Congress challenges Goa Governor's decision over government formation in SC


Panaji, Mar 14 (IANS): The tussle for government formation in Goa on Monday reached the Supreme Court (SC), with the state Congress legislative party leader challenging the invitation extended by Goa Governor Dr. Mridula Sinha on Sunday to BJP leader Manohar Parrikar to form government.

All India Congress Committee (AICC) Secretary Girish Chodankar told IANS late on Monday that Chief Justice Jagdish Khehar had ordered setting up of a special bench for the hearing, which had been scheduled for Tuesday at 10:30 a.m.

Chodankar said that the Governor should have rightfully invited the Congress party to form a government in Goa, because it had emerged as the single-largest party, with 16 seats in the 40-member Goa Legislative Assembly, following the February 4 polls.

"We were the single-largest party. The Governor should have invited us to form government according to established constitutional practice," Chodankar said.

Congress legislative party leader Chandrakant Kavlekar filed the petition in the apex court late on Monday.

In his petition, Kavlekar has cited the apex court's decision in the Rameshwar Pandit judgement, where the Supreme Court had said that the single-largest party should be allotted the first attempt to form government in case of a hung assembly.

"Governor overlooked Sarkaria Commission Report and M.M. Punchi Commission Report. These reports were also upheld and endorsed by the court in Nabam Rebia and Bamang Felix V. Deputy Speaker AP Assembly matters," Chodankar said.

The Congress had 17 MLAs while the BJP had 13.

The Governor invited Parrikar to form government, after he met her late on Sunday and submitted letters of support from 21 MLAs, which includes three legislators each from two regional parties, namely Goa Forward and Maharashtrawadi Gomantak Party and two Independent legislators.

    BJPee has become so power thirsty that it has now forgotten the fact it is the largest political party which has the right to stake the claim for government formation.Perhaps arrogance has blinded the BJP and it has made up it's mind to crush any voice that could Challenge it's supremacy.

    The SC has done well in constituting a special bench to address this serious constitutional breach by the Governor. The nation will be grateful to the SC if they could even decide on removing the constitutional protection of immunity from prosecution given to the office of the Governor which is being misused by many Governors over the past two and a half years in the case of a grave constitutional breach. We have Arunachal Pradesh; Uttarakhand; etc just to name a few. Few of the Governors are behaving like the doormat of the Central Government and showing disrespect and disregard to the Constitution of India. Thanks to the independence of the Judiciary we Indians are saved and protected by a despotic government at the Centre. Since the Governor's office is misused by the Central Government the SC should direct the Governors to seek SC opinion for any advice on any constitutional matter instead of seeking the Central Government's advice.

    Michael, if Governor convinced himself a party has majority he can invite..this is what political history all along...Goa BJP met Governor, but i didnt read any news report of Congress visiting Governor & requesting to invite..instead, they are squarely blaming Congress High command for failing to forge a alliance..then why you need a formality of calling a party which is not confidence of having numbers!..except Delhi Congis, no state congressmen complaining about BJP!!..Courts go by book & thats why they are in snail pace, but ground reality infront of us on Arunachal and now in Uttarakhand also..the Congress had no support of their MLAs or people of state..

    in other place i read one of congress MLA Mrs. Jeniffer Manserate told "ಮ್ಮ ಪಕ್ಷದ ನಾಯಕರು ಆಸಕ್ತಿ ತೋರದೇ ಇರುವುದು ನೋವನ್ನುಂಟು ಮಾಡಿದೆ" also in continuation another congress MLA Mr. Aleco Rejinaldo said "ನಾವು 17 ಮಂದಿ ಇರುವಾಗ ಜವಾ ಬ್ದಾರಿ ಮರೆತದ್ದು ನಮ್ಮ ತಪ್ಪು. ಇನ್ನೊಬ್ಬರು ಸರಕಾರ ರಚಿಸಿದರೆಂದು ಅವರನ್ನು ದೂಷಿಸಿ ಫ‌ಲವಿಲ್ಲ. ತಪ್ಪಾಗಿರು ವುದು ನಮ್ಮಿಂದ"

    this is real fact happend, despite having 17 members congress higgh command didnt show interest to fom govt, till yesturday no congress leader met governer to seek permission to form govt.

    Bjp met governer and parade 22 MLA to prove that they have majority.

    Also to be noted that 1 congress MLA supported BJP in Goa and 1 in manipur.

    With out election congress lost 1 seat each in Goa and manipur.

    Mr. Michael,
    Normally Election Commission will not meet governer to inform which party is single largest party or who is having majority, in normal practice, after election Party who have majority will meet governer with list of supports together with election Commission letter of results and seek permission to form govt.
    Governer will varify the same, and request any party to form govt. if they have majority (i.e.; more than 50% of assembly capacity).

    Even a Independent proved infront of governer that he is passed in number game, offcourse governer will give him permission to form govt.

    I dont understand why Mrs. Margaret Alva failed to understand this small this, she was governer of Rajasthan and Uttarkhand earlier. or she was just rubber stamp to high command and never bother to understand her duty.

    In my openinon 1 thing can be changed as first proof majority in Assembly before taking oath.

    Let us see what is the outcome. Even if Congress is given a chance, people say they may not be able to pay the horse trading amount in cash to the concerned MLAs, after demonetization. People say, Modi had already made arrangement for such eventuality.

    ..publicity stunt to cry murder of Democracy..SC can stay and give 10 days more but SC cant form Govt for Congress..Congress has to get numbers, the way state unit openly blaming High command i dont think they have numbers..If they had they would have challenged in Goa court also..moreover its not about hijacking of MLAs, its all about smaller parties & whom they support..at the moment they are with BJP..

    BJP should understand and take moral responsibility that people have rejected their govt. The story was different if the party has emerged as a single largest party and fall short of simple majority. In this case it clearly shows that BJP is totally power hungry and they go to any extent to keep themselves in power. Disgusting!

    Dear Jossey,
    yesturday u raised 1 issue that Manohar parikar is not elected / elected member from goa people.
    i would like to inform you 1 thing that Mr. Akhilesh yadav former chief minister of Uttar Pradesh from 15 March 2012 to 11 March 2017 was not elected / selected by people of UP, he is an MLC not MLA.

    Even in this election he didnt contest from any seat in fear of defeat.
    Even MMS was not elected / selected by people still he enjoyed 2 term as Prime Minister of India.
