Abetment to suicide case: Bombay high court refuses interim bail to Arnab Goswami


Mumbai, Nov 9 (IANS): In a major setback to Republic TV Managing Director and Chief Editor Arnab Goswami, the Bombay High Court on Monday rejected his interim bail plea and asked him to apply for regular bail before the trial court.

A division bench of Justice S.S. Shinde and Justice M.S. Karnik asked him to file for regular bail under Section 439 of the CrPC with the Alibaug court and directed that it should be decided on merits within four days, "without being influenced by observations" by the HC's observations.

The division bench also posted Goswami's writ petition - seeking quashing of the police FIR against him - for hearing on December 10, and declined to grant his plea to stay the investigations in the case at this stage.

Goswami's team has already filed its bail plea before the Alibaug court on Monday - a day after he was shifted from a school there to the Taloja Central Jail on November 8.

The Republic TV head was arrested on November 4 in connection with the double-suicide case of architect Anvay Naik and his mother Kumud Naik on May 5, 2018 for alleged non-payment of his dues by Goswami, and two other creditors, Feroze Shaikh and Nitesh Sarda.

Naik's widow Akshata Naik and their daughter Adnya Naik, have filed a separate plea seeking a reinvestigation into the case or transferring it to an independent agency for probe.

In a related development, Maharashtra Governor Bhagat Singh Koshyari called up Home Minister Anil Deshmukh and expressed concerns over the security and health of Goswami.

He urged Deshmukh to permit Goswami's family to meet and speak with him, said an official spokesperson.

Leader of Opposition Devendra Fadnavis urged the Bombay High Court "to take suo moto cognizance" of the way in which Maha Vikas Aghadi (MVA) government in Maharashtra has "treated Goswami during the entire process of arrest to handling under custody, as alleged by him".

    Two drivers of MSRTC comitted suicide and have named the govt. and CM. Does abetment to suicide apply ? Also case of Naiks alleged suicide needs to be proved. Apparentlly the mother was strangulated. So was it suicide or murder and is someone else involved... To the Arnab baiters and left liberals /lutyens lobby ... truth will prevail and the powers to be will be exposed for what they are trying to coverup that media has exposed.

    Arnab should have been bold enough to go with the police who had come well prepared legally & otherwise to summon him for Interogation especially so since he was repeatedly challenging (barking) the CM & Com of Police on a public platform to take him to task!

    All his resistive actions, during arrest, show that he is just a "paper tiger" barking at the behest of interested parties!

    Also, investigation should be made of his sources of funding!

    I have, personally, lost all respect for him!

    I don't watch his shouting matches-totally embarrassing. But, his behavior under detention can best be described as bad parenthood. This man does not take anything lying down and believes totally in sensationalism. A Son-mother duo died; and that does not bother him whatsoever.
    No his detention is not silencing media. Not yet. If you have profess high standards for other and are popular because of that prophecy, you better not have skeletons in your closet.

    He can have debate with the police now. He wanted to debate with the commissioner of police. So they took him there. Nobody is above law. Why kangana is quiet now?

    Some people think they are smart, but there are smarter people than them. So many people put behind bars for not fault of theirs, just speaking against government becomes a crime. Who is fighting for them? One pregnant lady for jailed for CAA. Didn't she bear the injustice of the government. Why was Arnab quiet then.
    Why is governor so much bothered now for one person. Days are changing soon.

    Hahahahaha!! Now he will understand what all the guests on his channel feel!
    The nation already knows that he & Kangana are the unofficial spokespersons of the BJP- it is instructive that only BJP leaders ( including the governor of Maharashtra) have come out in support of him.
    Everyone else, including the Editors’ Guild and Bar Association have merely paid token lip service.
    I have no love for the Shiv Sena or Congress, but it looks like they got it right this time.

    Mr. Arnab knows in and out of these people and that's why Governor worried. In Bangalore two Lady actors are jailed due to Drug Mafia and no one bothered to get Bail.
    I personally Feel this Arnab should not get bail as he made many others life miserable in this Country. In the Case of P C he made big Hangama with his debates & now Let him also understand how the Life in Jail is ( he may be getting royal treatment because of his Publicity)
