Justice Dipak Misra to be next Chief Justice of India


New Delhi, Aug 8 (IANS): The government on Tuesday cleared the appointment of Justice Dipak Misra as the next Chief Justice of India.

Justice Misra, who will be the 45th Chief Justice of India, will succeed incumbent J.S. Khehar, who retires on August 27.

The outgoing CJI had recommended the name of Misra, the next senior-most judge in the apex court, as his successor.

Justice Misra will have a tenure of nearly 14 months as the Chief Justice of India, as he is slated to retire on October 2, 2018.

The 63-year-old judge will be the third person from Odisha to become appointed the Chief Justice of India, after Justice Ranganath Misra and Justice G.B. Pattanaik.

He headed the bench that rejected Mumbai serial blasts convict Yakub Memon's plea for stay on his execution and that which upheld death sentence awarded to December 16 gang rape convicts.

Born October 3, 1953, Justice Misra joined as an advocate on February 14, 1977 and practiced in constitutional, civil, criminal, revenue, service and sales tax matters in the Orissa High Court and the Service Tribunal.

Selected as an Additional Judge of the Orissa High Court on January 17, 1996 and transferred to the Madhya Pradesh High Court on March 3, 1997 and became a permanent Judge on December 19 the same year.

Justice Misra took charge of the office of Chief Justice, Patna High Court on December 23, 2009 and charge of the office of the Chief Justice of Delhi High Court on May 24, 2010.

He was elevated as a Supreme Court Judge on October 10, 2011.

    The CJI is a constitutional authority and presides over the country’s judiciary, comprising 31 Supreme Court justices, over 1000 high court judges and over 16,000 subordinate judges. The CJI dispenses justice in the highest court in cases involving complex constitutional issues, issues affecting the rule of law, issues having an impact on governance in the country, issues touching the lives and liberties of 1.3 billion Indians, and dispenses justice in regular civil and criminal appeals. As head of the Supreme Court, the CJI wields wide powers not just in administration but also in constituting benches and allocating matters, often politically sensitive ones.
    Yet, Justice Misra has surprised many by what appears to be a serious lapse in conduct. He had applied for and obtained a lease of two acres of agricultural land in 1979 (while he was a lawyer) from the government of Odisha. In the affidavit filed by him (as a condition for allotment) he said: “I am Brahmin by caste and the extent of landed property held by me including all the members of my family is nil.”
    Can the Modi government appoint Dipak Misra as the next chief justice of the country without first resolving long-pending allegations that he acquired public land intended for the landless poor by submitting a false affidavit? This is the question being put to the prime minister and law minister by Adish C. Aggarwala, president of the International Council of Jurists, in the wake of Chief Justice (CJI) J.S. Khehar’s decision to recommend Justice Misra as his successor.

    People,

    Like parliament proceedings are telecast live SC and HC proceedings should be telecasted live...so everybody know how justice is dispensed in India....

    Like in Salman Khan appeal case Bombay High Court conducted its proceedings at midnight to grant bail so Salman Khan did not go to jail....these things should be telecasted live to take citizens into confidence....

    Indian judiciary is best in the world...it always reminds to Winston Churchill....

    India is only country in the world where SC/HC judges are selected/appointed by judges...not even Somalia does that...
