Mangaluru, Jul 16: The Karnataka High court rejected a petition filed by Vishwa Hindu Parishad (VHP) workers against the decision of the additional city civil court of the city on the Malali mosque issue.
Petitioners Dhananjaya and Manoj had challenged the order of the city trial court on June 6. Justice Sachin Shankar Magadum had rejected the plea.
In their petition, Dhananjaya and Manoj had questioned the verdict given by the additional city civil court to first decide on the maintainability of the suit for permanent injunction in order to prevent the mosque committee from destroying the structure for renovation rather than appointing a court commissioner to survey the mosque.
Dhananjaya had urged the court to appoint a court commissioner to survey the mosque. However, the court said that jurisdiction needs to be decided first.
The petitioners were represented by counsel Vivek Subba Reddy, who argued that the court cannot give a ranking to the application when the petitioners had contended for the entirety of the issue.
