Riyadh, Apr 25: After spending about three years in a Saudi prison, Suleiman Abubakker Nelyadi from Puttur was released on Monday April 25 from Taif Jail, after paying the blood money of 675,000 Saudi Riyals from insurance company to the family of six Arabs killed in the 2008 accident when their car rammed into Suleiman’s stationed truck in the city of Taif.
 
As the blood money was to be paid by the person who the court decides to be responsible for anyone's death, Suleiman was expected to pay the sum in compensation, even a fraction of which he could not attord. So he had to spend a prison sentence until the blood money was paid.

When he did not have anyone to take up his case, the India Fraternity Forum (IFF), with units at Taif, Jeddah, Riyadh and Dammam  swung into action. In consultation with the welfare section of the consulate general of India in Jeddah, Althaf, the Forum coordinator in Taif was authorized to plead the case with the goverment departments concerned and since then Althaf has been regularly following up the case.


The Case

Suleiman was working as a truck driver for the past 25 years in India. To give a better life to his ailing mother, wife and five children - two sons and three daughters - 53-year-old Suleiman left for Saudi Arabia on January 29, 2008.

Although, he traveled to KSA on employment visa sponsored by Saudi national Abdul Hadi Sannam, Suleiman was jobless for almost two months even after arriving at a remote tribal village in KSA. At last, Suleiman was employed as a truck driver with Raza Al-Tami, a relative of Abdul Hadi.

Tragedy struck Suleiman within two months of working as a truck driver. A marauding car full of passengers rammed his truck that was parked beside the road, killing six Saudi nationals which led to his arrest by Saudi policemen who put him in jail.  

His case came up for hearing at Saudi court after a few months of tragic incident and the court imposed him a fine of Saudi Riyals 675,000, almost Rs 70 lac which would set him free.

Suleiman had left for KSA by selling his 10 cents residential plot, which was all he could possess after his 25 years of earning at Nellyadi here. Suleiman was shifted to central jail at Taif without any access to get in touch with his family back home.

The distressed family pleaded to social welfare organizations for early release of Suleiman. They even sent a plea to Indian Embassy in Riyadh, minister of external affairs S M Krishna, Indian President Pratibha Patil, Prime Minister Dr Manmohan Singh and also state chief minister B S Yeddyurappa to try their best for Suleiman’s early release. But no concrete actions were being taken in this direction.  

All along, IFF helped Suleiman's family to cope with tragedy, assisting financially as well as by approaching organizations and individuals to look into Suleiman's case. Finally it approached the insurance company which was providing the insurance cover to the truck.

Althaf coordinated with India Fraternity Forum, Riyadh, which succeeded in convincing the insurance company to approve the payment of compensation to victims’ family. A couple of days ago the insurance company issued a cheque for SR 675,000 and submitted the same to the Taif court. Sulaiman has released from the Taif jail on April 25 after completing all necessary formalities.

Rafeeq Kulai of IFF Taif said, "Since the beginning, we the IFF have stood behind this case, providing help to his family in India. For blood money, we coordinated among the insurance company of the unfortunate truck, truck owner and the family of Saudi nationals who were killed in the incident.”
 
Forum members in Taif, Riyadh, Dammam and Jeddah including Rafeeq Kulai, Noushad Katipala, Hussain Jokkatte, Althaf Bajpe, Sulaiman Manjeshwar have been actively involved in the successful negotiation with the insurance company, family members of victims and government authorities in order to facilitate the release of Sulaiman. 

There are a number of cases related to human rights of Indian nationals here in the Kingdom. IFF has been constantly working on the front. "Here in Saudi we the IFF are also taking up cases related to human rights of expatriates," they said, and claimed that about 1,100 such cases involving expatriates have been cleared only in Riyadh.

The efforts made by the IFF have been well appreciated by all communities as well as the NRIs.

    Brother Ali, the truth does not change according to the statement made by Suleiman, since he is not the right authority to decide whether it was his mistake or not.

    I know of a incident that happened in Dammam Jubail highway, where a speeding Britisher, blew to pcs an Indian.

    The Britisher did not spend a single minute in jail, nor did be pay a single paise, to the poor mans family.

    The reason, it was not the Britishers fault if a man happened to be in his way in a high way.

    Do you think the same judgement would have been passed if a poor Indian had blown a Britisher to pcs.?????

    I do agree with your statement. There may be possibility of human error in justice, but not in all cases. In this case Suleiman agreed in court that it is because of his mistake. (I clarified with my friend IFF member) Nobody forced him to tell this.

    There is no double standard rule for killing or murder in Saudi. If anyone killed or murdered, their family has right to ask blood money. Recently a Mangalorean got 8 lack riyals as blood money for the murder of his son.

    With Full of respect i replying to the readers that pls don't target any countries law without knowing the issue. If In INDIA ma be he is beaten to death by public. Other than KSA I checked in UAE also If there a mistake from driver or not he have to pay the bloodmoney. Beleave me if you go through the law in detail you will apreciate it.
    About Mr. Sulaiman Unfrotunately parked his vehicle in wrong direction and because his bad luck car hit his truck. But because of IFF today he is freed by KSA. 6 people died from same father who is a lawyer in profession. Al Hamdulillah IFF Succeeded to convince him. Pls Make Dua For ALL

    why are you mixing religion with what we have commented. please check what i have written.i have never mentioned religion. obviously Saudi is a muslim state, but the whole world knows what they do and not. please do not preach us about religion and law of GCC states, we too are working there. at the end of the day what matters most is that this poor chap is rteleased and united with his family. we have to be happy that an INDIAN is released.

    Brother Ali, the worrying fact based on this news item is not about the accident, nor about Suleiman spending 3 years in jail, but about Justice, for anyone including you and me, based on the Validity of your statement, “ There is no doubt this is government law based on Sharia.”

    As against the statement of IFF ,” There are a number of cases related to human rights of Indian nationals here in the Kingdom.

    IFF has been constantly working on the front. "Here in Saudi we the IFF are also taking up cases related to human rights of expatriates," they said, and claimed that about 1,100 such cases involving expatriates have been cleared only in Riyadh. This statement by IFF means, NO Justice for many Indians, without the help of IFF.

    I belive and understand that Sharia law means Gods law, meaning, it can NEVER BE WRONG, unless there is a, human error in judgement, on the part of those implementing it.

    Brother Ali my question to you is , is there a possibility of human error on the part of those implementing the Sharia law in Saudi, If yes , NO COMMENTS, if NO , the statement of IFF about cases related to human rights of expatriates being violated, cannot be justified.Do you agree.??

    Commenting on any issue concerning Saudi Arbaia, based on Indian/international law or understanding is foolishness by itself.

    The above news item clearly states, that Suleiman was NOT working with his sponsor, Which is a violation by itself, to land him in jail, and get the guilty verdict, irrespective of the fact, whether the accident was his fault or NOT.

    Also many insurance companies in Saudi do not accept claims, for accidents by drivers who are not legally authorised to drive a particular vehicle, inspite of having a valid Saudi drivers licence.

    Whatever the issue, it is sad,and outragious to know, that Indian officials did nothing to help, and Suleiman should thank his lucky stars, that IFF could manage to help him out of a very difficult situation.

    Mr.Ali Mangalore/Riyadh, what u wanted to prove ? you mean Suleiman parked his truck on the wrong side means on the centre of road? how come in 1 way road he could park wrong side & even how could he park outside of emergency parking lane.

    Before blaming on any religion, pls study what exactly happened on this case. Suleiman parked his truck on the wrong side. You can easily pass silly comments because the people who lost their life in this accident are not your relatives or family members. If the same thing happened to your family (Almighty save all of us from this kind of tragedies) will you keep quite….or fight for justice or compensation.

    There is no doubt this is government law based on sharia.

    i think the report given here is not complete .. coz why would a govt(court) even charge for some one else ramming to a stationary vehicle
    chances are there may be the truck was unintentionally parked in a no parking area

    Really a commendable job done by IFF. what the Indian Embassy or Govt. should have done has done by this organisation. As all of us know especially in Saudi there is no transperency for Law and Human rights there. Had it been any other U.S citizen the story would have been different. Our Govt always comes at the end or never helps at all. this is the reason most parts of the worlds treat our citizens as if we are slaves.
