Hinduism no religion, Shiva a 'superpower', says IT tribunal


Mumbai, Mar 16 (PTI): Outlandish it may appear but an Income Tax Tribunal in Maharashtra has held that Hinduism is not a religion and Shiva, Hanuman or Goddess Durga are regarded as "superpowers of the universe" and do not represent a particular religion.

The Income Tax Appellate Tribunal, Nagpur, in a recent order, said the expenses on worshipping Hindu deities and maintenance of temple could not be considered as religious activity.

"Technically, Hinduism is neither a religion nor Hindus form a religious community. Therefore, expenses incurred for worshipping Shiva, Hanuman or Durga and for maintenance of temples cannot be regarded to be for religious purposes. They are merely regarded to be the superpower of the universe," it said.

The order by accountant-member P K Bansal and judicial member DT Garasia came on an appeal filed by 'Shiv Mandir Devsthan Panch Committee Sanstan' against an order of Income Tax Commissioner of Nagpur, who had denied the trust an exemption on the ground that more than 5 per cent of its expenses had been on religious activities, thus rendering it ineligible for such concession.

The case pertains to expenses incurred by the trust in 2008 and the tax benefit sought under Section 80G(5)(vi) of the Income Tax Act, 1961 which says "charitable purpose" does not include a purpose which is of a "religious nature".


The CIT took the view that the expenses for building maintenance, offering free food and festival prayers as also daily expenses, and those for imparting tailoring and yoga training, and free distribution of opticals, totalling Rs 82,977 were religious in nature and expenses of only Rs 6,700 were for non-religious objectives, the ITAT order said.

However, the Sanstan said the temple run by it was open to everyone, irrespective of caste and creed and that "the temple does not belong to a particular religion. Installing idols is not a religious activity".

The trust claimed that maintenance expenses incurred on the building was a charitable and not religious activity.

"The I-T commissioner must be aware that Hindus are a number of communities having different gods who are being worshipped differently, with different rituals and follow ethical codes. Even worship of god is not essential for a person who has adopted Hinduism as a way of life," the ITAT said.

In the instant case, the ITAT order said, since nothing had been brought by IT authorities to prove that the activity carried out by the trust was religious in nature, the onus now lay with the Revenue Department to prove that the assessee trust was "wholly or substantially for religious purpose.

    One should not get sentimental on this comment. IT tribunal is proving its yard stick on relevant taxation rules. Tomorrow this is applicable to any worshipping places in India. The appeal can be sought in this regard.

    In our Sickular Democracy can these IT tribunal or anyone dare to make such statement or somethign near against any other religion other than Hinduism ???? There will be riot then. Its easy for these people under congress to give such statements due to tolerence by the majority, like a "temple bell", anybody comes, hits it and gets away with it & then preach pseudo sickularisem & say others are insecure in India.

    Lets not get political on the issue Shetre..! If you go through Bhagavadgeetha, narrated by Lord Krishna to Arjuna, you will understand that hinduism is not a religion. If you hold it as a religion it would be to belittle your faith.Nishkama Karma is the basis for human evolution in faith to achieve Mukthi or Moksha...?
    Even Christianity is not a religion, so to speak, even though the structural hierarchy gives such a image, just as Hinduism. Christ taught Nishkama Karma in a different way, Love God and Love your nieghbour..thats the whole law, He said to his disciples.
    If you delve into any faith, the Wisdom of any faith, ultimately rests on Human dependance on Supreme Power of the Universe, the Creator of all things.
    Real Secularism can begin at that point, in knowing we are all pilgrims on earth, finding our way towards eternity of bliss, in the presence of a Glorious God, singing his praises.
    Suffice to say, from Sankalakariya to Mundkur, there is not just one road, you can take any path, as long as destination is a fixed place. Namaskara Shetre..!

But I would appreciate if you could address it to Dear Jossey too, else it shows you like the sentence reading “Gadkari, Sushma, Reddy and Yeddy” but not the sentence reading “Sonia, Rahul, Vodra, Jaiswal, Sibal, Khurshid, Diggi, etc” Off course there are many ways to reach your destination but to reach destination through back door is not at all welcomed too. There is proverb in our religion that “Guest will always enter the house through main door but person who enter the house through back door is not a Guest at all”

    Although IT dept. has vested interst in this matter - Worshipping the superpower should apply to all the religions. Keep the doors of temple church, mosque, temple, gurudwaras open for everybody without any restriction.
    This automatically stop all kinds of forcible conversion, religious bigotry and fanaticism
