What is holding Centre from appointing Justice KM Joseph as SC judge, asks Chidambaram


New Delhi, Apr 26 (NIE): Former Union minister P Chidambaram Thursday hit out at the Narendra Modi-led government for stalling the appointment of Uttarakhand High Court Chief Justice KM Joseph as a Supreme Court judge despite the latter’s name getting cleared by the Collegium.

In a series of tweets, Chidambaram questioned the intentions of the Centre. “Delighted that Ms Indu Malhotra will be sworn in as Judge of the Supreme Court tomorrow. Disappointed that Justice K M Joseph’s appointment is still on hold,” he tweeted.

“What is holding up Justice K M Joseph’s appointment? His State or his religion or his judgement in the Uttarakhand case?” he asked.

Stating that the recommendation of the SC Collegium is final, the former finance minister asked if the government considered itself to be above the law. “As the law stands now, the recommendation of the SC collegium is final and binding in the appointment of judges. Is the Modi government above the law?” he tweeted.

While the Centre on Wednesday cleared the elevation of senior advocate Indu Malhotra as a Supreme Court judge, it, however, kept on hold Justice Joseph’s name despite the Collegium recommending both names for appointment in January.

Justice K M Joseph had struck down the Centre’s order to impose President’s Rule in Uttarakhand in 2016. Ever since, the Collegium’s recommendation for Justice Joseph’s transfer to Andhra Pradesh and then his elevation to the Supreme Court has been blocked by the central government.

Meanwhile, Malhotra, the first woman to be elevated to the post of a Supreme Court judge directly from the Bar, has received the Presidential warrant, or requisite clearance to take oath as a Supreme Court judge. Her swearing-in is scheduled for Friday.

    As rightly said let us not give a religious angel to the Supreme Court but can we be silent on the Justice Lodha case??? What is happing today at the Center is giving cause for these thought. As our PM is silent when his supporters give communal speeches, what message is he trying to give the people of India, now also by taking control of the judiciary the Centre will bring in new laws determntal to our countries secular fabric.

    Why congress is so interested in Justice Joseph....may be chiddu wants him to support his son case...
    Merit and skills should be the choice of a judge .. Justice Joseph is No 42 on the list of 669 judges who are awaiting supreme court postings .

    Ask the same question to the government. Why is the BJP government not confirming appointment of Justice Joseph? Justice Joseph is not a congress nominee. He has been selected by the collegium of judges as stipulated by the constitution of the country. It is the vindictiveness of the BJP that is causing this crisis. The BJP wants only sanghis as judges in courts so that they can get away with corruption, murder and mayhem by getting clean chits from such sanghi yes men.

    ..it’s seniority every where counts not caste religion. Many don’t know since media very quite , in Karnataka nearly 20 thsnd SC/ST employees demoted. No one speaks about that SC strike down law made by Karnataka where Employees promoted on caste. It was challenged and SC strike down the law. Congress govt in a way agreed to SC. If so how this judge religion will be parameter when he is in 45th line!!

    Government has raised a question that he 42nd in the list of seniority.It wishes to know the
    grounds why he is being elevated.Wheres religion

    Despite the above, K.M., Joseph raised selective biased Allocation of Judges to the benches

    As soon as the Cow Government is thrown out it is better for the Citizens of this country.
