Supreme Court opens Sabarimala Temple gates to women of all ages


New Delhi, Sep 28 (IANS): The Supreme Court on Friday opened the gates of the Sabarimala Temple in Kerala dedicated to Lord Ayyappa to the women in the age group of 10-50, saying it was violative of their fundamental rights and constitutional guarantees.

In a majority 4:1 judgment, the top court also read down the provision of Kerala laws that protected the prohibition and said it could not be covered under practices essential and integral to religious practice.

Justice Indu Malhotra, the only woman judge in the five-judges bench, who gave a dissenting judgment.

Chief Justice Dipak Misra reading out the judgment also on behalf of Justice A.M. Khanwilkar, said that subversion of women's rights under the garb of physiological phenomenon cannot be allowed.

"All devotees are equal and there cannot be any discrimination on the basis of gender," Misra said.

Justice Rohinton F. Nariman in a separate but concurring judgment said that people of all faiths visit the temples -- worshipers are not of separate denomination.

"Religion cannot become a cover to exclude and deny women their right to worship," Justice D.Y. Chandrachud also said in a separate but concurring judgment.

Holding the Sabarimala temple is not a denominational temple peculiar to any sect, the court said that the Ayyappa temple belongs to Hindus and does not constitute a separate entity.

The apex court also read down the provision of Kerala laws that protected the practice of prohibiting the entry of women in the age group of 10 to 50 years.

    what an irony!!! when women dont conceive or have the menstruation cycles properly with respect to conceiving they go to temples to pray for that reason and when they menstruate they are not allowed.. ??

    If women arè unclean when they menstruate then why has God created that fact of life...??

    Good judgement by the Supreme court.... At the same time those who enter temples should not destruct the sanctity of the devine shrine... All human beings are one and should be allowed to perform prayers in temples/mosque/church and Gurudwara.... and all prayer halls.... Sarve Janaha Sukhino Bhavanthu.... Sarve Santhu niramaya..... OM Shanthi Shanthi....

    The court verdict is right (under human rights / not in religious rights) in its place and our religious belief is on another side. Here women have to decide why we have to enter that temple. For sake of man vers women right or sake of beliefs and what is the meaning of temples. This is up to us.

    Even though the judgement is a welcome step with regard to gender discrimination, this might open a pandora box for many more litigation in respect of practices or rules within the religious places.

    There are so many rules or stipulations which might be looked in the light of gender discrimination.

    In Sabarimala case it was not a pure gender discrimination but was more of restricting women who falls in the age group of menstruation. May be religious heads or organisations should have a debate on this and loosen the rules or stipulations before the court interferes in the name of discrimination.

    When court is giving judgement that Mosques,churches and temples are not must required in religion why courts has to take any advice from any religious heads???? When temple heads welcomed the judgement of the courts than why you want to object about Sabarimala temple judgement????
