Bengaluru: BBMP asks historical temples, churches, mosques to submit title deeds

Bengaluru, Feb 28: The Bruhat Bengaluru Mahanagara Palike (BBMP) has been directed by the Karnataka High Court to provide a list of religious places on unauthorised land. Accordingly, all historic churches, temples and mosques will have to provide their title deeds and other relevant documents to BBMP.

As per a report by The Hindu, this also applies to the oldest temples in Bengaluru like the Someshwara temple in Halasuru belonging to the Chola period during the 10th century, and the Dharmaraya Swamy temple in Tigularapete from the Nadaprabhu Kempe Gowda period built in the late 16th century.

Churches in east Bengaluru, including St Mary’s Basillica in Shivajinagar that dates back to 1803, and St Patrick’s Church built in 1844 for Irish soldiers, have been issued notice by the BBMP to provide the title deeds and other land-related documents. Some places have also been issued notice to bring down the structure within three days of receiving the notice since they are unauthorised, The Hindu reported.

Civic commissioner N Manjunath Prasad told The Hindu, "All temples, gurudwaras, churches, mosques and other religious structures, irrespective of their historical and vintage value, are being served similar notices."

If there are no recorded historical documents of old religious structures, they can also submit a report on their historicity, he said.

Responding to the development, spokesperson for the Archdiocese of Bangalore J A Kanthraj was quoted as saying, "The church is not against the process. However, the manner in which it is being done is not right. Also, several churches have been issued notices asking the authorities to demolish structures within three days, without giving an opportunity to be heard." He also alleged that BBMP officials who were issuing notices were rude during their meetings with priests.

    If BBMP asked to demolish the structure means that BBMP is sure of illegality. if you have the documents to prove other way around, please do it or else demolish it. Individual or group of people build on a road side small religious structure and over a period, it become full-fledged religious place. No govt touch such places later due to backlash and vote bank politics. it already started taking communal colour. let see how long this process go...

    Good move by the honorable HC. I wonder why the previous governments has not taken such initiatives. A piece of land in Bengaluru being sold at crores of rupees. So it is important to set the things in order, particularly the assets being managed by so called 'Trusts'.

These resources can easily be pilfered, by influential trustees, hence a clear title deed, is not only essential, but extremely vital.... so that subsequent generations, are aware of their ancestral heritages....

    All historic structures built before the independence should automatically get registration and natural title deeds by the new govt and its new govt’s responsibility to renew and reassign those title deeds of those religious bodies as successive regimes did not seek title deeds in thier new empire. Govt and ASI should be having records of all those historic structures passed on by the earlier regime. Whatever BJP is doing now is illegal and fabricating its own rule to illegally snatch religious property.

    Just as people automatically got Indian citizenship after independence. People did not go to the new govt to avail Indian citizenship. So whatever was before independence is automatically gets legalized after the independence to that entity.

    This looks like a high handed approach and reaction to Court order, and should be challenged in the same court, even taken to the Supreme Court. It smells like the dispute like Ram Janmabhoomi. Is there no law of prescription in India as they have in the western countries. Land registries were not created in India until the 18th century, and whoever was the occupier since that time has the historical right to claim it was their land, not the land of the government or anyone else. When land registries were established, that was the time to register and if necessary survey the land so as to issue title deeds. It is too late for the government or the BBMP or any other authority, not just in Karnataka but in all States to drum up this campaign to regularize titles. The governments concerned, whether State or local authorities are embroiling themselves into unsolvable disputes.

    Lands presently under the custody of religious structures cannot be called as totally illegal just for not possessing valid title deeds. These were not forcibly confiscated lands, most of which were vacant without claim for ownership. Many of these lands were either leased or donated by the then rulers or the structures were constructed with the approval of the then ruling authorities. So a solution has to be found to legalise such properties.
