Mysore: Mutalik Remanded to Judicial Custody till Apr 13

Mysore, Apr 7: Sri Rama Sene Chief Pramod Mutalik and 11 of his supporters, who were arrested in city yesterday, have been remanded to judicial custody till Apr13.

Tahasildar Geethakrishna passed orders in the evening for handing over the arrested persons to judicial custody. Police have framed charges on Mutalik and his supporters under CrPC Sections 107 and 151.

Advocates C.V. Keshavamurthy, H.M. Bhaskar and Subbaiah sought bail arguing that the alleged offence was bailable.

The advocates also raised the issue of flaws in the process of arresting their clients. The Supreme Court has passed orders that in cases where the offence is bailable, bail should be granted immediately after submission of application, the advocates argued.

Notice should have been issued to the accused before they were arrested. However, a flaw has been committed by the Police by arresting the accused without serving notice on them, the advocates said and sought bail for the accused.

Tahasildar Geethakrishna said that although there is a Supreme Court order that bail should be granted immediately after applying in cases relating to bailable offence, as there was a tense situation in Kyathamaranahalli and as Mutalik had declared his plans of entering the area, he has been sent to judicial custody till Apr. 13.

Police brought Mutalik and his supporters to Tahasildar's office by about 3.30 pm and appealed for sending them to judicial custody.

Facing the question how to send them to judicial custody in a case of bailable offence, the official proceeded to the residence of Deputy Commissioner and had consultation.

Later, after obtaining his guidance, the Tahasildar heard the arguments of the advocates and delivered the ruling by 7 pm.
