Bengaluru: No summons needed before search warrant - HC

Bengaluru, Jan 21: The state high court (HC) has opined that in the case of criminal cases, there is no need to serve summons in all cases before undertaking search warrants.

The HC was considering an application filed by SDPI. SDPI questioned the order of the 4th additional city civil and sessions court order issuing search warrant. The judges expressed the view that under section 93 (1)(c), warrants can be issued for search operations without serving the summons. The bench also said that in criminal cases, there is no need to issue summons before issuing search warrant and depending on the situations, courts can issue search warrants.
