Delhi High Court dismisses PIL for ban on burqa, other face veils in Delhi


NEW DELHI, Nov 15 (PTI): The Delhi High Court today refused to entertain a PIL seeking a ban on burqas and other face veils in public places due to security threat to the capital, saying it is not a public interest matter.

A bench of Chief Justice G Rohini and Justice Sangeeta Dhingra Sehgal dismissed the plea saying, "If it is a policy decision, the government will take care of it. How can we entertain it (PIL) under Article 226 (power of High Courts to issue certain writs).

"We cannot interfere in this writ petition. The same is dismissed. It is not an issue which deserves consideration by this court under the Article. It is not a matter of public interest."

The plea sought a ban on wearing face veils including burqas, helmets, hoods etc at public places like transport, government buildings and heritage sites in the capital on the ground of threat from terror activities.

The plea, filed by Sardar Ravi Ranjan Singh, alleged, "the use of face coverings and wearing of full body cover like the burqa is a serious security issue and citizens are put to constant risk and fear in the capital which is in violation of Article 21(protection of life and personal liberty) of the Constitution of India."

It said, "There is a rapid growth in terrorist activities and that the perpetrators of these criminal acts show no respect to burqa and ruthlessly use it as an instrument to carry out 'fidayeen' attacks."

The petitioner also referred to the recent attacks in Uri in Jammu and Kashmir and said public safety and the government offices in the capital are at constant risk.

"Face veils, burqas can be used to prevent identification at border check-posts etc. Further, criminals and extremists can use burqas to skip checking at police posts and barricades," the PIL which made Centre, Delhi government and National Security Council as parties, said.

    Let me explain what is Burqa,Why it worn and security threat

    Burqa falls under the category of Hijab. This is an Arabic word which means to veil or cover and refers to a woman's head and body covering.

    Islam has introduced hijab as part of the decency and modesty in interaction between members of the opposite sex.

    Men, whether they confess it or not, are slaves of lust and desire.
    Hijab protects women from such men it symbolizes that she has been sanctified to one man only and is off-limit to all others.

    Jain monks in India walks nude with face covered.Sikhism is a religion of about 25 million people around the world. It’s the fifth largest world religion by population. Most of the religion’s followers are in India, but there are about 500,000 Sikhs in the United States. That’s a lot of turbans!If practicing Sikh are asked to remove turban for security threat and jain monks are told remove mask for identity will hit going to hurt is feelings or not?

    In older Bollywood movies it has been used for concealing for escape.It was part of enterainment Muslims have not objected to it.But new generation movies are mostly try to portray them as suicide veils in order create negative persecption and fear in the public minds.

    This petitioner has too fallen to such negative perception.There are many high end technology available including the X-ray vision without the knowledge of bypassers.

    If someone want to conceal even they can slip into undergarment.For security reason all of us should walk like apes?

    In a conservative country where every 10 minute when women subject to abuse being a modestly dressed.

    Is security of women is important than the raising doubt about attire of particular community to disrobe?

    It is indeed a matter of public interest and the issue contains nothing else than public interest. It is my constitutional right to know with whom I am sharing a public place and to identify a person in public is my civil right. Compromising this aspect has devastating consequences in a secular society. Progressive states across the world has already banned face covering veils at public places. If judiciary is reluctant to take-up the matter and hiding behind the veil of technicalities, who else will dare to correct the system? I grossly feel my constitutional rights and equality is compromised and feel I am forced live my life as second class citizens in my own country!....?

    Recent exploitation of Burqa is by two VHP members who wore it and got seated between women.

    However, Shabarimala matter is unlikely to be exploited because no non-Hindu will be interested in entering the holy shrine, those who benefit out of it are within the community, not outside.
