Child panel chief against death for juvenile rape accused


New Delhi, Feb 7 (IANS): India's child rights panel chief Shanta Sinha Thursday said she was not in favour of the death sentence being demanded for the juvenile accused in the Delhi gang-rape or for a change in the law.

The National Commission for Protection of Child Rights (NCPCR) chairperson also said she was against changing the juvenile law in the wake of the alleged brutality exhibited by the accused.

"I totally disagree on death sentence demanded for the juvenile… They have to be treated like juveniles and tried according to the Juvenile Justice Act," she told reporters on the sidelines of an event here.

Asked if the Class 3 certificate shown as proof for the juvenile's age was enough, she said: "When there is no universal birth registration in our country, we have to depend on this."

The juvenile, who is alleged to have been the most brutal of the six rapists in the Dec 16 rape, is reported to be six months short of 18 years.

To a question if changes should be incorporated in the Juvenile Justice Act keeping in mind the brutality of the juvenile's act, Sinha said: "No, this case cannot be the basis for any change in law."

She also said she was ready to meet the victim of the Suryanelli gang-rape case in Kerala, which has created a storm in the state after the Supreme Court ordered a retrial of the case in the Kerala High Court.

The 1996 gang-rape case has come into focus again with the woman claiming that among those who exploited her was P.J. Kurien, deputy chairman of the Rajya Sabha.

However, Sinha said she was not in favour of reopening the case.

    If you ask rapist what punishment they should get, then obviously they would say that set me free. So asking child activists if they want to change juvenile law is the same thing. Juvenile law kind of thing is what child activists are using to show their presence in the society, they dont care of children before they commit crime, but they will be first to protect the child when they become criminal. Why we should ask child activists to amend juvenile law, where is common sense of these people gone?? why they don't care of human right of victim at all?? Shameless aspect of useless professional child activist group in India. Juvenile law should be renamed to "No 18 criminal protection law ".

    Its a Joke. A child rapes brutally. The defination of child ( less than 18 years ) itself is a 'comedy of errors ' as 12 year old boy or girl can be adult in todays standards. It will warrant more crimes in Juveniles as they now know noose is not reachable . Prepare yourself for 'CHILDS PLAY ' part 6 ( i bet this is more barbaric )

    Mr. Pradeep, Allen, Krishna Kant, Gerald, Luca don't be too emotional. I bow down before your emotions before rape victim. Here the point is to be noted is to go by the Juvenile Justic Act as reiterated by Shanta Sinha is right and a Juvenile is a Juvenile. He can't be treated or penalized just as above 18. Think Logical and he has to be put in Remand Home and guided since the crime is committed by a child who is under 18 years. Were you expecting the Death Penalty for this under 18 years boy..???!!! Noways...

    If the juvenile did not act as juvenile during the incident then why he should be treated as juvenile.Hang him to death.If not tomorrow all juvenilles will do the same.

    The juvenile has to be treated like a juvenile if he behaves like a juvenile.If he has behaved like a major , he should be liable for the punishment that of a major.If he is exempted from this punishment tomorrow he will not hesitate to rape his protector Shantha Sinha.

    If the victim was related to Shanta Sinha, I don't think she would have opined the same. The rapist deserves death or life imprisonement withour parole.

    If any rapists,murderer who is below 18 years is left without any capital punishment as he is juvenile then all below 18 will commit offence repeatedly because they think they are juvenile and there is no law to give punishment or can be tried in any other court. If any boy or girl commit offence and it is proved then their punishment should start after attaining the age of 18 years and till then they should be kept in juvenile house or remand house. Offence is offence and there should be punishment for that. A child even during childhood get punishment from their parents or from teachers...
