Mangalore: Tanker tragedy - DC talks tough, warns of action against HPCL

Mangalore, Apr 10: Taking HPCL company officials to task for the ghastly tanker accident at Perne, Bantwal that claimed eight lives, injured four and caused heavy damage to propety, deputy commissioner Harsh Gupta on Wednesday April 10 warned that the company will be held responsible for the accident as per the provisions under law.

Not satisfied by the response of the company to the accident, the DC came down hard on HPCL and said that oil companies transporting gas in tankers without taking any responsibility is unpardonable. "I will not allow any scope for violation of law in this case," he asserted.

Addressing a meeting with officials of oil marketing companies and district officials in this regard at his office, Gupta told the HPCL company representatives that the administration will not hesistate to hold the company responsible for the tragedy.

"Oil marketing companies have failed to take responsibility for the tragedy and have played with lives of innocent people. The police department will take strict action in the matter," he said.

Stressing on the role of the RTO, he said, "The officials of transport department must stop each and every tanker and ensure that there are two drivers and a cleaner, and also check all the relevant documents. If there is any discrepancy or violation of rules, the tanker must be seized. The drivers should not be allowed to cross the speed limit at any cost." 

He also addressed the officials of National Highway Authority and asked them their opinion on the measures that can be taken to alleviate the dangers posed by the steep turns on the highway. The tanker accident on Tuesday had occured while the driver was negotiating a turning.

Gupta also obtained details from the tahsildar about the estimated damage caused by the accident and assured that all efforts will be made to compensate the kin of the victims appropriately. He also instructed setting up of a fire station at Uppinangady.

He also directed the officials of factories and boilers to contact the chief controller of explosives and know about the guidelines and laws pertaining to the transport of inflammable materials.

Expressing lament over the fact that even in this era of technology such companies had failed to install GPS in their vehicles, he said that with the help of technology the occurence of such accidents could be curbed. "The company's off-site emergency plan was not implemented properly. SOP (Standard Operating Procedure) was not observed.

"The manner in which HPCL being a public sector company responded to the accident is unfortunate," he said.

Superintendent of police Abhishek Goyal gave his inputs on the accident and steps that could prevent such accidents in the future. District chief fire officer Varadraj brought to the notice of the DC the irresponsible conduct of the company after the accident.

The DC gave a deadline of 48 hours to the HPCL officials to respond to all the questions raised by him in the meeting.

Representatives of BPCL, IOC, and MRPL officials, ADC Dayanand K A, MCC commissioner Dr Harish Kumar, and DCP Mutturaya were preesnt.

    Dear DC,
    The need of the hour is to revive the whole proceedure related to LPG transport by Road. I am not astonished, if it is found that there is no formal proceedures at all.
    We are in 21st Century . Our thoughts and applications should reflect the modern techniques not medieval ones.
    So start with scientific approach, free from political clots. Thats what is expected out from a administrator.

    I was involved in a similar accident which lead to multiple fractures on my left leg. Was travelling by Durgamba bus from Mangalore to Bangalore on Jan 10, 2011. At around 2 AM, bus went off the road and rammed into a huge tree. I was unconscious for couple of hours and then woke up at Hassan hospital with both the bones on left leg broken and multiple gashes and glass pieces into my scalp and bruises. My uncle,brother and friends brought me to Mangalore hospital in the evening and was in ICU for 10 days. Multiple surgeries were performed.
    Resumed walking and my life after 4 months of recovery!!!

    Now, 2 years after the accident i am left with 15% disability and two metal implants and huge swell on my left leg.

    Insurance claim case is ongoing in Mangalore court against Durgamba bus company insurance, liable for my injuries.

    Cause of the accident: A oncoming truck on the wrong side made the bus driver swerve the bus away from the road. This is described in the FIR.
    Now this cannot be independently verified as driver and cleaner were the only witness. It was alleged that the driver drove under influence of alcohol!!!

    I hold following agencies responsible:
    National & State Highway authority: for not ensuring good roads and eliminating blocks/trees beside the road surface.

    RTO and Traffic/Highway police: For not enforcing stringent regulation and policing to fine and suspend licenses of drunk and errant bus
    and truck drivers.

    And finally Bus and Truck Companies: For not ensuring safe transport for passenger and motorists on the road. They should not be hiring incompetent drivers.

    Now, Durgamba bus company has since got the bus repaired and has been plying the route again. I was told that rash driving continues unabated.

    Lot of parallels can be drawn from what i went through and what is ongoing.

    Hope to see a result oriented plan and action from all responsible agencies to avoid such mishaps.

    Blame game will not alleviate the situation.

    whatever said and done, MRPL and other oil industries are curse to Mangalore. Just look back and see, how many lives were lost at whose cost? How much fertile land was swallowed?     This is an eye opener. DC has convened a meeting and promised action. Good. But now its left to the Media and Public to pursue the issue. Every alert citizen can report any deviation to the media nd Media can report it. There is tremendous lacunae in safety issues and therefore enforcement is the need of the hour. Every politician is silent ! Excellent reporting by Daiji and tremendous reponse by Daiji readers, Jossey, Shah nawaz, Ismail Perinje, Kamath, Pujari, Shetty, Nayak, Ranjan, Bollu, Desi, Videsi, Ajay, Ronlad, DSouza, Henry, Edward, Thomas, Jacob, Shekar, etc. Guys keep it up. Suggestion to Daiji.. please start a column for readers to report issues important to Public. Readers can send pictures etc with brief report of such issues violations etc. Also start a Daiji Foundation (NGO) to help the victims whether accident or calamity. Daiji readers will contribute. We need ambulances urgently Daiji can collect a target of 10 lacs and donate ambulances. Another initiative could be Daiji Safety inititive from Home to work and back !     Tough action is important at this point of time,but the Indian law and judiciary will take years together to bring out the judgement by then who knows who will be alive or not in this world.Such a tragedy was the Air India express accident a few years ago and how many of them has got the compensation so far?????.This hot arguments by the DC will be there for a few days till the public forget thinking the DC will take strict actions or the DC WILL BE TRANSFERED with in no time by the influence of the HPCL in high political level understanding of hefty money for the party election expenses....JAI BHARATH MATHA KI JAI....

    So it seems. The DC has spilt the beans. Right from HPCL, the RTO, the drivers, the tankers owners, the highway played a important role in destroying lives and families.
    The same thing was told by all the readers as well. How long will the system turn a blind eye.
    Dear Mr. DC Sir, your initiatives are most welcome and need of the hour. But at the same time, please ensure that these rules you have just announced will be implemented asap before it bites the dust and before you get transferred for doing good for the society.

    To avoid such incidents, training and awareness are very important.
    1. Trucks should operated by TWO drivers and both should be officially registered in the pay roll or name should be d in official documents /letter. Else there will be miss use of law. Driver must be with IMDG training cert. Normal license holder not allowed to drive. Speed limit to be follow strictly.City entry not allowed parking near fuel station/residency/school/hospital or any publice place city area prohibited. Each vehicles parking distance as per IMDG regulation.Group parking not permitted. But these are common in our Mangalore city. These are few points just placed in front of you friends.

    Appreciated for this decision. Please launch the same to all motorist specially heavy vehicles which are speeding more than the limit.
    Like Saudi Arabia taken steps of radar control system and special police monitoring on a private vehicle. Also they have made a seperate lane for the heavy vehicles.
    Please use heavy penalty for the violators. There is no speed camera's at all in high ways in India.

You may get your transfer order soon, but same time you might be leaving your foot mark on DC Office Premises so that whoever comes next will follow the same principle

    Thanks for the stern action and warning against HPCL by DC. However it can be noted that, HPCL may not be responsible for this incident, since the tankers are contracted as per agreement. However as a suggestion during award of contract the agreement need to be revised considering SAFETY as a priority and this needs to be implemented during every delivery schedule.
    Additionally if a move to install a LPG pipeline along the existing corridor from MRPL site to bottling plant at Bangalore will be beneficial. This may avoid such horrific accidents n future.

    There was a similiar accident at kannur in kerala where the news appeared on national tv & drastic steps where taken wherein the plying of gas tankers was stopped on road & alternative line of transport by the railways was proposed & implemented but in this case there was not much of importance given & moreover there was no response at all from the cheif minister whereas at the same time his kerala counterpart came down heavily both in the media & the assembly about the tragedy . Therefore i feel that this particular accident has been sidelined & therefore there has to be a larger support base & protest to stress the damage & lack of following standard safety protocols by the oil company which has to give the maximun compensation to the affected .

    All vehicles carrying HAZARDOUS materials should be fitted with ignition interlocks (system which measure a driver’s blood-alcohol content through fingertip sensors on the steering wheel or through ambient breath measurements.
    Volvo has implemented this technology……..

    Most of the existing law or guidelines in India are outdated and that followed the old British system, even they have changed it 10 times or every six month or 2 years. But our Indian system still follow the rotten and rusted regulation.

    All these Lorries which carry the cylinders on the highways has to be stopped and the cylinders has to be transported in the Railway track.. This will definitely reduce the accidents and moreover the traffic will be less on highways. Places like (near) Narahari Parvath, the roads get blocked because of these Gas Tankers. Some of the Tankers fly as of Express bus. I hope DC will look into these matters and try to implement the rule of transporting these cylinders in the railway track.

    Root cause for all such tragedies is the corruption in the Transport Authority/Department. Transport authorities should enforce transportation rules very strictly and the cops should police them.
    Just like in the US, such trucks carrying hazardous material should be banned from residential areas. Trucks carrying heavy loads should install speed jammers and tracked through GPS for any violations.
    Drivers should be well educated on implications on violating laws and the consequences to human life.
    I concur with the DC of Mangalore that unless the Company Authorities are not taken to task they will not learn the lessons.

    Talking tough is welcome! Now take tough action for luke warm response of HPCL!!! No GPS tracking, no emergency response from the HPCL is unfortunate. They need money without taking any responsibility! I'm Sure DC & Abhishek Goel will take them to task in order to avoid future tragedy!!!

    I once travelled from Mangalore to Bangalore in where the driver was piss drunk. I found this during a coffee break, I saw fellow driver and cleaner pleading the drunken driver to drive more while he highly intoxicated. Can we have randomn checks on bus drivers at night please.
