UN slams India's deportation of 7 Rohingya refugees


Geneva, Oct 5 (IANS): The United Nations refugee agency UNHCR on Friday slammed India's deportation of seven Rohingya immigrants to Myanmar, saying they had been denied access to legal counsel, a chance to access asylum processing and have their claims assessed.

United Nations High Commissioner for Refugees (UNHCR) spokesperson Andrej Mahecic said at a press briefing here that the agency was "greatly concerned for the safety and security of seven Myanmar nationals who were returned to Myanmar on Thursday".

India said that the men, who had been staying in Assam illegally since 2012, were deported on their "willingness", constituting the first batch of such immigrants to be sent back to their homes.

"On learning of their detention and the planned return... the UNHCR requested the Indian authorities to grant access to this group to assess their need for international refugee protection," Mahecic said, adding that the agency regretted that it did not receive a response to the request.

"The UNHCR continues to seek clarification from the (Indian) authorities on the circumstances under which these individuals were returned to Myanmar," the spokesman said.

"The UN refugee agency is concerned that they did not have access to legal counsel, were not given the chance to access asylum processing and have their claims assessed in India," he said.

Hundreds of thousands of Rohingyas have fled Myanmar in recent decades. In the latest refugee crisis, more than 720,000 Rohingya refugees found shelter in Bangladesh after escaping the Myanmar military crackdown in Rakhine province in August 2017.

The Myanmar military has been accused of "ethnic cleansing" and "genocide" by various UN agencies, International Criminal Court officials, human rights groups and governments including the United States.

Mahecic said that conditions in Myanmar's Rakhine were not conducive for safe dignified and sustainable return of stateless Rohingya refugees.

    UN is nothing but a puppet of USA. If they are really concern about Rohingyas they should have have taken stern action against Myanmar for their henious crimes. Why didnt they do that on the first place?. No third world country dare without the support of USA its allies. So as Myanmar did.
    Over the time again world is turning blind eyes over the state sponsored terrorism.
    USA , Russia, Israel and few powerful European states are always been found engage in such activities for decades merely for their self interest. These kind of monoplosim and attrocities against few "selective" countries has to be stopped.

Funny thing about these refugees is they want to live and breed in Christian country's only , they never go to country's which follow their religion .its time west kicked them back to the deserts , they are cursed and which ever country they keep their feet that land will also be cursed .

    UN is not a puppet of USA. UH Head quarters in USA and all most all funding for the UN comes from USA. Most poor countries depend on USA for Food, Survival and it's public funding. Soon after the Independence & just before the Green revolution in Punjab by Indira Gandhi India was a very poor country and was survived by USA handout called USA Aid. Still today millions of Indian origin people work in USA and invest the money in India. With out US mighty Dollars we the Indians will have no place to beg

    The BJP-led government in New Delhi has plans to deport (at least) some sections of the Rohingya refugee community currently living in India before next year’s general election. For the BJP – under whose watch India has seen a sharp rise in anti-immigrant rhetoric – the electoral dividends from deporting “illegal” Rohingya Muslims could be significant.

    India’s decision to deport the Rohingya is a violation of International and domestic obligations.While the electoral dividends from deporting Rohingya maybe significant, it sets an illiberal precedent for India and will only hurdle efforts to establish the country responsible as a South Asian power and secure a seat at the reformed UN Security Council.
    The International Covenant on Civil and Political Rights (ICCPR), which India acceded to in 1979. According to the interpretation of the UN Human Rights Committee – the official body that monitors the ICCPR’s implementation by state parties – and advisories issued by the UNHCR, Article 6 (right to life) and 7 (right to be free from torture and other cruel, inhuman or degrading treatment) of the covenant apply to not just the refugee’s host country, but also the country where they are to be sent back.

    India has also signed the Convention Against Torture (CAT), Article 3 of which expressly prohibits countries from returning refugees back to countries where they risk being tortured. However, India still hasn’t ratified the CAT, which does not legally obligate it to abide by the provisions of the treaty. Yet, signing it implies India’s intentions to move towards adhering to the CAT. Plans to deport the Rohingya back to Myanmar reverse this intention.
    Thus, the Narendra Modi government, instead of pandering to majoritarian sentiments, should heed UN secretary general Antonio Guterres’ suggestion during his visit to New Delhi this week: pressurise Myanmar to not just take back the Rohingya, but also create conditions for their safe, dignified and sustainable return.
