some parts.
