Mangaluru: Karthik Raj murder case - Court acquits all three accused

Mangaluru, Apr 30: The Mangaluru principal district and sessions court on Monday April 30 acquitted the three accused in the sensational Karthik Raj murder case.

Karthik Raj's sister Kavyashree, Gautam and his brother Gaurav were acquitted in the case due to lack of evidence.

Karthik Raj, son of former Mangaluru taluk panchayat president Umesh Ganiga, was attacked at Asaigoli on October 22, 2016. He passed away a day later.

His murder took a communal and political turn when right-wing outfits began protesting demanding justice in the case. BJP MP Nalin Kumar Kateel had even threatened to set the district on fire if the culprits were not arrested. He later apologised for the statement.

The police then arrested Karthik's sister Kavyashree, Gautam and Gaurav for allegedly plotting the murder. The police had said that Kavyashree, who was working in a hospital, came in contact with Gautam, a resident of Santosh Nagar in Kuthar. Police said that Kavyashree had approached Gautam with a request to kill her elder brother because of certain differences with him, and also offered to pay five lac rupees for committing this murder. Gautam who was in need of money, along with his brother Gaurav allegedly murdered Karthik, the police had said.

However, due to lack of evidence, the court acquitted all three accused.

The judgement was pronounced by judge K S Bilagi.

    Few readers must be knowing the fact that, courts verdict is based on the FIR & Charge sheet filled by police during investigation . If your influenced and money at your disposal you can make sure your booked under various irrelevant sections of IPC so that defence can easily prove that there is no Merit in the case and judge will throw that case . You find rarely judges who want to study the case and order for reinvestigate the case for the sake of justice now a days .

    After 2014 PM Modi's government inception Indian Judiciary has fallen to its lowest. In the latest incident Vice President Venkaiah Naidu intervention to protect Chief Justice Deepak Misra against whom for sitting Judges of senior rank has revolted. If one analyse all the verdicts passed after 2014 has similar reason pronounced by Judges. Below are the reasons;
    1. Lack of evidence
    2. Judges recusing
    3. Evidence retracting from original statment
    4. Judges transferred before hearing.
    5. Judge and lawyers murdered to weaken the evidencne.
    6. Life threat to the victim lawyer
    7. Bar association preventing victim for filing Charge sheet.
    8. Destruction of evidence.
    Section 191 of the Indian Penal Code 1860 (IPC) makes ‘giving false evidence’ an offence: Basically, if a person, who is legally bound to speak the truth, makes a false statement, there is a fairly strict punishment for this offence a person found guilty of giving false evidence can be punished with upto seven years in prison along with a fine.
    1.What protection is court offering to witnesses? It is your duty to protect the witnesses, so they can depose fearlessly. You can’t file a chargesheet and not give your witness protection?
    2.What action Judge taking in cases where witnesses have turned hostile? Are they being charged for perjury for giving false evidence?
    The sad truth is that India doesn’t have a witness protection law. Recommendations to enact one have been floating around since the 14th Law Commission Report in 1958, all the way till the 198th Law Commission Report in 2006. In between, there’s been the Malimath Committee Report in 2003, as well as several SC judgments, emphasising that it is urgently required.
    It is a matter of great urgency that this significant flaw in our law is dealt with, otherwise the hostile witness problem is going to continue to plague our criminal justice system, adding to the already strained judicial workload, making it tougher to convict, and endanger lives.

    Due to lack of evidence, the court acquitted - this is now days justice for victims ; how culprits was plan without evidence , if it evidence how they destroy ...it is very scary society , our intelligence & investigation very weak on controlling crimes !!

    It is a simple reminder to everyone in India, how capable and how committed our police force is. This is happening in every state in our country. What is the use of we are having a police in the first place? We don't need stories, stories of such nature even scripted by TV Anchors like Arnab, end of the day what matters is evidence that is produced in court.

    With Modi led BJP, this stage even crossed in judiciary. Now, just by knowing most judge, we can know what the judgement he will come out with.

    If she can give 5Lacks to Gutham & co means just think how much she can offer other systems.

    Police catched the culprit only to stop Dakshina Kannada turned into ashes from Nalin kateels fire which he threatened give to get some politcial & communal mileage witout knowing culprits.

    Now Nalin kumar kateel can make Dharana & can threaten to fire again if kavayashree is not hanged
    No he will not do because no profit .
