Yogi Adityanath equates silence on triple talaq to Draupadi's humiliation


Lucknow, Apr 17 (Deccan Chronicle): Uttar Pradesh Chief Minister Yogi Adityanath on Monday called for an end to the practice of triple talaq, and advocated the implementation of a Uniform Civil Code across the country.

He also invoked the disrobing of Draupadi in the Mahabharata to emphasise his point.

"When I see people silent on the raging issue (of triple talaq), the episode from Mahabharata comes to my mind. Draupadi asked the palace - who is responsible for this situation? Who's responsible for this crime? Vidura said those responsible are criminals, those who supported this incident are culprits, those who are silent are responsible," Adityanath said according to NDTV.

Raising the 'triple talaq' issue, Prime Minister Narendra Modi on Sunday said at the BJP National Executive in Bhubaneswar that justice should be done to Muslim women.

Hinting that he was against triple talaq, Prime Minister said if there are social evils, the society should be woken up and efforts made to provide justice to the victims.

In his address to the BJP national executive, Modi said there should not be any "conflict" in the Muslim community over this issue.

"He (Modi) talked about social justice. He said our Muslim sisters should also get justice. Injustice should not be done with them. Nobody should be exploited.

"We do not want conflict within the Muslim community over this issue. What we have to do is that if there are any social evils, we have to wake up the society and make efforts to provide justice to them (Muslim women). That was the Prime Minister's spirit," Union Minister Nitin Gadkari said while briefing reporters about Modi’s speech.

Earlier, Modi had also intervened in a discussion about the backward commission, saying that society should be more accepting of backward Muslims.

    Dr. MMS worked silently and kept us safe during the last global recession while delivering consistent economic growth, but since that last 3 years there has been a major failure in performance and delivery at grass root level.

    "Divorce may be pronounced twice; then the wife may either be kept back in fairness or allowed to separate in fairness." (Al Baqarah 229)

    "And the divorced women (after the pronouncement of the divorce) must wait for three monthly courses... and their husbands are fully entitled to take them back (as their wives) during this waiting period, if they desire reconciliation." (Al Baqarah 228)

    "Then, if the husband divorces his wife (for the third time), she shall not remain lawful for him after this divorce, unless she marries another husband..." (Al-Baqarah : 230)

    "When you marry the believing women, and then divorce them before you have touched them, they do not have to fulfill a waiting period, the completion of which you may demand of them." (Al-Ahzab : 49)

    "And if those of you who die, leave wives behind, the women should abstain (from marriage) for four months and ten days." (Al-Baqarah 234)

    The rules prescribed in these verses were as follows:

    A man can pronounce at the most three divorces on his wife.

    In case the husband has pronounced one or two divorces he is entitled to keep the woman back as wife within the waiting period and if after the expiry of the waiting period the two desire to re-marry, they can re- marry there is no condition of legalization (tahlil). But if the husband has pronounced three divorces, he forfeits his right to keep her as his wife within the waiting. period, and they cannot re-marry unless the woman re-marries another husband and he subsequently divorces her of his own free will.

    The waiting period of the woman, who menstruates and marriage with whom has been consummated, is that she should pass three monthly courses. The waiting period in case of one or two divorces is that the woman is still the legal wife of the husband and he can keep her back as his wife within the waiting period. But if the husband has pronounced three divorces, this waiting period cannot be taken advantage of for the purpose of reconciliation, but it is only meant to restrain the woman from re-marrying another person before it comes to an end.

    There is no waiting. period for the woman, marriage with whom has not been consummated, and who is divorced even before she is touched. She can re-marry, if she likes, immediately after the divorce.

    The waiting period of the woman whose husband dies, is four months and ten days.

    @Chittaranjan: One Law is not good Idea for country like India. India is very divers be it religion, language, local cultures. India strength lies in being tolerant divers society.
    That's why if in one part of country eating beef is crime because of religious belief, in other part it is not.
    If you want one law, one language, one religion, then think of consequence. We want India of Mahatma Gandhi & not of RSS.

    Having just a Muslim name, doesn't make them Muslim. By the way if u look at her background, then you will know that she would be born to a cocktail parents, mixed up Religion or could be a wife of a Non-Muslim, coz a true believer will never raise any question on Shariah or insult in public.
    Ask her if she even offer her prayers and fulfilling first the right of God, 5 times a day without fail, later on she can ask for her or others justice.... Let her 1st do justice with God for what He has bestowed upon her by His mercy.
