Government waives penalty for late filing of GST returns


New Delhi, Oct 24 (IANS): In a relief to GST taxpayers, the government on Tuesday waived the penalty for filing late returns for the months of August and September, and the money already paid as penalty will be credited back to businesses.

"To facilitate taxpayers, late fee on filing of GSTR-3B for August and September has been waived. Late fee paid will be credited back to taxpayer ledger," Finance Minister Arun Jaitley announced in a tweet.

Late fee of Rs 200 per day was being charged from businesses.

For the month of August, only 55 per cent of businesses had filed returns till September 25. September 20 was the last date to file GSTR-3B.

For the month of September, the last date to file GSTR-3B was October 20.

GSTR-3B is a summary return of details of outward supplies, inward supplies, credit and payment of Goods and Services Tax (GST).

The government had earlier waived off penalty for late returns for the month of July.

GST expert Pritam Mahure told IANS, "It's a beneficial move and will benefit taxpayers who are yet to file or have filed delayed returns. However, the late fee is getting credited in ledger and thus cannot be set off against tax liability as of now."

    Honest question to the government representing as a businessman.

    Businessmen have been forced to pay GST on purchase of goods/services, collect GST on sales of goods/services, keep record of transactions, buy software for the same, employ man power for GST, use stationery, hardware, software etc for GST & have t bear the so called consultants bills. But, what the government is giving in return for the businessman ? Is there free software, stationery, social security if they go out of business due to losses ?

    Indian government (IT rules) says, if you incur business loss, either set off against other income or carry forward for another 8 years to set off against "future" profits. But, will the business survive for 8 years if it continuously incurs losses ? There is an option to file & claim refund of advance tax paid for "that" particular year. But, in US, If you incur loss you can claim refund instantly of the taxes you paid for "past" years so that you have cash flow to continue your business.

    Hope our businessmen get educated in this digital world & reverse one way loot by the governments soon. I am not complaining about tax. But, what is the benefit for the businessmen for extra effort he is taking to collect tax for the government & what about his expenses ? Is he not a citizen like other citizens ? Why this additional cost/burden on businessmen only ? What he gets if he is out of business ? No social security for tax payers in India ? Then why do you penalise businessmen ?

    This bias needs to be stopped.

    GST has become a pain.

    Users have been taken for granted. There is no proper help desk. It is like a you are riding a new technology motor cycle and there is no one to help. When you do mistakes, you are being penalized. Even the GST authorities do not know how to ride the motor cycle and they penalize the users. If you continue like this people will penalize you in next election.

    Now they say penalty is waived but many people would have already paid and they will have to wait for credit.
