Delhi gang-rape: Friday the 13th judgment and lessons to learn

Sep 15: Considering that Friday the 13th is regarded as unlucky day by many countries of the world, it was ironic that a judge of the fast track court had reserved the decision on the quantum of punishment to the four Delhi gang rape victims. And lo, it proved to be the luckiest day for the entire nation which rejoiced in unison at the death sentence awarded to the four for the sheer barbarity of their act. It can be said that it was the first and only incident so far that touched the collective conscience of the sensible citizens of the country. The incident had proved to be a rallying point for the people of this country to take a united stand to vent out their aggravation and anguish denouncing the beastly and hair-raising behavior and demanding justice to the victim.

While many feel that by awarding death penalty justice has been done to the victim and her family and also the for the victim’s male friend, there are many who believe that death sentence is too less a punishment to these beasts. There were suggestions that they should have been castrated and allowed to languish in jail for the rest of their lives. While public opinion per se may not have a role to play in awarding punishment by the judge, people’s reaction is a pointer to the bottled up frustration and angst, condemning the incident for its very brutality and cruelty.

The families of the four convicts are naturally depressed and have said that the punishment was too harsh for them. They even said that the court verdict was due to pressure from people from across the country. They have also blamed the media for the death sentence. What was more shocking and even unbecoming was the reaction of the defence lawyer who termed the court verdict “as politically motivated”. It is true that the Delhi government had taken the Delhi rape case with the seriousness it deserves but the court judgment cannot termed as politically motivated. The judge in his verdict had clearly said that he has award death penalty to the convicts because he wanted to send a strong deterrent message so that people dare not commit such crimes on women.

While ours is a democracy where every person has the right to seek justice, a comment like the one given by defence lawyer A P Singh, neutralizes the very purpose of awarding death sentence to the perpetrators. All the six beasts had together behaved in such despicable and heinous manner which a civilized person would never do to another human being. They inflicted unfathomable cruelty and violence on a hapless girl that has no parallel in a civilized society and had showed no pity on her even when she pleaded with them repeatedly to spare her. They did not even express remorse for their act. And now they wanted the court to be lenient and the public to show mercy on them. What a pity!

I think the public had so much anger and frustration following the beastly act (it is an insult to equate their action to a beast because even beasts would not have behaved or acted like the way these six perverts and behaved). If these men were left scot-free the public would have lynched them by according a treatment similar to the one they had perpetrated on Jyothi Singh. It may take another month or so for the Delhi High Court to confirm the judgment and further delay can be expected in the execution of the judgment.

Even after the judgment there is dissatisfaction among the public because another perpetrator of the crime, the juvenile who was the most barbaric of the six, has escaped from the gallows due to the age factor. The juvenile was the most brutal of the six who were partners in crime and even now there is a feeling that the juvenile who was 17 at the time when he committed the crime and was convicted of rape and murder also deserved a death sentence. The teenager who had raped Jyothi Singh, brutalized by inserting iron rods in her private parts and had pulled out her intestine, cleaned up the bus and made tea after the dreadful act will walk a free man after spending another 28 months in an observatory home. Due to the brutality with which this juvenile had behaved, people have questioned the very adequacy of the Juvenile Justice Act (JJA) because he had committed an act similar and much more diabolical and brutal.

India being a signatory to the UN Convention on the Rights of the Child, had passed the JJ Act in 2000 and therefore has to enact a juvenile code wherein juvenile criminals are required to be tried under juvenile courts. The basic principle of Juvenile Justice is rehabilitation and not punishment and therefore this juvenile convict of the Delhi rape case has been sent to an observatory home. This leniency for juvenile criminals has its adverse impact in our country because juveniles who commit violent crimes on women have increased over the years. Though countries like US and UK are signatories to the UN Convention they have taken action to amend the laws after witnessing a rise in juvenile crimes. So when a juvenile above the age of 15 commits a serious crime the case automatically gets transferred to the adult court. This is what India has failed to achieve, sadly.

The leniency given to juveniles under JJ Act in India has led to a dangerous trend which is fast picking up. There are instances of terrorists and anti-social elements misusing the JJ Act especially in Kashmir and Kerala. In Karnataka too criminals and rowdies have deployed children below 18 years to pull off their crimes because of the lighter punishment involved to the perpetrators under JJ Act. This is indeed a dangerous trend and if left unchecked would have diabolical consequences for our country.

    I WANT THAT B*%TARD JUVENILE ALSO TO BE HANGED.THEN ONLY JUSTICE IS DONE TO THAT POOR GIRL. WHEN THE JUVENILE HAS THE CAPACITY TO RAPE & MURDER, THEN THERE IS NO QUESTION OF HIM BEING MINOR OR MAJOR. AFTER 3 YEARS HE WILL COME OUT AND AGAIN RAPE SOME INNOCENT. IF NOT THAT AT LEAST RELEASE HIS PHOTO, SO ALL THE PEOPLE WILL COME TO KNOW THIS GUY. Or else the best thing is the Govt should put BIG ADVERTISING HOARDINGS SHOWING HIS FACE. SO 1S HE COMES OUT OF JAIL, THEN HE WILL COMMIT SUICIDE WITH SHAME. I Know its not Possible... but try karne mein kya jata hai. MY ULTIMATUM IS JUSTICE... MINOR OR MAJOR...HE RAPED & MURDERED THAT POOR GIRL... THATS IT.

    This is a historical judgement and I salute the brave judge for his immense courage in delivering the very crucial Verdict. Thanks for his wisdom. Now all the convicts including the juvenile must die at earliest then only the victim will get eternal peace. Jai Ho Fast Track Court.

    Soul of Jyothi Singh will not rest in peace until the juvenile is burnt alive. That was her wish.The juvenile was the most brutal among the 6 partners of this beastly heinous crime.He may spend another 28 months in an observatory home,enjoying all the facilities provided to him which he could not afford in his house.But, once he is out , it is the public. The public, the people of Delhi, will give peace to the soul of the most unfortunate daughter of the nation,by burning the juvenile alive.MARK MY WORDS.

    Irony of this case is the guy who was most criminal minded who ed the iron rod turned out to be juvenile and he escaped with 3 years jail term. Rest of them got death sentence.
    How can you call him juvenile when he can go to such an extent. He should have been given death sentance and rest of them life imprisonment.
    Do you still believe this judgement is fine?? I do not think so.

    Nice article.Infact it is the right judgement.On practical grounds this kind of crime may repeat because in nation like Saudi Arabia rape convict will be beheaded but still rapes taking place but due to fear it is at reduced level.We need proper research in India to address this issue.What causes a person to behave in such a cruel way.My reference to various books and discussions of intelectuals conclude into main 3 issues.
    1.Person undergone neglect,dejection,cruelty,abuses during childhood prone to serious crimes.
    2.Person who witnessed voilence,sexual act,nudity at early age prone to commit sex crimes at higher rates.(Potential dwellings are the slums).They are deprived of basic living condition and education.
    3. present communication tools like mobile with access to hundreds of porn sites is a threat to young generation.Continuous viewing will trigger urge for sex.Once there is no moral sense within a person he will be tempted for immoral activity.
    Value of education is so great it will teach what are the human values,how to live without harming others.Basic human need is food,clothing,shelter and sex.Every desire to be fulfilled within the norms of the society.

    Well, as long as the option to plead against this verdict is open, I will not say 'Amen', at-least not until the culprits are actually hanged.

    Meanwhile, when the juvenile comes out of the remand home, I wish he voluntarily hangs himself as Ram Singh did !

    With the type of crime this juvenile committed, perhaps public will not spare him to live long. I don't think he will ever hang himself. If he really does, it is much better for him, than getting the punishment from the public. He does not have any moral right to live.

    Good article..Now my question is when these beasts will actually be hanged ? Next step High Court,then Supreme Court,after that President's apporval..finally death will be confirmed..Four rapists will stand in the queue..already 28 criminals have been waiting in the queue for more than 5 years !! After their ution only,Delhi rapists wll be hanged..My son turns 6 years old on 2nd OCT..Hope his son when he becomes 6 years old will get a chance to hear that Delhi rapists have been hanged..!

    And our jail authorities are treating these rapists as if their own brothers and sons.Juvenile rapist has been given cell with hindi newspaper and tv ! On Friday,13 he was watching Govinda's movie when judge announced death sentence to his friends..
    Tihar Jail officers have started counselling period to all 4 rapists immediately after death judgement.According to them,we don't want them to commit suicide like Ram Singh (rapist driver).My question is WHO CARES if they commit suicide..but it is still a million $ question..WHY COUNSELLING ?..In Kerala,police team kicked protester's private part repeatedly..Did protester rape or murder?..No..His mistake was "Holding Black Flag" to CM Omman Chandy...So what we have to learn from Police..Counselling & tv for rape..and brutal attack for silent black flag rally ?? HEY RAAAAMMM...!!

    The Juvenile should have been given the TTTT or permanent 'Buffalo Treatment' before sending him to an observatory home. What the heck
    'observation' for this chap? For his gruesome act his ..lls should be chiselled and chopped and kept
    in the observatory so that potential rapists shudder thinking
    about it....
    Whatever be the background does anybody do the act done by thee guys? Do you need education to tell you that it hurts when you poke rods into another's body?

    Nice article, keep it up Florine. Finally Justice has been delivered for the unimaginable, brutal, gruesome acts of these convicts on innocent girl. May her great soul rest in peace. It is true that these criminals are like animals and given the highest punishment. It is heartening to note poor living back ground of these convicts and I feel pity for their poor families. Considering many criminal cases either on women or otherwise, we have to question our self, whether this quick and drastic judgment can happen if criminals are of high profile status and having connections politically and judicially.

    Considering poor and uneducated background of convicts, I believe our social system failed proper education and living conditions. It is responsibility all of us to build fairer society to give the opportunity of good living conditions and good education to down trodden poor. We have to think about the root causes of the heinous crimes of these convicts and effective solutions for the whole society.
