Bhardwaj Explains Why he Recommended President's Rule

Bangalore, May 17 (IANS): Karnataka Governor H.R. Bhardwaj late Tuesday clarified that he recommended president's rule in the state as there was breakdown of the constitutional mechanism on the day the confidence vote in October last year.

Karnataka Speaker K.G. Bopaiah colluded with Chief Minister B.S. Yeddyurappa to disqualify 16 lawmakers for extraneous reasons just hours before the crucial floor test Oct 11, 2010, Governor H.R. Bhardwaj claimed late Tuesday.

"The speaker in collusion with the chief minister had distorted the character and composition of the state legislative assembly for extraneous reasons October 10, 2010 by disqualifying 16 legislators just before the crucial floor test the following day (October 11)," the governor said in a communique to the media.

The 16 legislators included 11 from the ruling Bharatiya Janata Party (BJP) and five independents.

The governor justified recommending president's rule by invoking Article 356 (1) of the constitution, as there was a breakdown of the constitutional mechanism on the day the confidence motion was taken up in the assembly Oct 11.

"The intervention under Article 356 (1) of the Constitution of India (recommending president's rule) is not limited to a situation of government losing its majority in the assembly.

"The intervention is called for whenever there is breakdown of constitutional mechanism in the state. The breakdown of constitutional mechanism also can occur in several other ways," the governor pointed out in the communique.

Article 356 allows the president to dismiss a state government on the advice of the governor of the concerned state or on his own if he/she is satisfied that the administration government of the state cannot be carried out according to the provisions of the Constitution.

"The actions of distorting the character of the assembly were resorted to by the chief minister and the speaker, as noted by the Supreme Court in its (May 13) judgment, to enable the floor test to succeed," Bhardwaj asserted.

A division bench of the apex court headed by Justice Altamus Kabir and Cyriac Joseph May 13 restored the membership of the 16 lawmakers by setting aside the disqualification order of the speaker.

The governor said the division bench held, among other things, that extraneous considerations were writ large on the face of the order of the speaker and the same had to be set aside.

"Unless it was to ensure that the trust vote did not go against the chief minister, there was no conceivable reason for the speaker to have taken up the disqualification application in such a great hurry," the judgment said.

Bhardwaj said he had recommended president's rule on the grounds that the government had lost the majority though an impression was being created in the minds of the public that the government enjoyed majority support.

"However in the instant case, though the origins of the breakdown can be traced to the question of support enjoyed by the government, the actual breakdown is due to tampering with the composition of the legislative assembly in unconstitutional manner," he pointed out.

Though the governor held the same view even Oct 11, 2010, the issue of disqualification remained sub-judice till the Supreme Court delivered its judgment May 13.

    Dear Padmanabha Shenoy, Udupi / Saudi Arabia...These types just think Congress do communal favour!!  but still its their inability to realise these Congress is playing with communal card for votes and creates everytime communal disparity...to better understand Congress is communal where BJP we can term as secular in national interest

    Shameless is CM and speaker cummulatively!! Even more shame less are rebels fought at SC after losing with Yeddy and high court!! No shame, ethics and morality at rebels supporting Yeddy after all the drama. There are many supporting Yeddys party in Karnataka just on religion agenda...They will realise after some years that this religion agenda is for looting tax payer and voters taken for a ride!! By then Karnataka is far behind Bihar or UP!! Atleast governer is keeping some control over these looters doing it in the name of God!!

    Ms. Jude, if you are saying BJP and CM is corrupt do you think Congress is clean? all are corrupt we people do no have other option than these corrupt people...why congress do not want to respect governers recomendation and bring president rule? becuase they know there will be reelection and they will lose the election very badly...

    We all know who is right and who is wrong in last election results.
    This governor is misguiding the people with his wrong interpretation of law of constitution(basically his own foolish ideas). Central government already mentioned that, they will not take any steps which are against the constitution, which is more than enough to prove that, this governor is wrong.

    H E the GUV of Karanataka, no need to explain the situation which led to invoke Article 356 of constitution of India on the issue Karanataka because BJP has little respect and if so they should had asked Yeddy to resign long before.BJP grass root workers level to High Command knows Yeddy is looting Karanataka for some time but BJP don't want loose this Govt @ any cost, that is the case and stregnth of Yeddy.KONANA MUNDE KINNERI BAARISIDAGA.......what happens?

    Hats off to this great man for not bending before the onslaught of a corrupt CM, his chela Speaker and a brigade of chameleons like Jaitley, Sushma, Venkiah etc etc. These BJP guys put on the halo of saints while blaming the congress for various corruption deeds, when every leader in the congress and its allied parties has resigned even before any judgements against them by the courts, just to maintain sanctity of public life.

    Yet this shameless Cm and his chela speaker are clinging on to their chairs. The BJP hartals and processions resemble funeral marches celebrating the death of their own party. A tiger once it tastes human blood becomes a man eater. Similar is the case with Yeddy. He has tasted power and corruption. Now he wants to remain in power and be corrupt for the rest of his life.
