Govt Proposes 7 Years Jail for Teachers who Beat Students


New Delhi, Sep 10  (Agencies) : The ministry of women and child development has proposed imprisonment of up to seven years for teachers indulging in corporal punishment in schools.

 In a cabinet note prepared to amend the Juvenile Justice Act, the ministry has sought to include a new section on corporal punishment commensurate with the provisions of the Indian Penal Code for "hurt" and "grievous hurt" offences.

The amendment could be put up for the Union cabinet's approval in a few weeks and will be placed in Parliament in the winter session, reports Mail Today.

"The proposed section 85, which could be incorporated in the Juvenile Justice Act, spells a jail term of up to "one year or fine or both" in case a child is hurt and emotionally distressed. For every subsequent offence of this nature, the offender can be imprisoned for up to three years", says the report quoting an official.

For causing grievous hurt or severe mental trauma to a child, the offender could be liable for rigorous imprisonment of five years and fine and a subsequent  conviction could lead to a jail term of up to seven years and fine.

"Second conviction for both levels of hurt (emotional and physical) would also mean dismissal from service for a school teacher or someone working in a children's home or orphanage", says the source.

While parents have wholeheartedly supported this legal amendment, principals of reputed schools say the punishment is excessive.

"Government will have to define a system how such cases (of corporal punishment) should be investigated and there should be a safeguard so that the child is not victimised later on", says Ameeta Wattal, principal, Springdales School, Pusa Road, Delhi.

"I am not in favour of imprisonment of teachers if they resort to corporal punishment. A teacher punishes a child with good intention  and not to hurt him or her. Corporal punishment  is sometimes important to maintain discipline. I understand there are cases of  excessive punishment, but because of one instance the whole education system is being berated. This is unfair", says V K Williams, principal, Mount Carmel School, Anand Niketan, Delhi.

    I'm a student of class 9 and has been beaten severely and had gotten injured, had blood coming out if my arm when a teacher had beaten me and other students, just for not doing some work.

    And our maths teacher does the same too, and what they call it is their "style" like they literally will beat the c**p out of you and tell you to call your parents and they tell the parents bout us not doing work but not about how hard they had beaten us.

    So, is beating like this even legal?

    My brother is beaten up by his teacher's oftenly. He was once falsely involved in drinking alcohol. When he denied that he was not drunk , one of his teacher took him to a room and beat him hardly to make my brother accept that fake thing which he had never done. Is it fair to do so? such a harassment in such a tender age its really unbearable. Please help my brother so that he can get justice.

    teachers expect some thing from the students by punishing them.
    but some teachers will tease the children.
    i dont like the teachers who punishes the teachers by hitting them to the board.
    for example the sir named sunil hitted the boy named vinod to the board due to this the vinod head was damaged.
    so i request the government to search the teachers who discourages the students and they should be prisoined in the jail.
    i support this method who cross the limits in punishig the students.
    the punishment should be given to the students in a limit.
    the children who bears the dangeoures are great.

    According to my teachers should not allow to bite any student. For small reason. He/She can bite if student is wrong.than teacher bite.its teacher write. Without any mistake teacher bite the student than school management are responsible fro this act.

    This a good rule for students......when i was on 10th class there was a science teacher as well as principal of our school i.e Akshay aggrawal.....He beats the student very rudely with fresh green stick....he beats in legs ..blue lines are drawn in our legs but he doesn't,t stop beating .....he was very rude....he didn.t change yet

    When I was a student teacher used to beat us but it never demoralise me it taught me to do better. Today hardly any student respect teacher they case file against those things teacher dint even do that.Sometimes they show old injuries and tell that they had been beaten by student whether they beat em or not. Do any law their for self respect of teachers??Do their parents never scold them never beat them??Where is the law which is in favour of teacher. In India every human right law is for criminals and students not for teacher and police. No teacher can complaint when student disrespect them. Where police will complaint when any criminal insult them.this law is totally bias

    Mostly schools are appointing freshers and non experience Teachers to teach the co system boys and girls, support teacher voice is low and she did not accept the student compaline nor student wanted to compalin becuase they afraid of internal marking,,,, What should then Student do ? what should student do when that teacher target two or three student to give lession to others.
    Teachers also not very much right all the time,,, they do not even care studend copies, improvement.
    i have respect for teachers but not those who become competitive with students .

    Children are innocent. They are the future of any nation and the world. Beating the children even if it is for their good demoralises them with spiritual harassment. A teacher should be able to make the students understand why the way he is using is not good and what is the best way to do it. But usually it is found that teachers themselves do not know why is that not good and what the best way. It is been researched that those children who undergo such situations are not able to cope up with the external world as they lack in confidence and do not know how to do it. Such situations kill their creativity and clear thinking. Teachers need to change their approach because they are old enough to understand this, and change themselves accordingly. But Children take it as a practical lesson to behave with others. This is the reason we rank below in mannerisms in the world. Why only teachers should be given respect, everybody needs to earn it, irrespective of the profession, age ,cast or colour. Its a give and take relationship. Teacher whose basic duty is to teach students, should set an example by their own behaviour. I know it is very difficult to be like that because even those teachers must have gone through same behaviour by their teachers or the people around them. In these cases such teachers should be retrained and made understand how this behaviour is not good.Punishments to such teachers can bring this behaviour down and can bring better tomorrow.

    Glad to see corporal punishment in schools is being addressed in the legislature. In this day and age, there is no room for any form of student abuse - be it physical or mental. Teaching is an art as much as it is a profession. It is not enough to have a degree/diploma and teaching credentials to be an effective teacher. Teaching is a fine art in transferring knowledge by capturing students undivided attention. I was very fortunate to have had some of the best teachers during my school and college days.

    teachers are haunting me today I was afraid to go to school. The jail terms must vary according to the seriousness of the teacher's cruelty. I do agree with
    JAIMINI P.B.' proposal. Before appointing to the teaching profession, there must be a character evaluation of every teacher. Now, it is done simply looking at their diploma or degree, also based on the bribery offered to the school officials. So, any rowdy can became a teacher

    Beating students humiliates them and leaves a scar of hurt for life.I was in 7th grade and this teacher lady who was suffering from blood pressure beat me up.It was not normal.My class had 48 students and in each students name i was given 2 beating on both hands and back.I was bleeding and piece of can even got stuck into my flesh, even then this merciless teacher never stopped ! Even now when i think of this incidents my eyes fill with tears.I have forgiven her, but the memory still haunts me!Please correct a child with love as much as possible. My fault at school was i did not know the answer for the homework.

    Teachers can only discipline by their words not needs like beating.. I had few teachers who never beat or shouted at children, but they commanded discipline. I wish all teachers were like that. Beating is not acceptable. We send our kids to be educated and taught good things, If they have complaints they should send word to their parents not directly attack them. There are many horrible teachers around. I was slapped by our PT sir(Alwyn) at cascia high school in 1992-93. I was the class leader! and was given the job of "minding" the class and writing names of noise makers on board. I did not write any names though they made noise. Hence I was slapped in front of whole class. I was first rank student. This is harassment. I was a good student(may not have leadership qualities).

    The purpose of punishment is to stop a child from doing what you don't want - and using a painful or unpleasant method to stop him. There are basically four kinds of punishments:
    1. Physical punishment - slapping, spanking, switching, paddling, and using a duster or rural-scale
    2. Verbal punishment - shaming, ridiculing, using cruel words, saying "I don't love you"
    3. Withholding rewards - "You can't go for Games, during games period, if you don't do your homework"
    4. Penalties - "You broke the window so you will have to pay for it with money for repair"
    In the modern days, the first two kinds of punishment, physical and verbal, are not considered to be effective discipline methods. The other two, withholding rewards and giving penalties, can be used either as effective discipline methods or as punishment - depending on how Parents/Teachers administer them in their PTA meetings.
    A swat on the bottom or hand is a mild physical punishment. While it may do no permanent physical harm and it does not help the child develop a conscience? Instead, it teaches him that physical violence is an acceptable way of dealing with problems. Parents/Teachers should avoid physical punishment. If they find themselves using it, then something is wrong and their method of discipline is not working. They may as well admit that spanking is more effective in relieving their frustration than in teaching the child self-control. More effective methods are needed.
    Harsh physical punishment and verbal abuse can never be justified as ways to discipline children. Parents/Teachers usually spank when they are angry they may not realize how hard he is striking the child. Verbal abuse hurts the child's self concept.
    Physical punishment usually doesn't work for several reasons.
    It makes the child hate self and others.
    Physical punishment makes the child think that there must be something awfully wrong with him to be treated so badly. If children think they are bad, then they will act badly.

    Partiality....Ok will tell the government to amend the Law and make 10 years jail to the teachers :) It was there even our times, specially by nuns that is reason I hate nuns today.

    Caning is important though but should be mild just to frighten the kids...not to scar them. Adikol (footruler)is not painful as nagarabetta. When we were kids our teachers in Convent School used to lift our skirts and hit and we wouldn't dare to complain it to our parents because in return we would get heavy pastings from Mom for getting the compalint from the school.

    These days kids, you cannot even tap them...it becomes an issue and goes to the Principal. Teacher is like a Mom, who can correct and mould children in the school. You need a good mentor to be a good citizen.

    I have experienced that....beating,harassing and teachers being rude will make most of the students less confident or i would say they will have lack of self confidence.
    To be a teacher you should be patient,understanding and wise.It is going to be implementing in our country now,but look at the developed country's, they have been practicing this rule for the decades....This would really help the student in her/his personal development.Parents are also teachers,they can play a better role in their child's development.

    How many of us realize that by beating children, you are only teaching them how to be violent?

    When elders beat children, you subconciously drive down the point that violence is legitimized.

    No wonder you see so much violence on the street.

    A teacher can lead his/her students with fear or charisma. Right now, teachers dont have patience. Yes, they are human, but so are the kids.

    Without a stick Students in a school will never be managed.to discipline it is must.Some extreeme cases which are very rare, surely there should be law. But it canntot be misused to take personal advantages.We parents send our childred to school. But we are not aware of the problems faced by our own teachers. Many schools have over number of students. I know some schools, each class student strength is 65 above. how the teacher will manage. Govermnent aided school teacher probation period is 3 years. That to get probation one has to work 3 to 4 years temporory ie just for 3000/-. Now a days beacuse of less payments nobody opt teacher profession. This law may affect further. In Bible it is mentioned. one slap on child will not die, instead it will correct the child.

    Hey steve, Sharjah, think before you ink. No law/rule benefits all people. What matters is majority! Western countries made these laws to protect their citizens. Living in under developing, it is easy to comment on western contries. But when you practically I bet my last dollar for this law. Kids are not animals! you do not need to beat them to study. There are many more better ways to educate them, only matters is what approach you take. Beating is definetly not the approach.

    It is in a way good and bad.
    Yes! There are some teachers who ill treat their students... we are also victims of such cases... in high school one of our teacher used to beat us with the duster (wooden) that too not on palm! Just imagine, a grownup guy beating children with all might! Even once our principal intervened him!

    Therefore, there should be a law, not a blind one which pupil shall misuse, but something which will prevent abuse!

    Teachers play a vital part in moulding an individual. If you look at the current curriculum, the moral science subject is missing. I am sure that we thank our teachers for our current success and position due to the early childhood learnings.
    Why should we bind them with legalities for a act done by a black sheep int he crowd? For each bad act, there are zillion good acts which are not highlighted.
    We should bring them on par with other vocations on the eunmeration front.

    No wonder very soon India will bring rules to Child Parent and punishment. This is what the west & Europe has done and the result we all know. The very meaning of Parent and family is vanishing In fact, I stop studying just because of the teacher who bate me very badly and it was a grievous hurt till now.

    Teachers please do your work and go home.Dont take extra stress about the students.Let the students study or notstudy it is none of ur business.Instead of staying in prison u teach just for formalities.If the child fails,u need not go to prison.if you beat the child and if the child excels u will be prison.Teachers please dont spoil ur family life by taking stress of your students.if students earn they will not give you.They will give to parents.At least you need not go to prison.

    Good move by the government.
    When I was in school, teachers were a law unto themselves. Frustrated to the hilt, they would vent it out on the students.
    I remember a teacher . She was probably 4ft 9, and she carried a cane longer than her.If this rule was implemented then, I can only imagine, there would be no teachers left.
    There are other ways to punish children, without laying a finger on them. But I guess, with a stone age mentality, it will never be implemented.

    With all the fear, ethical, societal religious up bringing, our attitudes and culture is so bad. Imagine the state of affairs to come, with all the wrong priorities...I don't think a teacher would beat unreasonably.

    What! Punishment to teacher if he or she beat pupil? Where this decision will lead us to?
    We too were human beings when we were kids. we received lot of beatings in school or at home for our mis behaviour. We might thought we won't go to school because there were teachers who beat at school age. But one thing certain, i still think i am whom today just because of my teachers and parents who teaches you in a good method to behave and gives beating if you do the same mistake again. These are part of school life. Law should not take this enjoyment from budding children. Just remember folks, a beautiful stone statue can not be bone without hitting with hammer and carve it.

    It doesn't make any sense that you put a teacher behind the bars for beating any student,the nature of punishment should vary depending on the hurt or mental trauma caused to a child. Its reasonable to be a little strict so that to keep the class under control on the other hand teachers should also know their limits...

    7 years jail is not a fair proposal, because sometimes there are false allegations which can be proved by manipulating evidences,the accused will get a false judgement. Instead a suspension on trial and barring their teaching profession on final judgement will be fair enough. After all teachers discipline the children to an extent for their own good. If this rule comes into action then there will be an upperhand with the students(spoilt brats) who dare to do all wrong always.

    I am against this new law of 7 years imprisonment for beating students.But if we analyse the things carefully,7 years imprisonment is not enough,it should be extended to life imprisonment.Some examples for you..
    1.Bangalore: Headmistress pierced 8 years old boy's eye with sharp pencil for not paying school fee.
    2.Two days back, boy was beaten in such a way that doctors had to put 8 stiches to his bleeding head.
    3.Teacher had thrown duster towards boy who did not do home work.It hit his right eye.

    when there are 100's of other important issues or penal codes to be amended in Indian law, all the Govt is doing is passing bills like these. Court cases for petty issues are dragging for years, people committing heinous crimes are getting bail easily & some not even getting booked, whereas people are rotting in jails or courts throughout their lives with cases such as alleged verbel against SC/ST etc. Delhi is rape capital of the world, but its no Big deal in India. Anti Corrpution Bill is just a time pass, Black money is to maintain the liquidity of European Union. People are dying of malnutrician & foodgrains are rotting in the warehouses of Maharastra & Punjab.There is a severe draught all over the country, Parliment is increasing incentives to MP's & MLA's. Farmers are committing sucide and Givt is Importing basic food stuffs from China and then blaming low GDP because we we bailed out Italy from crisis. What else law or bill can you expect our Govt to pass ???.
    There is a limit for something, all of us have grown taking doze of light canning from our parents or teachers otherwise there would have been more of Ladens & Kasabs in India. However there is sometimes some rare cases where the teachers cross the line whcih can be looked into case to case, but not prposing such a harsh law to one of the most respected profession of the time. First of there is a lack or derth of good teaching faculty especially in Govt schools and colleges, with this law now aspiring or practising teachers who has some good will motive to the society and who respect and carry on their duties may feel insecure and this may show in their behaviour and ultimatly this the performance of the studens. Even I as a student cursed my teachers to rott in Jail, but if I am if not usefull, atleast a responsible citizen fo the country without any harm to society, its because of those scale kisses on my palm at times.

    Govt Proposes 7 Years Jail for Teachers who Beat Students, is quite harsh. Instead to begin with they should be given warning and fined, for repeated offenses fine and suspend, and finally if offenses repeated, dismiss them from service. Even mental torture to children also should be punished, because teachers should care for children's overall well being, children should not be traumatized teachers intentions may be good but methods are not !

    On reading the article was astonished to read that a teacher would get 7 years jail for beating a child. Surely beating is not the way forward to discipline a child. However, such harsh punishments to teachers is not the answer, instead they should be fined heavily for this, and cases where the beating has been severe jail could be included as punishment. Whereas the punishment for crimes like rape, molestation are so lenient, that we have so many such crimes taking place everyday and so many children have been traumatized. The Govt should take a look at these laws and strengthen them.
