Mangalore air crash: Court orders Air India to pay Rs 8 crore to pilot's family

Mangalore, Nov 4: More than three years since the tragic crash of Dubai-Mangalore Air India Express flight at Bajpe here, a labour court in Mumbai has directed the airline to pay a compensation of around Rs 8 crore to the family of Captain Zlatko Glusica, the aircraft's pilot who died in the crash.

The national carrier had contended that Glusica's family was not eligible for compensation as he was not an Indian national, however, the labour court dismissed the claim and ordered Air India 'to deposit 7.45 lac dollars (Rs 4.63 crore) as per the workmen compensation package, besides 50 percent of the compensation amount as penalty for delaying the payment, and 12 percent interest per annum on the compensation amount from the date of accident till the date of depositing the amount', the Bangalore Mirror reported.

The Bangalore Mirror in its report stated that Air India officials had ignored repeated requests from Glusica's family, based in Belgrade, for compensation, after which the family approached the labour court. The family stated that while the kin of other officers and crew members of the ill-fated flight had been compensated appropriately, the same was denied to them simply because Glusica was not an Indian.

As per rules, Air India was supposed to pay workmen compensation based on the pilot's age and salary. The 55-year-old Glusica was drawing a salary of 11,000 dollars a month, which meant he had to be paid 5,500 dollars (half of his salary) multiplied by 135.56 (a figure specified by the Workmen Compensation Act as per his age) as compensation. The government announced interim compensation of Rs 10 lac to the families of 158 persons who were killed in the crash, and Rs 2 lac to the eight who were injured, but no compensation was paid to Glusica's family, the Bangalore Mirror reported.

Capt Glusica was blamed for the crash by a government-appointed court of inquiry two years after the incident. The inquiry report had stated that the crash was caused by the pilot's failure to "discontinue an unstabilised approach and persisting with the landing".

The labour court while pronouncing the verdict pointed out that while the airline had compensated kin of other victims, it had ignored Glusica's family for 'reasons best known to them'.

Reacting to the verdict, Glusica's family said that the court had 'honoured the dignity of our lives' while Air India had been 'disrespectful to his family', the tabloid stated.

    I understand that the Copilot Mr. Aluwalia had asked the Captain to make a " go around ' but the Captain did not bother. He landed the aircraft half way through the runway. He created these deaths in Mangalore. He should be tried for murder in absentia.

    Are Indian lives cheap ? Haven't the Indian pax's families been paid much less than stipulated by the Montreal Convention ?

    its not that Indian lives are cheap, its that we do not put a value to it. if you check the net you would see that the 'reputation' of a retired supreme court judge was valued at 100 crores!!! The question is how much of a fight can a person put up to value a life. In Mangalore, I watched it so closely and I can assure you...it was a meek surrender to get the money quick, whatever it is. I can name people, but that doesn't help. The victim's families need to introspect. I even met families that never wanted the compensation and i tried to motivate them saying that they should at least stand up to ensure that no other parents lose their children and suffer a loss they had, but they said they were heartbroken. See air accidents worldwide you will see people form a formidable association, Mangalore never had one and will never have one, we are so selfish in nature.

    do not blame systems, it is we who make those systems.

    it is still not late if the victims' families decide to stand up and put up a fight....

    I AM THE ADVOCATE WHO TOOK UP THE MATTER OF THIS PILOT. i TOOK UP THE MATTER OF A PASSENGER WHO ALSO GOT A FEW CRORES. I HAVE SOUGHT 5 CRORE FOR EVERY PASSENGER AND THE MATTER IS PENDING IN THE SUPREME COURT. TO BE HONEST I HAVE TO TELL, THE VICTIM'S FAMILY WERE BUSY SETTLING THE AMOUNT QUICKEST, BUT NEVER WANTED TO STAND UP AND FIGHT FOR THEIR RIGHT. mY CASE IN SUPREME COURT IS NOT STRONG NOT BECAUSE IT IS NOT STRONG LEGALLY, BUT OTHER THN ONE VICTIM'S FAMILY NOBODY HAS SUPPORTED MY CASE. I FILED CRIMINAL CASE AGAINST THE BIG SHOTS IN AI, AAI & DGCA. NOT ONE MEMBER FROM THE VICTIMS FAMILY SUPPORTED THE CASE.

    I FORMED 812 FOUNDATION NOT ONE SUPPORTED. IF ANYONE OF YOU THINK PILOT IS AT FAULT, MAKE AN EFFORT TO KNOW THE REASON. IT IS AI & AAI THAT IS RESPONSIBLE FOR TAKING THE LIVES OF YOUR DEAR ONES.     The pilot/captain was at fault. Because of him 158 lives perished. Co-pilot warned Zlatco Glucica several times to abort attempt to land. But adamant rascal did not listen to him which has resulted in the big tragedy. There are pilots who do not have any family values and enjoy with girls in the night/day boose and doze while doing the work. This man was snoring for 110 minutes out of 180 minutes of journey. Rascal...he wiped out many families. His family should not have been paid even a single penny, come what may.

    Now we have Deepak Sathe who did the same at Kozhikode airport. Overshot the runway and 18 people are dead. One good thing he did is exhausted/dumped all fuel, and switched off the engines. I never understood why these Pilots are paid that kinda post-mortem compensation upon a crash.

    Hello Dear Lawmakers,

    What is amount paid to the families of the Victims, whose lives were lost in this tragedy. Is the Family of the Capt, who did not perform his duties, (just because is a Non Indian)important or the lives of the innocent who lost their lives because of someones casual approach to his work when flying an aircraft of plus 250 passengers.
    What justification is this when the victims families are yet to receive there dues.

    Can someone explain and justify the same.

    This is not acceptable on any grounds or levels.

    This only goes to show that if a Non Indian is found guilty of such an act, he still benefits because of his nationality.

    HOW STUPID TO SAY THE LEAST.

    God for bid, but I really wish someone from the lawmakers families were the victims of this unwarranted tragedy.

    What would have happened then. all dues would have been immediately dispensed to cover the whole incident.

    This decision of the court to pay compensation to the family of the deceased pilot looks rediculous.Because of his neglegance, the Air India lost the flight and made to pay so much heavy compensation to family of the passengers who lost their life.This is all because of pilot's neglegance.Now court ask his family to pay 8crores.Looks too confusing.Thanq.

    Dear meban person who died on duty (Including all crew)subjected to workmans compansation.All passengers are subjected to Insurance policy of airindia express as well as ICAO convention( monterial) Very simple people talk rubbish without knowing the law.Why blaming the pilot ,what are the contributory factors for pilot to sleep..That is Air India express duty timings.People who are trained to conduct investigation never blamed the pilot for crash they investigated the crash and findings included pilot error.By law he deservees full compansation as per the L Law Jai Hind to all who dont agree without knowledge

    And,I request Court to order Air India to pay Rs.16 crore as fine for keeping such a careless,sleepy,snoring Pilot in its organization,because of him 157 people died.(Pls pay Rs.16 crore to co Pilot who tried his best to wake him up and advised him to follow basic rules,but adamant pilot went against him and rules-voice recorder confirmed snoring and co pilot advice)

    This is utter arrogance of our proud National Air Carrier Air India. When person died in accident, compensation should have been paid instead of delaying the payment by using clauses of decades old Indian Law. But remember friends, Indian Military Personnel from Gurkha Regiments died while on duty on UNO Mission abroad, UNO argued that Indian Military Personnel can’t be compensated in line with British Soldiers died on same mission. Indian Government pursued the case in International Court and I do not know what the outcome was finally

    Though it was Pilot's error it was actually Air India who had over-used him and make him fly non stop for a few days causing him to fall asleep. Air India's greed needs to be punished though a similar high amount also should have been paid to the victim's families.

    Pilot's family has been paid based on Workmen's Compensation Act which is compulsory for all the employees regardless of the nationality (negligence has nothing to do here), whereas the passengers and/or their families are to be compensated based on Warsaw Convention/Hague Protocol/Montreal Convention, both are different, hence the difference in compensation amount. It's unfortunate that the passengers families have not been compensated as per Montreal Convention which is SDR 113,100 (approximately USD 175,000) minimum payment per passenger for death. Rs. 10 lacs per passenger is very paltry sum, AI and AI's Insurers got away lightly.

    80 Million Rupees compensation to the pilot this is totally unacceptable comparing to other passengers because passengers and cabin crews lost their lives due so-called pilot's mistake. As per IATA Convention each passenger’s kin entitled to get the compensation of $ 150,000 but Air India Express hesitate to pay the $ 150,000 to the kin of passenger because Air India Express was paying the compensation as per the economic status of passenger.

    I am the real nephew of the co pilot ...we have big automobile business but his passion was to fly planes my dad use to say when he use to come to factory that tine also he use to read the books of the planes and study hard...we miss him alot

    The labor court is wrong, In USA, they don't say ' 7.45 lac', they say 'Seven hundred and Forty Five hundred thousand' Lac is used in India, Mauritius, Nepal, Pakistan, Seychelles and Sri Lanka.

    Denying insurance compensation to the pilot is ridiculous because he is not Indian. While foreign national can pilot the air craft why this double standard behaviour? Any how great pilot is murdered 158 passengers due his arrogance,ego and carelessness (Sleep while navigating). In this aspect, don't deserve compensation however his braved family will suffer.
