Mangalore air crash: HC stays proceedings against Air India

Bangalore, Jul 3 (DHNS): The High Court of Karnataka on Tuesday stayed the proceedings against Air India and its chief operating officer in a private complaint holding them responsible for the air crash at Mangalore airport on May 22, 2010.

812 Foundation, a non-governmental organisation, had filed a private complaint before the trial court after the investigation into the accident was closed.

The trial court took cognisance of the complaint stating that there was no action on the matter even after four months of complaint and considered it as a ‘deemed sanction’ by the Ministry of Civil Aviation for prosecution.

Counsel for the petitioners Gurudas Kannur, in his submission said that the respondent, (812 Foundation) filed a private complaint on March 6, 2012 after the entire matter and the investigation was closed.

“ Initially, the investigation proved that the accident was due to the error of pilot. Later, a Court of Inquiry was constituted on June 3, 2010 which also held that the pilots of the aircraft responsible for the crash.

“FIR was filed against Glusico, the pilot and Ahluwalia, the co-pilot. Charges against the co-pilot were dropped later.  The matter was closed as the pilot was dead and the Court of Inquiry did not find any negligence on part of the petitioners,” he explained to the Court.

The petitioners claimed that the Foundation had written to Ministry of Home Affairs seeking sanction for prosecuting the petitioners and the MHA had forwarded the request to Ministry of Civil Aviation.

The matter is under consideration. “Under such circumstances, the trial court without hearing the petitioners exceeded its jurisdiction and took cognisance of the complaint.  There is no such concept under The Aircraft Rules, 1937,” said Kannur. 

Justice K V Keshavanarayana, stayed the proceedings and has adjourned the matter.

    I am the lone fighter who put the criminal case against the officials. None of my family or friends died. I did it after i experienced how Air India roadrolled the poor victim families and how dangerous the mangalore airport was and another tragedy should be averted.
    sometimes, when i look back, I feel that the system is like this because we deserve this. Look at one person saying to 'move along' and another saying what if family or friends are involved. Today after I put up all this fight, people accuse me as being an agent of Calicut Airport!!!
    I have filed 2 petitions in the Supreme Court, one seeking Rs.5 Cr for each of the passenger who died and another to look at all critical airports including mangalore and calicut.
    I met some victim's family who had a single child and they were neither interested in the money nor the fight. I spent about Rs.15 lakh so far to put up this fight and prepare for this long battle. sometimes, i feel like giving up and asking myself, who am i fighting for, but the picture of the burned dead bodies refuse to move away from my mind.

    I want all the victims families to come together, I want all of them to put the fight together. I am not asking anyone for financial help, if anyone has means, they can chip in, but if we leave these people free, be sure there will be another tragedy. I just cannot stand injustice.

    The worse is when I heard that the air india lawyer was telling victim's families that as soon as they take compensation, they will marry again, and nobody reacted, all meekly giving in. I am sad. i wish someone complained to minority commission.

    It's a sad flight of the citizens of India and passengers who travel with Air India or Air India Express?

    Chris, Yes - Money was paid to some of the families. But not according to the APPLICABLE law for Air crash. Rather, AI tried to settle money according to Motor accident for some minimum compensation. All over the world, (including India)the Air crash accidents are subject to MONTREAL LAW and Airline Company is liable to settle the death compensation according to this law and not motor act.So most of the families protested this method of settlement and went to the court to seek justice for thier beloveds. Some of the poor families who lost their lone bread winner (and who have no surivors to fight for the justice) have accepted the final settlement from AI.So this is the TRUTH on this case. Someone filed a case in Kerala High Court, but after the veridict, this has been moved to Supreme court and there is no result yet. But the case has been kept postponing every month for one or the other reasons.
