Mangaluru: Court slaps fine on bank for fleecing man who repaid vehicle loan in full

Mangaluru, May 15: The first additional district and commercial court considered the act of a bank which declared the bank account of a vehicle loan holder as NPA, though he had paid the loan instalments in full and also confiscated the vehicle against which he had taken the loan from the bank.

The court asked the bank to pay victim Danesh Rs one lac with 10% interest and compensation for the loss.

M S Danesh had purchased a vehicle on loan from earlier Corporation Bank Kavoor branch. The present Union Bank of India (since corporation bank was merged with Union Bank of India) confiscated the vehicle of Danesh saying that he has not done the repayment of loan on time and also filed complaint in this regard with the commercial court.

Justice T P Ramalinge Gowda, who heard the arguments of both parties, said that Danesh was paying his instalments in due time and had requested the bank to transfer the instalment amount from his savings account to the loan account. However, the bank showed negligence and declared his loan account as NPA and confiscated the vehicle. This is against the law.

Lawyers K S Nambiar and Vivek Nambiar argued for the defendant.

    1lakh +10% interst fine is too less. They should replay Danesh full amount of the loan as compensation + loan interest. Clear his loan rom their records and Return his car back. Public apology on 3 state and 3 national newspapers should also be published.

    If I had my say, I would plead the court to pay Rs. Ten lakhs instead of peanuts 1 lac with 10% interest and compensation for the loss. These bankers need to be taught a very severe lesson which should serve as a deterrent. The bankers and the kaamchor staffs think they're doing a lip service for services rendered to us. Instead they don't think that its because of customers like us that the banks survive. They even speak filth and use abusive words on customers if they remind them about their unaccomplished tasks.

    Many banks don't take action on BIG loan defaulters as they have God Fathers for influencing their case and also some Managers are assisting defaulters for some favors!? Most of the time small amount loan holders are the victims!!! It's good that the court has punished the bank for it's negligence and uphold the rights of the victim. Justice delayed but not DENIED...

    The staff cannot manage a individuals loan details. They cannot print details of transactions in the passbook properly sometimes printing is overlapped. Employees of the bank only know to go on a strike.
