Triple talaq is worst form of marriage dissolution, says SC


New Delhi, May 12 (PTI): The Supreme Court today said the practice of triple talaq was the "worst" and "not desirable" form of dissolution of marriages among Muslims, even though there were schools of thought which termed it as "legal".

There are "school of thoughts (which) say that triple talaq is legal, but it is the worst and not desirable form for dissolution of marriages among Muslims," a five-judge constitution bench, headed by Chief Justice J S Khehar, said on the second day of continued hearing on the matter.

The observation came when former Union Minister and senior advocate Salman Khurshid, who is assisting the court in his personal capacity, told the bench that it is not an issue where judicial scrutiny is required and moreover women have the right to say 'no' to triple talaq by stipulating a condition to this effect in 'nikahnama' (marriage contract).

The court asked Khurshid to prepare a list of Islamic and non-Islamic countries where triple talaq has been banned. The bench was then informed that countries like Pakistan, Afghanistan, Morocco and Saudi Arabia do not allow triple talaq as a form to dissolve marriages.

Senior advocate Ram Jethmalani, appearing for one of the victims, was blunt in his arguments and assailed the practice of triple talaq various constitutional grounds including the Right to Equality.

"The right of triple talaq is available only to the husband and not to the wife and it breaches the Article 14 (Right to Equality) of the Constitution," Jethmalani said. "There is no saving grace for this method of granting divorce. One-sided termination of marriage is abhorrent, and hence, avoidable," he said.

"Triple talaq makes a distinction on the ground of sex and this method is abhorrent to the tenets of holy Quran and no amount of advocacy can or will save this sinful, repugnant practice which is contrary to the constitutional provisions," he added.

No law can allow a wife to become an ex-wife "at the fancy of the husband" and it is "the highest kind unconstitutional behaviour", Jethmalani said.

The high profile hearing on a batch of petitions challenging the constitutional validity of triple talaq will continue after the lunch break.

    Triple Taalaq a license to brutally kill a married life by only saying, Talaaq, Talaaq, Talaaq. Hope good decision will give enough direction to the Muslim community to start overhauling their personal law without law of the land to start taking it by itself.

    A fundamental question, why triple Talaaq at all in the first place???. As per Quran you MARRY upto 4 women for the sake of the woman/ women to help, support and as security, then where is the question of divorce under any circumstances?????.......

    Well this is the headline...media chooses headline which is half truth to create sensationalism
    Well if TT is banned ...then it is good..TT is not universally follwed by muslim communities in India only one school follows it..FYI mangalorean muslims dont follow TT..
    But will BJP stop politicizing now...or will it continue to another matter..
    Or will abolishing TT stop marriage/divorce related issues...Only time will tell...
    I think it wont...divorce related issues and rate in majority community is an examample before us....
    Some people who masquerade as reformers when muslim issues are concerned ..these are the same people who are involved in rapes in Godhra,babri and muzaffarnagar....It is bigotry which motivates not any really concern...

    Triple talaq is very logical and justified in todays times .

    1 . The definition of TRIPLE TALAQ only comes under the clauses of THE DISSOLUTION OF MUSLIM MARRIAGE ACT 1938 , as practised under sharia laws . So it should be noted that the Muslim marriage also can be considered valid under THE SPECIAL MARRIAGE ACT 1955 , where triple talaq clauses are not there , so Muslim women or men who has issue with triple can make use of this , and orthodox couples can refer to original sharia laws . So wisdom is to stop criticising the Islamic laws and forcing ANTI TRIPLE TALAQ stand .

    2 . TRIPLE TALAQ is not anti women , in fact reciprocal of it , the QULA system is already given to wives in case their husband comes under certain parameters . In this system women can claim maintenance from men till the period of 12 months ( IDDAT period ) and later WAKF board takes care of them .

    3. The only stand against TRIPLE TALAQ is by liberal feminists ( female chauvinists ) , gynocentric misandrists and atheists as they are conditioned to believe that it suppresses brides rights . Now consider other side , secular laws DV / 498A given enormous power to wives , where they can arrest husband and in laws just by mere verbal statement , misuse of such clauses are rampant and lots of innocent husbands lost their lives but nobody talks a out this or it becomes a national issue. ( when 99 percent of laws are in favour of women , isn't it logical one religious law tilted or favoring men ?)

    4. Triple gives rights to husband to divorce their adulterous , promiscuous wives instantly without going threw secular courts saving lots of valuable time . Now there might be some feudal minds who are misusing this clauses for their selfish agenda , this has to be regulated threw proper awareness again within the gambit of sharia , not by amending it

    5 . Patriarchy is a natural social order evolved threw ages and given men more deserved rights due to their contribution to mankind . So logically abrahamic religions gives more power to men / husbands , keeping the uniformity of balance . Not by oppressing women but keeping their diverse homemaker qualities intact .

    6. So bit tilted power towards husband , wives will have fear in case of if they go stray and this stops them breaking families . TRIPLE TALAQ is considered as a weapon is just like surgeon knives , it depends how you make use of it , either to kill or save someone's life . If there is no fear and husband's are powerless without clauses of TRIPLE TALAQ , there is a chance wives going astray as secular laws ( like 498 A ) will benefit them even if they are guilty .

    7 . So having said this , I want to exclude this power equation where husband and wife work on egalitarian concept with equal balance . I agree such marriages exist and they make use second law which i already mentioned above

    I couldn't agree with Mr Jethmalani more. Triple talaq not only sanctions inequality but is also degrading to the wife who becomes a disposable chattel! Indian muslims continue to live in the Middle Ages when the likes of our neighbours Pakistan - and even Saudi Arabia - have banned the inexorable practice. Hope the SC comes out strongly against TT and gives Parliament a green light it needs to reform in the same way that the RC church's sanction of nullity of marriage was held by the courts to be invalid as a form of divorce and any one marrying after that type of divorce commits adultery. It is not interference with religious rights which cannot be recognized in the light of the constitution. Of course I realize that there will be backlash from the Muslim community but a progressive Parliament cannot back down just because of that..
