Harassed by farm owner, driver's family seeks mercy killing in Madikeri


Madikeri, Mar 17 (IANS): A driver, along with his family, has filed a petition seeking mercy killing before the President for being tortured by the farm owner.

Subramani's family from Palibetta in Virajpet taluq claimed that the owner has dug a

15-feet trench around their to prevent their movement. They are forced to reach their house using a ladder.

Subramani has filed a petition in this regard saying he has been working in a 250-acre estate as a driver since 25 years and lives in a quarter provided by the owner.

But after some differences cropped up between the two over a financial matter, the estate owner Annamalai asked him to vacate the quarters. Subramani maintained that he would go out once the owner clears his dues of Rs 12 lakh.

An enraged Annamalai then dug a 15-feet trench around the house of Subramani overnight with a JCB. He also cut the electricity and water connection. The family members are heckled for passing through farm to reach outside.

Subramani family has filed two complaints in this regard with Virajpet Rural police station.

The labourer has stated that his wife is sick and he feels helpless and hence has filed a petition seeking mercy killing.

Pavithra, his daughter said that they are being given life threats also and deadlines to vacate the house without settling the dues.

However, the farm management rejected the allegations stating that it was as per the requirements of 'Vaastu'.

    I fail to understand what this driver is seeking. To kill the owner and claim it as "mercy killing"? How criminal can one get if that is the meaning of the plea.

    Mohan Prabhu Mangalore ,I understand that to get rid of his driver without giving his due of some lacs to vacate the house ,simply dug a trench ,saying driver is asking for mercy killing.It shows how merciless and want to getout of the house and mean one can the house owner be.God knows if there is anything connected with young girl?Or want to throw him out?Old type of house owners ,using people as if they their servents?

    Whatever the inside story. Electricity and water cannot be cut off without an order from the court. If Annamalai has done that, he has to be arrested. One cannot dig a trench surrounding a residence withput providing foot path area to walk. One cannot block foot passage existing from ages. If the driver has lived in the house since 25 years, thegoot passage to his house has existed since25 years. Digging a trench to block foot passage is a crime. Annamalai shoild be arrested if has dug the trench. This is written Law of the land in India.

    So according to you ownership of land and house is just bullshit....the tenent is resides for 25 years he becomes owner? However pending wages of 12 lakh is another issue, which needs to be investigated.

    If you have doubts, check with a lawyer. By your comments looks like you are not one. Tenant needs to be given notice to vacate. If he fails, court proceedings have to take place based on tenancy contract if any. Water and electricity .. So you have any doubt?

    @Sunil hebri. I have experienced similar cases and giving you and the readers some tips about tenancy. If you have doubts you could consult a lawyer or cut your tenants electricity and water. You coild land in jail of course. Thats your choice

    Going to jail is different issue, if one owns a house, tenent has to vacate the house with reasonable notice ....no law on earth makes the tenent owner for staying 25 years....looks like may be you somewhere have troubled your house owner, law is clear tenant is tenant, he cannot become owner for staying long in a house..

    We do not know the full inside story in this case... Driver has a 25 year history of service in the farm company... It may be that owner wants to deliberately throw him out without paying service dues... Or there may be a different angle to the whole story... Whatever the issues young daughter is the most affected....
