Babri demolition: Charges against Advani cannot be dropped, says Supreme Court


New Delhi, Mar 6 (Agencies) : The Supreme Court said on Monday that conspiracy charges against senior BJP leader LK Advani and other leaders in the decades-old Babri mosque demolition case may be revived.

According to NDTV, the court said an order on March 22 will determine whether Advani, Murli Manohar Joshi, Uma Bharti, Kalyan Singh and 9 other BJP leaders will face charges in the 25-year-old case.


Kalyan Singh, who is now the Governor of Rajasthan, was the Chief Minister of Uttar Pradesh at the time of the demolition.

Some leaders of the Vishwa Hindu Parishad (VHP) also may face charges accordingly, said a report.

The court was hearing the CBI's appeal against the dropping of conspiracy charges against Advani and others.

The SC bench also suggested to the CBI to club two cases pending in Rae Bareli and Lucknow and added that the matter will be heard in Lucknow.

The Babri Masjid, a 16th century mosque, was brought down allegedly by 'karsevaks' in Ayodhya on December 6, 1992, plunging the state and country into communal riots which killed hundreds.

The Sangh Parivar, which includes the BJP, the RSS and other organisations, has continuously called for the construction of a Ram Temple at the site of the demolition.

    Sir, When we were kids we used to play encouraging games. One used to pass the typical word when it reaches to the last person he/she should say it loudly in front of all. At the end we all use to have big laugh. I am not good in Kannada. I hope you got the name.
    Evidence and proof carries the wattage. Not generations theory. Please do your homework wisely when you present an example. 'One scholar' said is itself is big lie in this argument. You need to know the history well rather than jump into conclusion.

    I can give hours of lectures in single sitting if you are patience to hear the argument and counterargument. Basely theory will create only mess.

    Sir,In school we used to study 'Darwin theory of evolution'. It was an interesting subject we all believed what was written. As we grow older many counter questions arose. One such question is,if our ancestors are ape like features and evolved to be modern humans why human evolution is seized in the same state not evolved to be super humans?

    Your generation to generation theory is just like monthly cycles passed by great grandmother which does not hold any water. The argument and proof should be based on the religious scripture which majority Hindus believe.

    @SMR- 16th century event and disputes came in 18th century. Do you think matter of 200 years, does really matter?

    In 1799 tippu sultan was killed and people carry memories of torture even today. That means after 200 years...

    That is called generation after generation.

    One more example- Egyptian pyramids were built during 2500 BC. And one written document from one of the scholar says, people talk about torture and hard labour during 500BC. That means after 2000 years of that event.

    So that means evidence carried after generation after generation.

    After 25 + years Indian court can't give justice...Justice delayed is justice denied. ...By the time court passes its judgement most of those named will already be dead...By the way what is the use of passing judgement now most of those involved are already 80+...There is something called as God's court where no one can escape.....
    The justice which was applied on Afzal guru and Yakub instantly was never applied on the other side...Coz Indian political parties doesnt want to loose majority vote bank....

    The Supreme Court was on a sabbatical honeymooning all these years. Imagine when will the common man get justice if such lethargic lackadaisical behavior is imposed by the judiciary to whom people look up for solace and justice. Whenever this case is closed, (God knows when) - no one should be left scot free, irrespective of their age, position and political mileage, if any.. Only then will there be judiciary transparency in our country.

    It makes me wonder ... why the Supreme Court and High Court do not take active interest, intervene in these issues independently WITHOUT any political intervention (even if there is a change in the political parties every 5 years or so forth).

    I perceive, am of the opinion and also strongly that whenever any case is taken up for hearing, fact finding etc. it should not rest until the verdict has been sounded. Sometimes I wonder how our country functions with a skeletal judicial system work force when for donkeys years every Tom Dick and Harry knows that there is a huge backlog created for appointing new advocates / lawyers to keep pace with piled up cases which keep ACCUMULATING year-after-year.

    @Sri, your argument that Ayodhya was the birthplace of Ram is without any proof. If you think that Dasharath as well as Ram lived in Ayodhya, then you also have to remember that the first child of a girl is born at her father's place which is Koshala (the preset Odisha) Kaushalya was the daughter of the King of Koshala and as per the tradition, then the pregnant Kaushalya could have went back to Koshala to be with her mother who would take care of her during the child birth. Unless you prove that there was a very good hospital with the best gynecologist in Ayodhya, then your theory is useless. Even if Ayodhya was the birthplace, you certainly can't prove the same spot which is under dispute, is the birthplace within Ayodhya. I would be more happy to make that site, a national monument (so that you can visit UP, I am sure you did not visited the so called birthplace yet) in stead of a temple at the cost of thousand lives once more. BTW, DW report says " into communal riots which killed hundreds: but I don't think i just HUNDREDS.

    Under Advani, the BJP became the political face of the Ram Janmabhoomi campaign. In the early 1980s, the Vishwa Hindu Parishad (VHP) had begun a movement for the construction of a temple dedicated to the Hindu deity Rama at the site of the Babri Masjid in Ayodhya.The agitation was on the basis of the belief that the site was the birthplace of Rama, and that a temple once stood there that had been demolished by the Mughal emperor Babur when he constructed the Babri mosque.

    The destruction of the Babri Mosque, as well as the destruction of numerous others that day, sparked Muslim outrage around the country, provoking several months of inter-communal rioting in which Hindus and Muslims attacked one another, burning and looting homes, shops and places of worship. Several of the BJP leaders were taken into custody, and the VHP was briefly banned by the government. Despite this, the ensuing riots spread to cities like Mumbai, Surat, Ahmedabad, Kanpur, Delhi, Bhopal and several others, eventually resulting in over 2000 deaths, mainly Muslim. The Mumbai Riots alone, which occurred in December 1992 and January 1993 and which the Shiv Sena played a big part in organising, caused the death of around 900 people, and estimated property damage of around ₹ 9,000 crore ($3.6 billion). The demolition and the ensuing riots were among the major factors behind the 1993 Mumbai bombings and many successive riots in the coming decade.Jihadi outfits like the Indian Mujahideen cited the demolition of the Babri Mosque as a reason for their terrorist attacks.

    Advani who turned 89 is responsible for the nearly 5,000 deaths and more than Rs.30,000 crores destruction due to his bloody wheels of 'Rath Yatra'.
    Ironically, instead of prosecution for criminal conspiracy, BJP in 2015 he was awarded the Padma Vibhushan, India's second highest civilian honor.

    The knowledge of existence of temple was passed by people from generation to generation. So first dispute came in 1850 at the end of mogul empire. So I think ram mandir should be built on that site.

    when some of the namesake muslim women knock the door of supreme court about triple talaq the law comission and central govt responded quickly but it took twenty five years just to see weather mr advani should be consider an accused or no babri caset. We can easily find out the game plan of delayed and denied part of justice. Even congress govt also ruled ignoring the facts of liberhan comission report. The day will come when the same justice system may ask to trial of mr modi for gujarat massacre. we minorities just have to satisfy with this much considering its justice . Thats all. When zakir naik can face charges trial ban ect everything for no fault so quickly the same policy cannot be expected about any sanghi leaders even found guilty or an accused.     We could not find the criminals of Akshamdham attack, Hyderabad etc.....etc.... All the persons accused / booked by the great Police have been acquitted .... So all these attacks are carried out by Bhoota, Prethas .....
