Tipu Varsity Row: No Provision for Minority University Under Law, says Rama Jois

Bangalore, Jan 19: As the verbal battle between BJP and Congress rages over central government's proposal to establish five universities across the country named after Tipu Sultan, including one at Srirangapattana, a retired judge has said that minorities have no Constitutional right to establish a university.

Justice Rama Jois, retired judge and member of Rajya Sabha has said that though minorities have the right to establish the education institutions, there cannot be universities meant specially for minorities.

"According to the Article 30 of the Indian Constitution, it is the fundamental right of minorities to establish, administer education institution of their choice. Language and religious minorities have the right to establish registered society, trust, education and private companies.

"Previously in the Aligarh Muslim University case between Aziz Basha and the central government, the Supreme Court ruled that once a university is established under the law, then it becomes the property of the state. No state is reserved for any one religion," said Ram Jois.

In 1981 to provide reservation to Muslims in Aligarh University, the AMU Act was amended. Later the Allahabad high court revoked the minority status and reaffirmed Supreme Court's previous verdict that AMU cannot be a minority institution. The Supreme Court, later, though it restored the tag of minority institution to AMU, restrained it from alloting 50 percent reservation to Muslims.

"According to law, language and religious minorities can establish educational institutions but the degree can be granted only by a recognized university. Hence in this sense, established universities are for all and special provision cannot be provided to Muslims. Discriminating in the name of religion is against the constitution," said Rama Jois.

    tippu was a arrogant, radical leader ,,.. i remember in 6th grade i was asked to name five indian freedom fighters and i named four o them and since my history was poor i named tippu sultan as the 5th, my teacher got offended and rejected tippu as freedom fighter... he was a mass killer history says it all.. never worked for the language kannada or never benefited anybody except himself and his ego... sad king... never will i except him nor as a king neighter as a revolutionary

    I really wonder why Congress has been so much backing the name of Tippu Sultan for the University. Unlike warriors like Rani Abbakka, Kitturu Chenamma,etc.who fought against British, Tippu had a very bad image of suppressing other religion. Christians & Hindus where his targets for conversion. In Srirangapatanna he had a cell where he tortoured his opponents basically Christians. He forcibly converted them in mass in places like malabar region in Kerala, Bhatkal, some parts of Coorg, etc. I think because of threat of Tippu, one of famous church in Mysore has its prayer hall underground. The scriptures written in his sword clearly shows his intentions & work.
    Such persons cannot be treated as a Secular or Patriotic or National Hero. Instead, they can use the name of people like Dr Abdul Kalam, which will suite much better & will set a role model to people.

    Dear brother and sister if it will be TIPI SULTAN UNIVERSITY think after passing from this university student cannot get job abroad ( Specially in western nation ) or even in INDIA choice is yours ??????????     'In the 21st Century, in a democracy which wants to develop a composite culture with diversity, in liberty, equality and fraternity, it is wrong to create universities or places of learning (whether PPP or any P) and reserve them for specific religious groups under the cover of minorities . The provision on Constitution’s “Article 31 rights to minorities to start educational institutions” has to be harmonized with the secular requirement – the directive principle of the constitution. . The provision should not be exploited, by one group for that would mean preference. If a particular group needs to be given greater opportunity to education then seats for them should be provided in existing universities by expansion. This will ensure that the groups are not isolated and help unity and composite culture to evolve and flourish. Even if capacity is to be increased, new universities can be made in the normal course for all of citizens and the affected group accommodated fully through approved standard reservation norms. Such norms cannot be 50% to religious groups As to the name, the justification that he allowed his sons to be hostage and fought the British cannot be taken as his passion or patriotism for an India with equal rights for all socio religious groups, especially when you factor his actions and the aim and result of such actions in what now is Kerala in the justification logic . As a matter of fact logically, and respectfully, with due consideration of his skills, Tipu's name can be attached only to a war skill school or war skill college NOT to a university or Vishwa Vidyalaya The right thing would be to create a Tipu regiment and head quarter it in Pattana along with a Tipu school of arms . That would perpetuate his famous skill for long time. As to religion , if any university has to teach that it can be only “Comparitive Religions” and not any single one the if secularness in constitution has to be inculcated.In future, new institutions should be named only by REGISTER NOS- like University 1, 2, 3 etc Basically it is important to adopt healthy principles of social justice while creating additional capacity and allocation

    Tippu also doubted Christians IN THIS WAY and mascaraed thousands of Christians, alive were those who fled to Jungles for survival.
    Literally displaced everyone!
    Be sensitive enough to understand! Nobody is blaming present generation for Tippu's atrocities on Christians!
    Forgiving and forgetting is different issue, but sufferers can not glorify Tippu!
    Why should we oppose Tippu if he had fought British ?
    So many fought British, like Subhash Chandra Boss, Shaheed Bhagat Singh, is anybody speaks against them?
    We adore our warriors like any other Indians.
    Most part of the world has fought the British and won freedom !

    Tipu Sultan, no doubt a great king & warrior. His name against any Indian Defence Regiment or Defence college suits well. University names like Manasa Gangothri (Mysore), Mangala Gangothri (Mangalore), Karnataka University (Dharwad) gives no controversy. Technical university is in the name of Dr. Visvesvaraya, recognised as an engineer (technical). If we need a Muslim name for a general university go for Dr. APJ Abdul Kalam, who is one of the great educationalist.

    Yes indeed by your comments do you want us to beleive that he was a true muslim .and he took moral guidance and justification before killing people from other religions and marrying off their wives to his soldiers forcibly..???go to srirangapatna and you will get the evidence.and killings he did..History is written by historians who are learned people.It is based on facts
    and to deny these facts is like Irans Ahmedinijad denying holocost of jews..Tippu Sultan was a good fighter...thats it..Education..Tolerance.. with his name..no ..no.. it does not match at all....

    Why these politicians are now bent on naming an university after Tipu Sultan? On what basis ‎should the university be named after him? According to history Tipu Sultan was a brave warrior ‎who fought the British for his own survival. He was neither a learned man nor an intellect. He was ‎a fanatic known more for gruesome religious persecutions and war atrocities. If universities need ‎to be named after historical figures, then they should rather be named after benevolent emperors ‎like Akbar and Ashoka, who patronized learning, practised tolerance, non-violence and cared for ‎the common people.‎

    If Rehaman Khan/others are so respectful to Tippu Sultan,I wonder why none has kept their childrens name after Tippu Sultan.It is immperative that no muslim in India is interested in nameing their beloved ones after Tippu because is was not a good person.We should complement for muslims for this.
    Now,to put an end to this University naming raw,I suggest that proposed university should be named after the great seer late Sri Balagangadharanath the mesaiah of down troden and helped lakhs of poor failies/youth to have education and come up in life.He is the person respected by masses and it is Karnataka's duty to dedicate him a worth memorial.I wish all people irrespective of political affiliations should perceive and support this matter for fulfilment of the project.

    One must go the the root of the issue before coming to a verdict. Tippu Sultan is a great hero to most Muslims in this country, he followed the hadits and used the holy koran as justification to fight the enemies of Islam. He followed the guidance great shoora led by the enigmatic Mullah Nasruddin Battyboyi. There are many concocted stories planted in the media that Tippu was a tyrant and that he massacred a lot of christians,yahoods and Hanoods, this is not true,Islam is the religion of peace and a true muslim cannot perform such acts without moral justification or sanction from the great shoora. Tippu was also known as the Loin of Mysooru, he commanded a great deal of respect amongst his peers like General Reginald Dyer, Polpot, Chairman Mao, AAK Niazi, Rev Ripper Chandran etc. It is not for nothing that these worthies have categorically stated that Tippu was an inspiration to them. Tippu during his period of declining power had even requested the great liberator and secular leader Ahmed Shah Abdali to join forces with him to liberate the nation from the evil forces of the East India Company and the communal Marathas who were the defacto rulers of Delhi at that time. This is a shining example of secularism that should not be lost on the youth of today, the above can be equated to Abdul Nasser Madhani asking for the help of Akbaruddin Owaisi for the sake of secularism. University or No university, the muslims of this country can always bank on the UPA government to subsidize their education at Binori or Muridke

    " The Lion of Mysore" is the freedom fighter with" Father of Nation" Mohandas karam Chand Gandhiji , Moulana Abul Kalam Azad and other National freedom fighter hero's. These hero's fought against British and brings the freedom to us. Now we are only commenting against communities.     I am not sure about the law. But if they want to establish a university for Muslims they better find a name better than Tippu. Tippu was a tyrant. He treated brutally Mangalore Christians, Nairs of Kerala and so many others.

    dont go through tv serials to show he was a good ruler, no doubt he fought british for personal gains he commited great attrocities on his own people not even excluding his minister pandit purniya and his family tv series is only a fiction which is mentioned at the beging of broadcast and the stories are not true as per the editor of tuppu sultan series, pls read tippus biograpy to know the real person , he was never a moral ruler a citizen would expect, what point in naming univ. in his name.

State cannot bend extremely to favour any religion as the University meant only for particular religion. If done so many may follow the suit. Educational institutions if established or run by religious leaders ok, but not the case as this, Universities for only one religion. Nation first religion next. Jai Hind.

    I totally agree with Justice Rama Jois on the issue that educational institutions can be established by any Sect but its benefit should be for all. Also it is unfortunate that a controversial name like Tipu Sultan has been chosen when there are end number of personalities from Indian minority community who are respected and revered by all.

    Justice,Ex Governor,RAMA JOIS is a BJP RS member and he has to bat for BJP As far as Tippu Sultan University concerned,first they (RSS)opposed for the name of TIPPU SULTAN now they are digging for loopholes/provisions in the law.After all, in India all universities are granting degrees not any religion or community.What about DEEMED UNIVERSITY run by minorities?Is it not written in the constitution?BJP making this issue to polarize the vote bank politics and after some time the issue will backfire them.On the other hand BJP minister Raju Gowda favoured Tippu's while criticizing BJP council member GO-MASODHAN!!!!It is a Central Govt provision and State Govt only making blah blah..
