Mangaluru: DRI seizes 11 bars of gold worth Rs 39 lac from passenger at airport

Mangaluru, Jan 31: The officials of the Mangaluru Directorate of Revenue Intelligence (DRI) on Tuesday January 30 arrested a passenger at Mangaluru International Airport here for attempting to smuggle gold worth Rs 39 lac from Dubai.

The passenger has been identified as Ahamed Nabeel Gaffoor (21), a resident of Kasargod, who arrived from Dubai by SpiceJet flight no SG-60 at 6 pm on January 30.

Acting on credible intelligence, the DRI mounted surveillance at the Mangaluru airport. On arrival of the SpiceJet aircraft from Dubai, the said passenger Ahamed Nabeel Gaffoor was identified and intercepted right at the aircraft door and was escorted to customs arrival area and subjected to thorough checking. It was revealed that he was carrying a mobile like item in his front trouser pocket. It was also observed that the so-called mobile was heavier than usual and it was sealed from all the sides.

On interrogation, Ahamed Nabeel admitted that he had concealed 11 gold tola bars of foreign origin inside the mobile pouch. On opening the mobile pouch, it was found that 7 tola bars of gold of foreign origin (intact) and 4 tola bars of gold of foreign origin cut into 8 pieces (totally 15 pieces) were cleverly concealed inside the mobile phone cover(pouch) by using black/silver adhesive tapes in order to avoid detection.

The gold pieces weighed 1m282 grams in total and were found to be of 24 carat purity and their current market value was placed at around 39 lac. The contraband gold was later seized by the officers of DRI under the provisions of the Customs Act, 1962.

The passenger Ahamed Nabeel Gaffoor was arrested for attempting to smuggle gold bars into the country.

Further investigation in the case is in progress.

    Its very difficult to pass our Mlore Customs officers with gold in any place concealed, so why do these people still think of smuggling gold via Mlore Airport?

    Operating to bring black money generated out side India after investing (black money ) outside India.. Out of 10 times, loosing one time to customs is not a big loss to smugglers. . Public and DRI are least bothered to find out, who is behind this smuggling. Is this money in the form of gold has come as a election fund.???

    This young chap must have done it before? this time was caught.May be a carrier.otherwise at this age to buy so much gold and bring it ,with a normal job is not possible .Een after some years.Just proove his pass when he went abroad and came ,and how often.He was probably promised a good amount of money and air ticket if operation succeed.Now ?he is caught,his people must have disappeared.He has to sit inside or pay money.

    The law says" Holder of Indian passport who is having at least 6 months continuous stay abroad can bring UPTO 1 KILO GOLD ON PAYMENT OF DUTY"
    They can catch ONLY IF THE SMUGGLER CROSS THE GREEN/RED SIGNAL CUSTOM BOUNDARY without declaring the gold. What , if a person want to import gold as per Indian law, and want to pay duty, these custom officers will not allow to do that, they will arrest him/ her at the aircraft gate.
    If the guy is clever, he can sue these custom officers as they arrested him from the aircraft door not leaving the airport without declaring the gold.

    I do not think that concealing gold inside a mobile cover would provide a conclusive evidence that that its owner intended to smuggle gold to India.

    I have no doubt that the gold was intended for smuggling purposes. However, since the guy was arrested from the aircraft door itself, he was never given an opportunity to declare the gold and pay the duty. So legally speaking, what is the crime? The mode of packaging in itself is not a crime.
    Confessions made by the accused to the interrogators carries very little weight in a criminal trial (unless independently proved by other evidences) since the Indian constitution clearly forbids the accused from testifying against himself.

    In short, this guy needs two things:

    1. A smart lawyer who will be able to puncture any case made by the customs since they arrested him with the expectation that he may not be paying the duty; and

    2. A commercial arrangement with a wealthy influential financier who would offer to pay the lawyer’s fees and any duty he would eventually be required to pay on those gold (since this guy has already been arrested, it is highly unlikely that the true paymasters of this gold would actually turn up in this customs proceedings).

    Concealing in mobile cover could be for security reason, as the gold is a valuable item, can be stolen .
    Mangalore custom officer must give the opportunity to all the passengers carrying gold to DECLARE prior to crossing the green/red channel. If not declared then they have all right to arrest the person concern. But they do not have any right to arrest a person from the aircraft gate as the declaration of gold is not done inside the aircraft, it is done inside the terminal prior to crossing the green/red channel.
