Bengaluru: DKS approaches court, seeking to quash enforcement directorate summons

Bengaluru, Feb 5: State minister for water resources, D K Shivakumar, has sought stay on the summons issued by the enforcement directorate seeking his personal appearance relating to case filed against him in connection with raids conducted on his properties. He also has requested the high court to quash the complaint lodged against him in the special court for economic offences.

Raids had been conducted a few months back on a flat at New Delhi, residence of the minister, and several places in the city on August 2, 2017.

Shivakumar's application questioning the action taken by enforcement directorate against him is yet to be listed for being taken up by a particular bench of the state high court.

    The problem for Modi is that these partisan actions and the blunt use of investigative agencies, without any intention to fast track cases, have caused a serious credibility crisis for the NDA. At this late stage, every midnight raid or FIR filed will be seen as a vendetta and the opposition will exploit it to the hilt. Modi cannot use corruption as an issue in this elections as he did in 2014. On the contrary, now he has to answer many questions linked to rampant crony capitalism during his regime.

    There must be a solid reason why an honest CBI officer who headed the organization’s anti-corruption bureau chose to submit an affidavit to the Supreme Court accusing the PMO of interfering with the CBI’s investigations. In the same affidavit, M.K. Sinha, a DIG at the CBI, implies that the entire government machinery was trying to protect former special director of the CBI, Rakesh Asthana, in a case of bribery.
    Sinha goes on to describe the CBI as ‘Centre for Bogus Investigation’ and ED as ‘Extortion Directorate’ in the affidavit. Such allegations are unprecedented in the last 60 years.
    We saw the partisan behavior of agencies just before the Karnataka elections when the CBI let the Reddy brothers off the hook in what was described as an open and shut case of illegal iron ore exports by the state Lokpal. Later, one also witnessed the multiple raids at the premises of Karnataka Congress leader Shivakumar.
    More recently, after Mayawati and Akhilesh Yadav sealed their 2019 electoral alliance, a fresh case was filed against Akhilesh in a 12-year-old sand mining case. Similarly, Chandrababu Naidu was at the receiving end when some old case of disturbing peace and order was reopened after he severed ties with the BJP. Even Mayawati recently came under the scrutiny of the ED.
    All these leaders have expressed solidarity with Mamata Banerjee. Mamata’s dharna provoked even Naveen Patnaik’s BJD, which said the CBI was also used against their party.

    The centers Prime Minister Modi government prestigious investigation institutes become the tool of exploitation. Maybe it is Karnataka or West Bengal the BJP's strategy remains the same.

    A few days back West Bengal IPS officer Bharati Ghosh on Monday formally joined the BJP, a year after the Criminal Investigation Department in Kolkata raided premises belonging to her and her close aides to recover imported liquor brands and Rs 2.5 crore.

    Once a close confidante of West Bengal Chief Minister, Ghosh came under the radar of the CID after one Chandan Majhi filed an official complaint alleging extortion and criminal conspiracy in February last year.

    She was also very close to Mukul Roy, another former loyalist of Banerjee, before he too joined the BJP.

    Incidentally, Roy’s decision to join the BJP too had come after the CBI had grilled him in the Sharada chit fund case.
    It has conducted a series of raids against former Finance Minister P Chidambaram and the latest one being against former Haryana Chief Minister Bhupinder Singh Hooda just before an important bye-election in his state. In most of these cases, the CBI had first identified the ‘accused’ and then tried to spin a case around it. The focus has been more to get into the news cycles and less on following the law. Political outcomes were always more important in such cases.
    The problem with the CBI is that they have been so focused on the political ‘bull’s eye,’ that they have forgotten that they are a professional investigative agency with some of the finest officers in the country.
    CBI and ED can be adventurous in hounding political targets but not financial fraudsters who escape India with loot while 'Chowkidar' is still on duty.

    It is becoming quite clear to the people that the BJP and Modi in particular are using the CBI and the ED to target opposition leaders and political parties before the next general elections as they are fearfull of loosing the elections. Such actions will only fuel peoples fury against the BJP.

    Suprisingly no BJP leader is being targetted by the CBI ot ED. Corruption is going out of control with this one sided approach to target oppositon leaders.

    Yes CBI. IPS, IRS & ED IS IN MODI"S POCKET WHY THEY ARE NOT DOING ANY RAID FOR BJP LEADERS HOUSE OFFICE AND ALL WHY ONLY RAID FOR OPPOSITION LEADER .
