President rejects mercy petitions of two rape and murder convicts

New Delhi/Belgaum, Aug 16: The President of India has turned down the application for clemency from two convicts from Karnataka for rape and murder of an eighteen year old girl. This was the last of the mercy petitions pending before the President, sources said.

The convicts Shivu and Jadeswamy, are lodged in Hindalga jail in Belgaum.

The application for clemency was reviewed by the President on Thursday August 15 after the Independence day celebrations.

The convicts belonging to Bhadrayyanahalli in Kollegal taluk had raped and murdered the eighteen year old girl on October 15, 2001.  The girl had bitten the hands of Shivu and Jadeswamy as a result of which the skin of their hands had peeled off.  The police had arrested the two on a complaint from the girl’s mother Chellamma.

The high court had awarded them death penalty in November 2005, after which they approached the Supreme Court. 

The Supreme Court in 2007 upheld the judgment of the high court. The home ministry in April this year had recommended the rejection of their mercy petition, following which two new mercy petitions were filed on Shivu's behalf. Subsequently, the case was sent to the President in June. Mukherjee rejected the petition after consultation with the home ministry.

In April this year, the President had rejected the mercy plea of another Hindalga inmate, Praveen Kumar from Puttur, who was convicted for killing four members of a family in February 1994.

    @Allen, I agree with your views!! Giving a death sentence is only in the rarest of rare cases!!! Research has proved that there is absolutely no in crime rate even in autocratic countries who practice ruthless and barbaric punishments, hence many developed countries have abolished capital punishment!!

    We should know first that in a country like ours most of the people languishing in jails and going to gallows are the innocents who are implicated, whereas the perpetrators, rich and powerful are roaming free!!!

    The biggest human right violation occurs in countries from where these people say: hang him, stone him, castrate him!! But it is all suppressed, and only the positives are highlighted as the media too is controlled by the rulers!!

    I don't dispute that the people refused mercy were guilty. But looking at some comments, it baffles me how sometime back we criticized Pakistan for punishing Christians solely on the basis of the false accusation of blasphemy by a jealous neighbor, while today when it comes to other crimes we suddenly become fans of Saudi's system and seek to replicate the same system of instant justice without burden of evidence or right to appeal.

    We believe we ALREADY know who is guilty and who is innocent (because the media told us so??) and we just want the courts to give a verdict we want to hear against the first person brought to trial for the crime. Even the most brutalized victim doesn't want the wrong person hanged, the burden of evidence and right to appeal assure that that doesn't happen.

    The improvements in conviction rate should come from modern forensic evidence that cannot be refuted by hostile witnesses, not by shortcuts. Else, tomorrow you and I may wake up to a jealous neighbor dragging us to court and being hanged the day after tomorrow!

    The decision of the President of India to turn down the application for clemency from two convicts for rape and murder was wrong.
    The death penalty is carried out in countries like Bangladesh, China, India, Singapore, US, etc.
    t should be natural that no country has the right to kill and the death penalty must be abolished all over the world.

    Article 2 of the Charter of Fundamental Rights of the European Union says "everyone has the right to life” and no one shall be condemned to the death penalty, or uted."

    These are wonderful words and that makes me too proud to be an European to live in the European Union and to know for certain that no one is sentenced to death.

    We must not forget the time from 1933 to 1945, millions of innocent Jews were murdered in concentration camps, gays and lesbians, gypsy, communists, Social democrats, even Catholic priests, nuns and monks and million of innocent people in various European countries were murdered by Nazis.

    And finally 1945 The Second World War ended and a new time started lots of European countries were free and democratic elections took place.

    I wished to mention the past to show how important it is to protect life in every form and therefore The EU holds the right to life as a fundamental right that no individual, group or government can put into question.

    The European Union consists of democratic countries with liberal constitutions, freedom of speech and press, an independent media and judiciary, the constitutions guarantee its citizens legal and liberal rights.

    There is no place any longer to sentence people to death.
    Indeed The EU has done a lot in advocating the abolition of the death penalty and by the end of the 60s all EU member states had abolished the death penalty in law.

    That was a tremendous progress life is protected and the death penalty cannot be applied.

    Even murderers and criminals must be treated with dignity and respect according to legal law. Everyone has the right for a fair trial and the Criminal Law is applied and murderers are sentenced to a lifelong term in prison.

    India as the largest democracy on earth should abolish the death penalty.

    Long pending mercy petitions be disposed of as early as possible. Our present President is taking prompt action to dispose the cases. President should take proper discretion and settle all the cases. Our President is doing a good job. Let him clear the cases fast and bring the pendency NIL

    It is a shame that the Judiciary of our country unlike other countries is most wierd, without a backbone! Criminals and convicts should be punished mercilessly without any delay so that it it will be an eye opener for others thereby bringing down the crime rate drastically. In my opinion, criminals who have been sentenced to death by the court should not be allowed the see the light of the next day. They should be hanged at once. But when will our idiotic laws ever change???

    It is too late to convict Praveen Kumar who killed four of his own family members at Vomanjur in 1994. If he had punished immediately in 1994 so many crimes could have avoided in 20 years.

The president requested Sushil Kumar Shinde, home minister, review the opinion of his predecessor, P. Chidambaram. On 10 December, Shinde indicated he would look at the file after the winter session of the Parliament was finished on 20 December.Shinde made his final recommendation to ute Gul on 23 January 2012.On 3 February 2013, Gul's mercy petition was rejected by the President of India."

    On 3 June 2012, President Pratibha Patil granted clemency to more than 30 prisoners on death row. She also delayed to take decisions during her period but our Pranab dada is prompt in taking deceision without any delay. Our Most of the Presidents were only busy in foreign trips.
