Speaker Acted in Haste on 16 Karnataka Legislators: Apex Court


New Delhi, Jan 25 (IANS): Holding the disqualification of 16 Karnataka assembly members as mala fide, the Supreme Court Wednesday said that the speaker acted in haste to ensure that then chief minister B.S. Yeddyurappa did not lose a trust vote.

"Therefore, we hold that the impugned order of the speaker is vitiated by mala fides," said an apex court bench of Justice Altamas Kabir and Justice Cyriac Joseph.

Justice Kabir said: "Unless it was to ensure that the trust vote did not go against the chief minister, there was hardly any reason for the speaker to have taken up the disqualification applications in such a great haste."

The court said this in a detailed judgment in pursuance of its May 13, 2011 order restoring the assembly membership of 16 disqualified Karnataka legislators who faced action on the eve of the trust vote.

The legislators were disqualified by Speaker K.G. Bopaiah Oct 10, 2010, a day before the trial of strength of the government Oct 11.

The disqualification of the 11 Bharatiya Janata Party lawmakers and five independent legislators was upheld by the Karnataka High Court Feb 14, 2011.

The disqualified BJP legislators were Balachandra Jarkiholi, Belur Gopalakrishna, Anand Asnotikar, Sarvabowma Bagali, V. Nagaraju, Raje Kage, Y. Sampangi, Nanjundaswamy, S.K. Bellubbi, H.S. Shankara Lingegowda and Shivanagouda Naik.

The five disqualified independents were Gulihatti Shekar, D. Sudhakar, P.M. Narendra Swamy, Venkataramanappa and Shivaraj Tangadagi.

"It is obvious from the procedure adopted by the speaker that he was trying to meet the time schedule set by the governor for the trial of strength in the assembly and to ensure that the appellants...stood disqualified prior to the date on which the floor test was to be held," the judgment said.

The judges said that "Having concluded the hearing on Oct 10, 2010 by 5 p.m., the speaker passed detailed orders, in which various judgments, both of Indian courts and foreign courts, and principles of law from various authorities were referred to, on the same day, holding that the appellants and the other MLAs stood disqualified as members of the house."

Pointed to the speed with which Speaker Bopaiah acted, the court said: "The vote of confidence took place on Oct 11,2010 in which the disqualified members could not participate, and in their absence B.S. Yeddyurappa was able to prove his majority in the house."

The judgment noted that this happened "despite the view expressed by him (speaker) that upon submitting the letter withdrawing support to the BJP government led by Yeddyurappa, all the MLAs stood immediately disqualified".

Holding speaker's action as mala fide, the court set it aside along with the verdict of the full bench of the High Court.

    Sachidanand Shetty, Mundkur/Dubai, you have serious concerned about these two Judges of Supreme Court. I will give two Past incidents :

    1. Recently Most of the Cases of Yeddy, Bail is given by Justice B.V.Pinto.

    2. In the year 1995 Because of the prtoest from Christian & Vishwakarma community, the Karnataka Government withdrawn School Lesson Book " Oduva Aata" wriiten by K.Shivaram Karanth. Then the Karnataka High court gave its judgement that the decision of government is illegal & asked to reintroduce the Book!!!!. You know which High Court Judge gave this judgement ?. It is none other than Justice Michael F Saldanah!!!!!.

    What you say about these two Judgements ??????.

    Dear Nabeel Hanif, please note that had they followed the previous verdict given by High Court of Uttar Pradesh regarding disqualification of MPs’ when they dejected the same Party one which they supported to form a Government I would not have rejected their Judgment. There is no question of minority and majority here. They have to perform accordingly and they have to stand still and they will be respected by each individual too.
    I am doing same thing in Dubai whatever you do in Saudi Arabia. There is no question of daring to say that the verdict given by Dubai court is not acceptable to anyone since we do not have freedom of expression same like Saudi Arabia.

    Had the verdict given by any other Judges of Indian Supreme Court other than Altamas Kabir and Cyriac Joseph we would have accepted the verdict as it is. But we have serious concerned about these two Judges of Supreme Court. So it does not make any difference in Karnataka for BJP Ruling. Just ignore it

    The assembly was running without a simple majority and the status was to dissolve the assembly but the speaker played dirty games.The court took more than a year to give a verdict on a issue which insulted the entire voters of Karnataka. How people can keep trust in the judiciary if the justice is delayed like this.

    Kasab killed innocents people of India. Now he is 24. When he becomes 74 you will prove he is culprit...

    Entire Karnataka including speaker knew that he was wrong then..but who will ask him.. He is a speaker and he is helping a CM.. What will a court do..maximum it wil invite them and ask for explanation. That too after a year...And then give Anticipatory bail..god bless our country...Happy Republic day.

    Beautiful judgment by Supreme court. But corrupt high court judges of Karnataka gave wrong judgement. May have taken crores from Yeddy n Reddy. Shameless people.
