Karnataka High Court resumes hearing petitions on hijab row


Bengaluru, Feb 14 (IANS): A full bench of the Karnataka High Court comprising Chief Justice Ritu Raj Awasthi, Justice Krishna S. Dixit and Justice Khaji Jaibunnesa Mohiyuddin on Monday resumed hearing of petitions seeking directions to the ruling BJP government to allow wearing of hijab in classrooms.

The bench had given an interim order last week that no religious symbols are allowed for the students in schools and colleges until the final order of the court. The order banned both hijab and saffron shawls inside the school and college premises.

"We want to make an interim order on the matter of hijab row. The peace has to return to the state. Schools and colleges must open soon. This is not the final order. Until the final order is given, students must attend schools in uniform without hijab or saffron shawls," CJ Awasthi had opined on Thursday.

"We will hear the matter and issue orders soon," he had further said.

The larger bench also set aside the vehement arguments of petitioners seeking orders to the government for allowing students to wear hijab in classrooms.

However, petitioners moved the Supreme Court challenging the interim order banning hijab in classrooms. The Supreme Court had rejected the demand of urgent hearing by petitioners and said that it will only interfere at an appropriate time.

Meanwhile, the state government reopened schools up to class 10 from Monday, and is also expected to take a call on reopening of colleges by the evening.

    It is not a rocket science to find a solution to such an easily solvable/accomodable problem. People are at liberty to wear what they like in public, so long as t hey dress decently and cover their main torso and private parts . But there are rules of uniform in the Forces (Army, Police, Navy, Fire officials, etc.), and wearing turbans is their religious right. No one can question that or object. But in school there should also be discipline. Uniforms would be ideal and should be adhered to with some concessions to Muslim girls or for others who want to cover their heads even in class if they are in co-educational and not in girls only schools. In co-educational schools, what does it take to provide lockers to keep their full black dress which they should be allowed to wear until the classes commence, and continue to wear the hijab (the scarf only in class. Is there any need to be identified in public spaces that they attend a particular school? I am sure the Honourable Court - and if the matter goes higher, the Supreme Court will find a reasonable solution acceptable to all, Muslims and others alike.

    Why state by state needs separate law and regulations? let SC court decide with all religious leaders along with other intellectuals and give verdict. IT SHOULD BE ONE LAW FOR ENTIRE INDIA. In our time they used to come with burkha but before they enter classroom they used to go to bathroom and come out with the proper uniform.

    Un-necessary issue..., the matter could have communicated to Muslim students politely... by counseling them to realise that all are equal.. and one among all...inside the class..., Hindu's organizations must also .... take note of Brahmin students.... mindset towards lower cast students... in class, are they willing to sit next to them... I wonder... am the victim of it 5 decades ago....,but thanks to good education that i got... now b'coz of my qualifications & knowledge... Brahmins/upper class people have no issue..., in fact knowledge empowers everyone feel equal.. time for Muslim girls to work hard... focus on studies and show your identity in society....,

    Mr. Mahesh , Mangalore we appreciate your comment but you are not a judge to find solution. We are a great faith with Hon'ble court and judges that they obey constitution and Holy "Quran" . So it is the Fendamental right of Muslim girls to wear a hijab not from now it is ancient. So we have a faith on High court as well as "Supreme court".

    What is the connection of uniform civil code and school uniform. Secondly uniform civil code doesn't mean HINDU CIVIL CODE imposing on others, it will be a code acceptable to all.

    Uniform civil code is not a dress code, it is not possible to impose uniform civil code in the country like India, bcos there are number of cast riligion region and cultures, states like north east having thier own reginal laws which are not applicable rest of the country.
