Supreme Court Disapproves of Karnataka's Language Policy

New Delhi, Jul 21: The Supreme Court Tuesday, July 21 refused to suspend a Karnataka High Court order which junked the state government's language policy binding all primary schools in the state to teach only in Kannada or students' mother tongues and not in English.

A bench of Chief Justice K G Balakrishnan, Justice P Sathasivam and Justice B S Chauhan refused to suspend the July 2008 order of the high court. "The language should be of universal advantage and not a barrier of communication," it said.

Refusing to accede to the state's plea to suspend the high court's order, the apex court bench said: "The parents should be given a choice in deciding the medium of instruction for their children. The schools and parents must have an option."

It slated tentatively in the last week of August the final hearing on the Karnataka government's lawsuit challenging the high court's order that scrapped the state government's language policy and granted freedom to the unaided minority schools in the state to choose their own medium of instructions for all classes, including the primary ones.

The high court had later even launched the contempt-of-court proceeding against several state government officials for allegedly not permitting the unaided minority schools in the state to teach students of classes I-IV in English.

The state government, in violation of the high court's July 2008 order, was asking the schools to follow the state's language policy of 1989, which stipulated that students in primary classes should be imparted education only in Kannada or their mother tongues.

Following a brief hearing of the state's lawsuit, the apex court halted permanently the contempt proceedings.

Karnataka government counsel Sanjay Hegde pointed out to the bench that the state has already moved the apex court against the high court ruling.

    It is a clever & a good decision of SC in disapproving Karnataka High Court order of language policy binding all primary schools in the state to teach only in Kannada or students'' mother tongues and not in English. I fully agree with the viewpoints of SC that the parents should be given a choice in deciding the medium of instruction for their children. The schools and parents must have an option. I hope all parents & children are happy about this decision of SC. and now the education in Karnataka wil in improve in all the caste without any discrimination.

    SC judgement brings cheers on the faces of poor people of Karnataka. Karnataka govt before approaching SC did not realise the root cause of the problem like doctor treating the patient without even touching him.

    The issue was debated in the assembly and with the bureaucrats, great writers , great cine actors and many great people of karnataka but school managements and parents were not at all called for any kind of discussions. Also, the poor people of Karnataka want compulsory Kannada medium in CBSE , ICSE board and schools started before 1994 schools if state imposes Kannada medium for the schools started after 1994 for primary classes.

    Common man cannot pay the high fees structure of prominent English medium schools in karnataka. In turn , he encourages the low fees structue schools to teach in English medium showing parent right even after announcement of list of derecognized schools in the state. Govt must first enforce the people serving the state govt to admit their wards to kannada medium schools and then bring law to the common man and private institutions later.

    Also , government should direct the people fighting for the Kannada medium and also the people who have filed SPL in SC must voluntarily the medium of instruction followed and school attended by their children and grandchildren in particular. Clear discrimination shown by the Govt of Karnataka between the poor and the rich , also the partiality between schools established before 1994 and the schools established after 1994 was upheld and the need of the multilinguistic people for the present day situation where English is the connecting and Global language , is clearly understood by the judges of SC. Really hats off to you honourable judge sir for your wonderful , meaningful judgement.

    If we take a survey of the children of our beloved politician, how many of them have studied in India? Are they studying in their mative language or in Kannada medium? If they are studying in Kannada will they get a chance to study abroad? In the current world human beings are not confined to a single and keeps on moving in search of better life. English is universal language. This is applicable to our politicians also.

    Good and prudent decisions by SC of India. As mentioned Languages don''t grow with barriers attached to it.I studied in Kannada (no Choice)at the same time, I don''t regret, as I never felt less or not competitive enough in this world. But meanwhile, I also understood how important English or any other language would enhance your skills. By studying in Kannada, it doesn''t guarantee that Kanndiga is born or he/she would understand the ethos, values or preserve those, in much better way, No, its not possible. Better we should concentrate on what we can give to our children, by means of good social life, language is only a medium, its not the way by itself. I also respect all opinions expressed in this blog, at least those who oppose also know English (or may be no choice), but its good that by this web page we can here voices or opinions which come from diversified experiences. Thanks to Daijiworld. But, please understand and communicate the same experience to your kids in what ever medium possible, let the choice of language be on them, or on parents who know the future or who guides them. Let the political issues be kept aside, they fight for a reason (vote) and may be the petition filed in the honorable court is in some language which is universally understood (English), while our nation has more than 20 official languages, which can us used to communicate. So, its important is to communicate the intent, and the message, the means is secondary. Same way English or Kannada, or may be German, French everything is fine, until its used for communicating , and the same should be understood. By teaching English in our schools, India will not become England in in Case.

    BJP govt. is doing right thing & Most of the readers are commenting against BJP for the sake of opposition. These readers praised & accepted Mr.Lalu & Mr.Mulayam who are dead agaisnt angreji. Lalu got pat from famous UK university . Do you think Lalu learnt in english medium. Only difference is that Lalu supported Sonia & got railway minister. In karnataka learning KANNADA is a must .JAI HO KARNATAKA.

    Mr Deepak Shetty/kundapur, I dont agree with your observation. Here you mention that children grasp and learn fast if taught in native language. Whats the native language of twin coastal districts of udupi and mangalore. It is tulu which doesnot have alphabets of its own and your kannada is slang and if spoken in bangalore nobody would understand it. I agree kannada is our state language. Learning kannada must be made madfatory, but parents and children should be given the choice of ing medium of instruction. Could you please tell me in which medium your children are curently studying? I am sure they dont study in kannada medium. When preaching comes you just dont consider youself but when it comes to practice you are the first one to deviate from what you advocate. Just double standard like BJP in karntaka...ahhh...ahh...heee hhheeee...

    Deepak, If you have so much love for the Kannada language, please send your kids to Kannada medium schools. Government runs these schools for free. That is a CHOICE that is left to you. For the rest of us, who are you or the government to impose? The Hippocratic attitude of the political parties in this state is deplorable. They cannot impose their narrow minded will on the people. After all, not all of us can survive as politicians in this world, there by making money through very dishonest means. Those very politicians send their kids to English medium schools and also abroad. Why are they not practicing what they preach?

    I am amazed to see some of the comments expressed by readers of this forum. It has become a habit for few to criticise everything just for the sake of it. This one is the stand of present karnataka govt., supported by other political parties like congress and JD(S). The policy says schools can teach english from 5th standard onwards, so what''s wrong in it? According to many experts/educationists a child eductated in its native language will have more grasping power compared to other languages. I have seen many people (friends/relatives)studied in english medium getting failed in exams and life miserably. So to say only by getting education in english will give tham an advantage is false. I am sure many of the readers who expressed their views must have done their eductaion in kannada medium. Did it stop them from coming up in life? According to latest UN survey within next few years many languages will disappear from this world. We do not want to happen same thing to our dear kannada/tulu languages. Unlike Bengalis, Tamilians and Malayalees we kannadiga''s have a habit of conversing in english and not in kannada. By doing this we are killing our language and our identity. How will our children learn kannada if it is not being taught in their schools? so I fully support govt policy on this issue.

    It''s a fair decision by the SC. However, schools should hire teachers who are proficient in reading, writing, pronouncing and effectively communicating in English. Teaching jobs in elementary schools are very important jobs and there should not be any room for nepotism, simpathy or any kind of bias in hiring teachers.

    What we want to do, or study is our fundamental right. the officers who make regulations must know what they are doing. a persons language skills are formed by the age of 12. in which case, the politicians kill the public,s future so that they can reign as kings. find other ways to keep our native languages alive.

    Justice prevails. Wonderful court ruling. These corrupt Politicians in Karnataka pay in Million to get their child admission in well known foreign universities but they try to impose ''Kannada'' only the medium of study. Can Karnataka Government assure livelihood & a decent life to those people studied in Kannada Medium? Currnet Politicians though they are old enough, they don''t allow young generation to get into politics? So, indirectly making young people get frustrated and find a way for the livelihood whether it is joining terrorist group, naxalites, underworld, hafta vasooli etc.

    Good decision by the SC. who knows our needs better than we ourselves. who are these shameless politicians to decide what we want to dress,talk, read, study and above all live a life of our own. We know very well what is better education but these people only graduate in crimes, hate politics and above all indulge in all sort of illegal activities and finally to cover up their sins join politics and become Netas (sick)it''s a shame for democracy.

It is unfortunate that critical issues such as education are left in the hands of ignorant and narrow minded politicians.     SC judgement brings confidence in People mind. Good judgement. Who are these corrupt politicians to decide the fate of the children ? Education choice and Education should be fundamental right of every citizens."The language should be of universal advantage and not a barrier of communication," it said.
