SC seeks reply from 6 states, including Karnataka, on plea to ban cow vigilantes


New Delhi, Apr 7 (PTI): The Supreme Court today sought response of six states, including Rajasthan, on a plea seeking a ban on cow vigilante groups there. A bench comprising Justices Dipak Misra and A M Khanwilkar issued notices to Rajasthan, Maharashtra, Gujarat, Jharkhand, Karnataka and Uttar Pradesh and asked them to file their reply within three weeks.

The bench has fixed the matter for hearing on May 3. During the brief hearing, the counsel appearing for the petitioner referred to the recent incident at Alwar in Rajasthan where a man was killed allegedly by a mob of cow vigilante group. The counsel claimed that the ground-level situation in these states was worrisome as the cow vigilante groups were resorting to violence there.

Solicitor General Ranjit Kumar, appearing for the Centre, told the bench that formal notices were not issued to the states on the plea after which the apex court sought response from these six states. The Supreme Court had on October 21, last year agreed to examine the plea which sought action against cow vigilantes who were allegedly indulging in violence and committing atrocities against Dalits and minorities.

Activist Tehseen S Poonawalla, in his plea, said violence committed by these 'Gau Raksha' groups have reached to such proportions that even Prime Minister Narendra Modi had declared them as people who are "destroying the society". The plea also alleged that these groups were committing atrocities against Dalits and minorities in the name of protection of cows and other bovines and they needed to be "regulated and banned in the interest of social harmony, public morality and law and order in the country".

"The menace caused by the so-called cow protection groups is spreading fast to every nook and corner of the country and is creating disharmony among various communities and castes," the petition said. The plea sought to declare as "unconstitutional" section 12 of the Gujarat Animal Prevention Act, 1954, Section 13 of Maharashtra Animal Prevention Act, 1976, and Section 15 of Karnataka Prevention of Cow Slaughter and Cattle Preservation Act, 1964, which provide for protection of persons acting in good faith under the Act or rules.

"These laws and the protection granted therewith act as a catalyst to violence perpetrated by these vigilante groups," it said. Seeking action against the vigilantes, the petition said the atrocities committed by them were punishable under various provisions of IPC and under the Scheduled Caste and Scheduled Tribes (Prevention of atrocities) Act, 1989.

    Everyone knows about the 2001 Parliament attack, where nine Lashkar-e-Taiba and Jaish-e-Mohammed militants stormed New Delhi’s British-built Sansad Bhawan only to be challenged and killed by the Delhi Police as well as Parliament Security Services personnel.
    What is less known is that this was actually the second attempted attack on the Indian Parliament. In 1966, while Indira Gandhi was Prime Minister, a mob – led by a troupe of naked Naga sadhus attempted to storm Sansad Bhavan, demanding that the Union government impose a national ban on cow slaughter. In the ensuing bedlam, the protestors killed one policeman, while police firing left seven gau rakshaks dead.
    The one big difference is at that time Mrs [Indira] Gandhi still used the law. Now it is not the law. These people are acting outside the law. This is true fascism because you say what is the law? I am the law. All this action is being done outside the government, worse, things are being done inside the government to choke the existing laws
    It’s happening again and again. It can’t be that when the last vote of the UP election was cast, then suddenly love jihad was over? The Muslim boys left the Hindu girls? Its obvious that his only objective is to win elections and he will do anything to win elections.It’s to do precisely that instigate offline riots with the clear purpose of dividing people. And, the other person they have cast aside or are abusing is somebody who is anti-national. So it makes it exactly right for them to beat up the fellow.
    India has never seen such a weakest PM who call to “stop attacking Dalits”, saying “shoot me if you want, not Dalits”. PM whose 56 inch worth chest which holds the 4 inch heart can't even speak a single word of condemnation when fellow Indian citizen was brutally murdered?

    President Mukherjee should morally take responsibility of this unconstitutional murders due to his 'cow slaughter bill'.

    cow rakshak may be controlled by beef exporter ?if Indians beef they can't export and make profit in that ,India is the largest exporter of beef in latest survey. if its go matha let central ban all over India and stop export. why to kill innocent cow transporter.

    The problem of cow vigilantes will be solved only if the States issue permits to cattle slaughter houses to each taluks of the state.

    Well said Emi, most of them are fake Gav Rakshaks, earning a career out of it and many hoping to climb political ladder faster using this theme! Bottom line is almost all of them are greedy for quick money and power! If someone really loves cow, they should use a land and look after old cows at their premises, not preaching and staying in apartment!. For money most of them are putting cow ahead of human life and welfare! and thousands blindly to support them in the name of......., benefit goes to one political party only which is direct rep and custodian of God and faith....while preaching most of them live an opposite kind of life! I wondered how these issues came only after Adwani yathra action and a TV serial... guess money and power....so low is our politics!!
